THIS LEASE is entered into by and between the City of Fort Worth, Texas, a hom�-rule
rnunicipal corporation situated in Tarrant and Denton Counti�s, Texas, hereiin�.fter called
"Lessor," acting herein by and through NIIf�E GROOMER its duly autharized Assistant City
Manager, and RiCHARD B. CARROLL and JEFF H. HENSON hereinafter re�erred to as
"Lessee".

For and in consideration of the rental payrnents to be paid hereunder and the agreements
of the parties ex�ressed herein, Lessor does hereby Iease, let at�d demise the property described

�escribed as:
A 24.57 acre tract af land situated in the C. R. HARMON Survey, Abstract
Na�, Tanant County, Tex�.s, as recorded in Volume '1309, Pag�e 1g36 of Deed
Recards of Tarrant County, Texas and the improvements located fhereon,
cam�nonly known as 1504 WESTPORT PARI�WAY. FORT WORTH.,
TEXAS 76177 , and rnore speciaily described in Exhibit "A", attached hereto
and incarporat�d herein.
The property described together with any and aIl str�,�ctures, irnprovements, fixtures �nd
appurtenances o�n, over and under said properiy shall be referred to herein as the "Leased
Premises".

LEA�E TERIl�
Tlus lease shal� be far a periad of one (1) year commencing N�VEMBER l, 2001, and
icrminating on OCTOBER 31, 20Q2, unless a prior termina�aan is eff�cted by either party hereta
pursuant to the termimation provisions expressed he�-ein. This lease may be renewed for a
maximum of two {2) successive periods of one (1) y�u each, provided that Lesse�; provides
Lessar wit� written notice of its intent to renew on or before sixty (bOj days prior to the
expiration of the ierfn of the lease or any success�ve renewal thereof. The specified written
notice shail b� effecti�e upon receipt b� Lessar. The terms set farth harein shali ga�em a.nd
control the relationship of the parties hereta during any renewal period, ezcept the rental
amount, whic� may be adjusted ta fair �arket value. LES�OR RESERVES THE R�GHT

As consideration for this lease, Lessee agrees to pay Lessor monthly rental payrnents in

monthly and due in advance of the f rst day ai each month. Payments �nust be recei�ed at the
Aviation Department, 4241 N. Ma.in, Suife 200, Fort Worth, Texas 76106 during normal working
hours by �he due date. Rent shall be considered past dua if Lessor has not received fulj payment
by the tenth (10�) day of each month for which paymenx is due. Lessor will assess a late periatty
charge of ten percent (10%) oF the rental payments due pe�- monfih in addition ta the entire
month's rent for each month £or which rant is past due.

DEPOSIT
(A) Lessee has deposited witfi L�ssar, the �um of ��450.00) rec�ipt of �vhich is acknowl�dged by
Lessor, as seCurity for ti�e full and faithful perforrnance by Lessee of the terms, conditions,
and covenants of this lease an Less��'s part to be performed and kept. This deposit daes not
constitut8 adva,nce payment of the fi�al rental payment due under this le�se, unless the
express canditions specified in Subsection (I) ar� met.
(B) Lessor agrees to hald such depoait for Lessee, and it is understaod that Lessor's claim to such
deposit shall be prior to any creditor of Lessee, exclud�ug a trustee in bankru�tcy.
(C) Excluding thE final rental payment to �e made under tYus lease, if at any tirne during the lease
term, Lessee de�aults in the payment of rent or any portion of rent reserved in this lease, or of
any otlaer sums expressly constituting rent, ather than advance renta.l payments, Lessor may
appropriats and app�y any portion ofthe security depasit as may be necessary ta the payment
oithe ov�rdue rent or oiher sums expressly canstituting rent under this lease.
(D) If at any ti�e during the lease term, Lessee should faii ta repair any daxnage to the leased
premises tha.t Lesse� is required to repair under the terms of this lease �or a geriad grea�er
than thirty (30) days after Lessar aerves on Las�ee written demand to mal�e such repair, then
Lessor may appropriate and �.pply any portian o£ the security deposit as may be reasonably
necessary to make such repairs.
(E) If on �termination ofthis tenancy for any reason, Lessee does not �eave �he leased pr�mises in
a reasana.bly clean condition and in good repair, excluding r�onmal wear and tear, then Lessor
may appropriate and apply any portion of the security depasit as may be reasonably
necessary to put the premises in clean con�ition and goad r�aa,ir. As used in t�is lease
"noxmal wear and tear" means det�rioration that results fram the intended use of dwelling,
and does not include deterioration that results from negligence, carslessness, accic�ent, or
abuse of the premises by Lessee, by a member af L�ssee's household, or by a request of
Lessee.
(F') In #}�e event actual cause exists for retaining all or any portion of the security deposit, Lessor
shall return #he balance o� the security deposit, i� any, together with a w�itten description and
iternized list o� all deductions. Such deductions shall be limited to darnages artd charges for
which Lessee is legaily liable under this agre�ment or as a resutt of breac�ing this agreement.
Lessor sha11 not be required to furnish a description and iternized list of deductions if there
are any rentals due and unpaid at the time Lessee surrenders possession of the gremises and
there is no controversy over the amount of rentals due and unpaid.

