WHEREAS, Cent�x Homes, A Ne�ada General Partnershi�, hereinafter
cal[ed "De�reloper", by C�ntex Homes Real Estate Corporation, A Ne�acla
Corporation, Its Manaqinq General Partner, desires to make certain
impro�ements #o Harriet Creek Ranch Phase 1, an addition to the City of Fort
Worth, Texas; and
WHEREAS, the said Developer has requested the City of Fort Worth, a
municipal corporat[on of T�rrant and Den�on Counties, Texas, hereinafter caflecf
"City", to da certain work in connec�i�n with said Empror�ements;
NOW, THEREFORE, KNOW ALL BY THESE PRESENTS:
That said De��loper, acting �erein by and through Robert J. Romo, its
duly authorized V�ce PresEdent and the Ci�y, acting herein by and through Mike
Groomer, its duly authoTized Assistant City Manager, for and in consideration of
the covenants anc� conditions cor�tained herein, do hereby agree as folEows:

A. The City agrees to permit the De�eloper to �et a contract for, in accordance
with its accepted practices, ordinances, regulations, and the provisions af
the City Charter, and subject to the requirements of the City's Charter, and
subject to the requirements of the City's Policies anc� Regulations for
Installation of Comm�nify Facilities, all as current at the #ime of installation:

attached Exhibit A�'! all in accordance wifih plans and specifications to
be prepared by pri�►ate engin�ers employed by the De�eloper and
appro�ed by the Water Department.
B. The City agrees to al[ow the De�eloper to install, at his expense, at the
time all other water mains in ihis addition are installed, a service line for
each lot as shown on the attached Exhibit A. The estimated cosfi of
these service lines is $�7�,80D. The Ci#y agrees to record the loca�ion of
each said sen►ice line in respect fo the corner of #he lo# served, and to
re�ain said records in its possession.
C. The canstruc#ion cosf of �he water facilities herein concerned, exclusive of
service lines and engineering is estimated to be �ix bundr�d, Seven�v
ihousand, and Sevenfv-�even Dollars {$670,D77) .
D. The City agrees ta a[law fhe De�eloper �o install, at his expense, at th�
time all otner sar�ifary sewer mains in this addi#ion are installed, a serrr�ce
line for each lot as shown on the attached Exhibit �-'1 . The estimated
cost of these service lines is $�97a,8O0. The City agr�es to record the
location of each said service line in respect to th� corner ofi fhe lot served,
and to retain said records in i#s possession.
E. The construction cast of the sanitary sewer facilities to be installed
hereunder, exclusi�e of service lines and engineering, is estimated to be
Seven Hundred, �ori�a�heee ihousand, i�ine Fiund�ed Fif��o�iqht
Dollars ($7�3,95�1.

F. Prior to allowance of the construction contract by De�eloper, t�e Developer
agrees to pro�ide accep#able financial guarantee to tl�e city far 10D �ercent
of the construction of the canstruction cos�s along with payment of any
�rdinance costs and fees �hat are applicable. Prior to the awarc4 of �he
construction contract by tl�e Ci#y or fihe commer�cing of any work by the
Cify or its contractors, the �eueloper agrees to pay to the City:
(1) (a) One Hundred percent (10�%} of fhe Dev�loper's cos# of all water
a�d sanitary s�wer faciliti�s within the development, exclusi�e of
engineering and service costs, sized to provide wa�er and sani�ary sewer
service within the development.
(�}One hundred percent (100%} of fhe De�elo�er's cast of alf
approach water and sanitary sewer facilities outside the limits of the
development sized to pro�ide water and sanifary sewer service to the
development.
(c) One hundred percent (100%) of the Developer's cost of any
approach water main facility or water facility wifhin the development that is
8-inch�es in size for non-industrial developm�nt and 12-inches in size for
industrial deveiapment. .
(d} One hundred percent {1 QO%) of the Deueiop�r's cost of any
approach sanitary sewer main facility or sanitary sewer facility within the
development that is 8-inches in size.
(2} An additional ten percent (10°!0) of the tatal of the Developers cost
of these water and sanitary sewer facilities, exclusi�e of cost of service
lin�s, is required for design engineering if such engineering is perfarmed
by the City at the De�efoper's request.
{3) One hundred percent (100°10) of the Develop�r's cost of all service
{ines, estimated under 1-B and 1-D abave, in accordance wi#h the
provisions of tY�e current Fort Worth City Code.
(4) A construction Inspection Fee equal to two (2%) of the De�eloper's
actual cos# share of the construction cost (including all services} of the
wafer andlor sanitary sewer facilities.
G. The distributior� of estima#ed construction cost between the City and the
Developer, as per paragraph 1-F abo�e, for all wa�er and sanitary sewer
facilities to fae constructed hereunder is estimated as follows:

