Boswell, its duly authorized Assistant Citq Manager, and Downtown Fort Worth Incc�rporated, hereinafter re%rred to as "Contractor", acting by and throu$h Crregg Upp, its duly authorized Chairman, do hereby covenant and agree as follows: 1) Tha.t the aforesaid contract for improvements and/ar services in the Fort Worth Improvement District No. 1, between the City and Contractor, dated Oc#ober 1, 1999, referred to as City Secretary Confirac�t No. 25389, be aztd is hereby extended for the pariad beg�nning October 1, 2001, and ternuna�ing on September 30, 2042, but with the £o�lowing amendments t�ieretn: a} Section V, Term, is h�reby a�n�nded by changing the first sentence thereof to read as faliows (p. 4}: "The term a� this cantract will be far a p�riad beginning Qctober 1, 2001, and terminating September 30, 2002." b) Section VI, Pavments #o Contractor, Subsectian C, is hereby changed to read �s follows (p. 4}: - Total r�venues of the District and payments to t�e Cantract shall consist of th� fallowing amounts for t�e £ollowing improvements a.nrllar s�rvices, which a,mounts �re 6ased on twelve (12) mQnths of wdrk: ,��u�,Gw� ��V�u : ��' �� 4�'�9 YYVY:IMYY �� In the case af any unpravements andlor servi�es which the Contractor daes not pro�ide throughaut the en�re {12) manth term af the cantrac#, the Contractar sha11 receive a pra rata payment t� cover the months when such improvements andlor service _ were actually provided. 2.