(G}Within thirty (30) days of when Lessee surrenders the premises, any remaining portion di the
security deposit, after any law£ul deductions as above, sha41 be retumed to Les�ee directed to
the address left by Lessee specifieally for auch purposes. HOWEVER, LES�EE SHALL

(� Should Lessar transf�r Lessor's interest under ��is lease in a,ny manner, Lessor must da one
of th� following acts, either of which wiil relieve Lessar of further liability with respect to
such deposit:
(1) Transfer the portion of such depasit remaining a.fter any lawful
deductions, as abave, to tl�e successar in interest, and th�reafter notify Lessee by
registered mail af the transfer and the transferee's na.me an�d address. On receipt
af Lessee of a stat�ment signeci by the succ�ssor in interest acknowledging receipt
af and sesponsibility for the security deposit, Lessor's successor in intere�t shall
have all of the obligation� oFLessor with respect to such deposit; or
(2) Return to Lessee the portion of such deposit r�maining after any Iawful
deductions have heen made.
{Z) if Lessee has provided notice o� surrender of the Leased Prenaises in accordance �vith
Subsection (G) herein, and Lessor, in its sole discretion, det�rrnines that the leased premises
are in sat'ssiactory condition and have �een rna.intained in good repair, Lesaee may elect to
have the balance af ihe security deposii appjied to Lessee's final payment due under this
lease agreernent.
SEC'TIUIiT G.
PAYN�E�TT OF UTILITIES
Lessee shall be respansible for �lae payment ot' all utilities. Lessee must pay promptiy, as
they become due, all charges iar the fixmishing of water, sewer, gas, electricity, garbage service,
and other publzc utilities to the leased premises during t�� term of this lease.
SECTi01� 7.
TAXES
Lessee shall pay promptly all taxes, monthly charges, assessm�nts and/or levies of any
naxure or charact�r whatsoever which may be lawfully assessed, �axed, levied or made against
the leasehoid estate hereby created and/or any impravemen#s or personal property located on the
L�ased Premises.
�ECTIOI�T �.
RESIDF.1�TiAL
The Leased Premises shall be used solely and exclusively for private residential purposes
�or Lessee and their immediate family. Lessee further agrees tl�at Lessee shall not canduct any

