ordinance No. l ~0,4 ~ '~-~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL PROJECT FUND IN THE AMOUNT OF $596,703.29 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE COWTOWN INN PROJECT; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATI=. BE IT ORDAINED BY THE CITY COUNCfL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amoun#s ailacated to the various City departments for Fiscai Year 2004- 2005 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Environmental Project Fund in tl~e amount of $556,703.29 from available funds for the purpose of funding the Cowtown Inn Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shad be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No, 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. ADOPTED AND EFFECTIVE: ~ ~l~y oaf .F®It V~®1'~flg ~'e'.7rr~S SUBJECT: Authorize Execution of Contract with Eagle Construction and Environmental Services, LLP for Asbestos Abatement and Demolition of the Cowtown Inn and Adopt Appropriation Ordinances RECOMAlIENDATION: it is recommended that the City Council: 9. Adopt the attached appropriation ordinance increasing appropriations in the Environmental Management Fund by $ 426,618.59 and decreasing unreserved retained earnings by the same amount; 2. Adopt the attached appropriatinn ordinance increasing appropriations in the General Fund by $170,084.70 and decreasing unreserved retained earnings by the same amount 3. Approve the transfer of $ 426,618.59 from undesignated funds in the Environmental Management Fund (R103} to the Cowtown Inn Project in the Environmental Project Fund,(R101}; 4. Approve the transfer of $170,084.70 from the General Fund to the Cowtown Inn Project in the Envirnnmental Project Fund (R101 j; 5. Adopt the attached appropriation ordinance increasing estimated receipts and apprnpriations in the Environmental Project Fund by $596,703.29; and 6. Authorize the City Manager to execute a contract with Eagle Construction and Environmen#al Services, LLP in the amount of $596,703.29 fnr asbestos abatement and demnlition of the Cnwtown Inn structures at 6855 East Lancaster Avenue. DISCU5510N: The Cowtown Inn property has been abandoned for more than 15 years and has suffered extreme degradation through weather, neglect and vandalism. The City of Fort Worth acquired the subject site on January 2, 2001 through property tax foreclosure proceedings and holds the property in trust for two additional taxing entities: Tarrant County and the Fort Worth Independent School District. Prior to demolition of the nine structures that make up the Cowtown Inn complex, same 981,783 square feet of regulated asbestos-containing materials located in the various buildings must be removed in order for the City of Fort Worth #o be in compliance with state and federal regulations for demolition. A Request for Proposals for the removal of the asbestos and demolition of the nine structures was issued by the Department of Environmental Management nn October 21, 2004, Responses were received an November 24, 2004 from the following firms: Atlas Equipment Company Lo~narne: S2COWTOWNABATE n~„p r „f~ Basic industries Certified/LVI EnviranmentaC, Inc. Eagle Construction and Environmental Services, LLP Entact S"rsk-Robb, Inc. The proposals were evaluated based on apre-determined combination of qualitative and quantitative (bid point) measures. These measures included but were not limited to the evaluation of such factors as previous work experience, qualifications of personnel, contractor capabilities, cast and subcontractors. Based on the total point distribution of the measures, City staff is recommending the contract be awarded to Eagle Construction and Environmental Services, LLP. Eagle Construction and Environmental Services, LLP is in compliance with the City`s MlWBE Ordinance by committing to 62.5% M/1NBE participation. The Gity's goat for this project is 3d%. The Gawtawn Inn is located in COUNCIL DISTRICT 5.