commercial use at the Lea�ed Pr�mises without prior written appraval vf Lessor and any
unautharized cammercial use shall constitufe a breach of tlus lease. �
�ECTIOl� 9.
EVICTI01�i AA1D �iBA1�TDOl�IirlEl�T
A. Lessor shall b� entitled ta institute pxoceedings to e�ict Lessee from the �remises, a# any tirne
that Lessee is in default under this lease or holds over after the �xpiratian of the lease term or
any successive renewal terms, a.�d Lessee hereby speci�caZly �va.ives any rights it may nave
to the follawing:
1. Natiee by Lessor of termination of the tenancy;
Z. Any n�tice to vacate or quit the prer�ises as specif�ed in the Texas Property Code,
Seetion 2A�.005 (a}; �nd
3. Any other nofices required by law.
$. In the �vent the Lease is terminated far �ny reason or Lessee abandons or is evicted fratn the
pre�ses, Lessor shall not be respa�sible �or any r�al ar per�onal praper�y of Lessee
rerna.ining on the premises at the time of said eviction, abandonment or terrninatian, and said
persor�al progerty shall be deerned abandoned by Lessee if it remains on the premises at any
tisne subsequent to the termination of Lessee's lawiul possessian of the premises.

Lessee sha11 cornply wit�i all applicable l�.ws, ardinances and regulations prevailing in the
jurisdiction in which the Leased Premises are Iocated, including but not limited to federal, state,
local laws and the City ardanances, rules, regulations anc� specificatiQns.
SECTION 11.
REP�IIR�
A. Lessee agrees tk�at Lessee shall maintain the Leased Premises and keep �ame in good repair
at Lessee's sole cost attd expense. All mainten�nce, rninor repairs and upkeep of the Leased
Premises shall be in aecordance with all appl�cable laws including Ciiy ordinances, rule�,
regulations, and specifications.
B. Lessor �nd Lessee agree that Lessee will repair or remedy any of the followin�
con�difrons that occur dnring #he lease term nr a renewal or e�tensivn of the t�rm
provfded the conditian is not caused by the Lessor's negligence, such repairs and
remedies to be made at the Lessee's e�pense; 1) dama�e from wast�water st4ppsges
�aused by foreign or improper objects in lines tl�at e�clusively serve the Lessee's
dwelling; �) dama�e to daor�, windows, or screens; and 3) dama�e from windows or
doors left open. 'Y'�is pravision constitutes a waiver af t6� Lessar's statatory dufy to
repair or remed� such cond'rtions nnder Subchapter B, Chapter 9� of the Te�s
Property Code. This waiver is made �owin�ly, voluntarily, and fur consideratian,
receipt af which is acl�naw�edged. This Provision does not re�ieve the Lesso� of the
statuto�ry daty und�r 3ubchapter B, Chapter 9�, of the Texas Property Code to repair

or remedy, at the Lessar's ezpense, wastewater stoppages nr bac�ups caused by
deterioration, breakage, roots, �round conditions, faulty construction, ar
m��functioning eyuipment.
C. Lessor hereby agr�es to make a�y rnajor repairs to the premises up to the amount of $1,500
psr year upan written request oiLessee, however, if the cost of the major repairs is more t�iaz�
$1,500, �..essor will d�termine, at its sole discretion, whethe:r to repai� the premises or notify
the Lessee that the lease will be terminated according to Section 1b.

HOLDO�EI2
If the �.essee holdsover after the lease or renewal p�riads e�p�re, a month-tamonth t�nancy shail
be crea��d with all other t�rms in this agreement remaining in effect, except that Lessor �nay give
Lessee 60 day� natice to terrninate.
�ECTi�OI�T f3.
II'V�PRO�JEIR�ENT�
Lessee shall not canstr�ct any impravements or structures on the premi.ses without the
prior written consent of Lessor, and all improvements constructed on t�� premises shall be
canstructed ai Lessee's sole expens�. L�ssee must maintain and protect �11 improvements,
structures, fences or appurtenances existing an the Leased Premises. Lessee caven�a.nts and
agrees �hat Lessee si�all not be entitled to a,ny reimbursement for the cost or value of said
improvements, structures, fences ar appur�enanc�s. In addition, o� or before the termination date
of this lease, Lessee shall be responsii�le for removing any re�.l ar persona.l praperty owned or
otherwise belonging �o Lessee and not deemed to be the properly of Lessor. The re�noval of all
reai and personal property ofLessee sha11 be accomplished solely tk�rough Lessee's efforts and in
removing any of Lessee's real or persona� property from the Leased Premises subsequent to the
terrnination of this lease. The Leased Premises sha11 be deemed to ha.ve been abandoned by
Lessee if Lessee does not use and occupy said premises in accordance wiih the purposes of this
lease term or a.ny successive renewal per�ad. Tl�is Iease sha.�l be terminated u�on the
aba�donmen# of the Leased Premises withaut notice to Lessee.
SECTIOI�T 14.
51Vi�I�E DETECTOR
A. Le�sor must install at least one smoke detector in the Leased Premises in accordance with
Sect�ons 92.255 and 92.257 of the Texas Praperty Code.

C. Lessee agrees to inspect the smoke detector installed in the premises at the beginning of
Lessee's passession and at regular intervals oiihree (3) rnon.ths thereafter to determi:ne that
it is in good woricing order. Lessee must bear the cost of repairir�g the smoke detector.

AS�IGAI�YEl�1T OR �UBLEA�E�
Lessee shall not assig�. or sublet this lease without the prior written approval of Lessor,
and any such ur�authoriz�d assignment ar sublease shall constitute a breach of this lease.
�ECTIOl� 16.
TERI9�YII�TATIOI�T
Lessor shaJl have t�e right to terminate tlus lease at ax�y time %r any reasan unrelated to
Lessee's de�ault ar breach of any of the terms expressed herein by giving Lessee thirty (30) days
written notice prior to ths intended t�rminatian date. Lessor may terminate the lease
immediat�ly upon any default or br�ach of any of ths pravisions hereunc�er without any prior
notice to Lessee. Sairl notices sl�all be deerned effective as oFthe date they are mailed. If Lessee
elects ta ternvinate the lease because of any alleged default or breach by Lessor or any lease
provisions, Lessee shall be required to give Lessar immediate n�tice of said aurten�ion in writ�ing
stati.ag specifically the rEasons therefor and allowing Lessor �hirty (30) days after i�e date of
Lessor's receipt af such notice to cure any or all dsfault{s) ar breach(es) specified in said notice.
If the specified default(s) or breacl�(es) of Lessor are cured within said thirty (30) day period,
Lessee �hall be deemed ta have waived said specified deiault(s} or breach(es}, and this lease
shail cantinue to be effective unless termir�ated pursuant tQ some other provisions specified
herein or by virtue of some subsequent uncured default or breach of Lessor, in wl�ich case Lessor
s�rall be entitled to any additional notice period required by the terms af this lease,
If t�is lease is terminated under this Section, or as a result of ihe expiration of the lease
ter�r► ar any renewal period, neither p�rty sha11 ha�e any further obligation ar liabi�'sty to the other
under this lease, except t.�at Lessee shali be liable for th� breach of any term, covenant or
condi#ion cofltained in this lease occurring prior to the date af the surrender of the preini�es by
Lessee pursuant to the ternv�ation. Lessee sha11 be baund hy t�e terms, covenants and
candi�ians ex�ressed herein until Lessee surrenders the premises regardless of whether the date
af surrender coincides with the date af termination of the lease. The waiver by Lessor of any
de��.ult or breach oi a te�tn, cover�ant or condition af this lease shall not be deemed to be a waiver
oi any ather breach of that term, covenant ar car�dition or of any other term, cavenant or
conditian of this lease, regardless o£when the breac� occurred. Furthear waiver by Lessor of any
default or breach of a term, covenant or condition of this lease sha11 in no way impair the right of
the Lessor to avaii itself of ar�y r�mady for any subsequent breach �hereof.

SECTIUl�d 18.
Il�T�URAI�TCE
It is hereby agreed that Lessee will provide Lessor with a certificate oi insurance
documenting liability insurance �t a minimum limit of $340,000 each occurrence as respects fhe
property and premises addre�sed herein. The effecti�� daie af in5urance caverage shall be
camcnensur�.te with the term of the lease. Lessor s�aall be er�dorsed as an additional insur�d in the
certific�te. The insurer of Lessee's liability insurance shall be accepta�le to ihe Lessor insofar as
the company's financial strength and solvency. The policy prnviding liability insurance shall be
endorsed to provide Lessor with a minimum thirty (30) day notice af cancellation, nan-renewai
nr materia� c�a,�g� in cove�age. Lessor's insurance requirements may be revised at Lessor's
aption, and Lessee shall respand accordingly within thirty (30) days of Lessee's receipt of a
written notice of such requirement. Any failure an part of Lessor to request cert�cation of
insurance required herein shall not be construed as a vvaiver of such requirement.

Mailing of all noticas pursuant io this Sectinn shall be deemed sufficient if mail�d

of an�+ change uz the other party's address. All time periods related to any natice requirements
specified in this lease shall commence either on the date notice is rnailed or on the date notice is
received by the party ta whom it is sent, depending on the terms specif ed in the Section
requiring notice.

This lease shall constitute �he entire agreement af t�e parties of tl�is lease and shall
supersede any prior agreements of said parties, either oral or written, pertaining ta �i�ae subject
matter specifi�d herein.

Thi�s lease and the relationship created hereby shall be governed by the laws of the Sta�e
of Texas. Venue for any aetion brought ta interpret or er}force the terms of this lease or �ar any
breach af tlus lease s�all be in Tarrant Caunty, Texas.
SEC'T��N ��.
1'1�5CELLANEOUS PRO�ISI4I�'�
A. This lease does n�t give Lessee any rig�t to use, rnine, lease or otherwise derive any benefit
frorn a�y ail, gas, caa1, gravel, minerals, tree� ar deposits ai any type or nature, and title to all
of said substances sha11 remain in Lessor. In addition, Lessee shafl not have ar�y right vr
claim to any damages or other monetary compensatian �or or related to any surface dannage
resulting from mining, drilling ar otl�er'op�rations related to the removal af u�tilization of any
such substances.
B. Les�ee shall nat co�r�rnit nar allow any waste to be c��runitted an the Leased Premises, nor
shall Lessee maintain, commit or p�rnvt the maintenance or commission of any nuisance on
the Leased Premises nor use the L�ased Premises for any unlawful purpose.
G Lessee hereby represenfs that Lessee takes the Leased Prem�ises in good condition and t�ie
Leased Premises are suitable far the purposes specif ed h�r�in. Lessee hereby waives the
right to terminate this lease or sue for dam�.ges or pursue any other remedy against Lessor
based on any patent or latent defects in, to or on the premise�.
D. With respect to conditions that materially affect tha physicai health or safety of an ardinary
tenant, Lessor Fnust make a dili�er�t effort to r�pair or remedy the con�ition if Lessee
specifies the condition in a no#ice to the Real Property Management o�ee, Ci�,y o� Fort
Worth, 927 Tay�ar Str�et, Fort VVorth, Texas 76102. Lessor is not required to �epair or
remedy sixch condition if Lessee is delinquent i:� the payment of rent at the time of giving
notice of the coandition, other than normal wear and tearr, wa� caused during the lease term by
Lessee or Lessee's family or guest.
D. Lessor r�serves the right to enter upon the Leased Premises at a.11 reasonable times far the
purp4se ai inspecting the premuises or otherwise using the premises, provided that an.y suc�
entry doss not conflxc� with Lessee's rights hereunder.
Tiris �ease sh.all be binding on the heirs, successors and lawiul assignees or sublessees of
Less�e and the successors or L�s�or. Any person or entity using or occupying the Leased
Prernises without a lawfixl assigt�ment or sublease shall be subject to all the responsib�ities and
liabiliti�s of Lessee set forth hereunder and shall be subj�ct to all the provisior�s regarding
�ermination and eviction set forth herein. Any such person or entity shall be daemed to be an
agent or rapresentative oiLessee and sl�all be deemad to have notzce of the terxns, cnve�ants, anct
conditions ofr this iease.

employees, invi�ees and licensees af Lessee.