H. ihe above cl�arges do not �nclude any front foot charges for connectian to
existing or praposed water a�dlor sanitary sewer mains constructed or to
be construc�ed under the provis[ons of tF�e "APPROACH MAIN OPTION"
as described in Section III of the Palicy for the "INSTALLP►TION OF
CO1111MUNiTY FACILITIES" adopted in Se�#ember, 1992. These
additional charges are as follows:

l. When water facilities are �nstalled by contract, instalEation of wa#er
services wi[I be inciuded as part af the contract. Installation of ineter
boxes on those services may be done by the.City, after completion of
construction of all relati�e curb and gutter work an the water facilifies
project site, at a cost of $701$135 per contract-instafled charge to be due
and payable prior to issuance of a Work Order on the wa#er faci�ities
installation contraet. The abo�e c�arges do not apply if the Develaper
elects to include me�er box instal[ation as part of the cor�tract. HoweWer,
meter boxes must conform City standards.
J. Within a reasonable time after completion of the aba�e referenced
faci�ities to be constructed by contrac# awardec� by �he Develaper,
�rovided al! conditions for City participatian haue been m�t, the City
agrees to pay the De�eRaper the "Estimated Ci�y Cost° set out in 1-G
above; provided, however, that saicf payment shall be calculated using the
actual construction costs and actual service costs under the pro�isions of
the current Fort Worih City Code, (said pa�ment to be calculated as in 1-
G abo�e), based on actual quantities as ref�ected in the final estimafe paid
to the Contractor by the De�eloper and on t�e actual records of cost �Cept
by the City as a part of its c�asfamary prac�dures. In the event the
difference in the d�posit and the ac#ual costs exceeds $25, De�eloper
agrees to pay to �he Gity and underpayment whicY� said adjustment mig�t
indicate as being due, and the City agrees to �ay #o Developer any
o�erpayment.

K. Work hereunder sF�a11 be completed wi#hin �wo {2) years from date hereof,
and it is understood that any oa�igation on the �art of the City to make any
refunds with respect to water andlor sanitary sewer facilities shall cease
upon the expiration of twa (2} years from date hereof, except for refunds
due from "front foot charges" on water and sanitary sewer mains, which
refunds may continue to be made far a periad af ten (10) years
commencing on the da�e that approach mains are accepted by the
Director. If less than 70% of the eligil�le collectians due to the d��eloper
has been callected, the �eveloper may request in writing an extension of
up to an additional 10 year5 for collection of firont charges. In the e�ent
water andlor sanitary sewer facilities work is not completed wifihin the �2)
year periQd, City may, at i#s election; complete such work at De�eloper's
expense.
L. It is further agree� and understood #hat any a�ditional payment required
of De�eloper is to cover only such additional work andlor materiaEs as
m�y b� made necessary i�y conditions encountered during canstruction,
ar�d shall not include any change in scope af the project.

A. The De�eloper(s) agree to install or to cause to have installed, the street, storm
drainage, street lighting, street name sign and other community facilities
improvements shown as "current improvements" on the attached Exhibi�s �, �1,

B. The Developer agrees to comply wifh a!I city accepted practices, or�inances,
regUlations, as well as provisions of the City Charter, the City 5ubdivision
Ordinance, City Design Standards and the current Policy for Installation of
Community Facifities in the design, con�racting and installation af required "current
improvements".
C. The De�eloper agrees to comply with the General Requirements confained herein
(Atfachment A}.
D. As shawn on the attached "Summary of Cost", the Developer agrees to fund his
share of "current improvements" and to pay the City for his share of the cast af
street, storm drainage, sfreet lighting, street name signs as shown on the attached
Exhibits �, �1, C and D.
E. Payment is due at the time this agreement is executed by the City and the
Developer. .
F. The estimated total cost of current improvements and related s�pport services
specified in this agreement, including design, construction and inspection is
estimafied to $3.�24,615.
[n accordance with the City's current Policy for lnstallation of Community Facilities
as shown in the Cost Summary on page 3.
The Developer shal[ contribute �o[lars �2,833,113. of the total amoun�.
The City shall contribute �ollars $691,�U2.
G. Developer agrees to pro�ide, at his expense, all necessary rights of way and
easements required to construct current and future improvements provided for in fihis
agreement.

H. �eveloper agrees ta relieve the Gity of any responsibilities for any inadequacies in
�he preliminary plans, s�ecifications and cost estimates supplied for the purpose of
this contract.
I. Deveioper also agrees ta insfiall or adjust all of the required utilities #o serve the
de�elopment or to canstruct the improvements required herein.
J. Developer agrees that no street construction or storm drainage will begin prior to
City Council approval of #his Community Facilities agreement. (Article 104.�00,
Ordinanc� 7234).
K. De�eloper agrees that no lot shaf! be occupied until impro�emen#s requi��d herein
have been constructed (Article 1D4,�00, Ordinance 7234).
L. De�eloper agrees to complete the improvemenfs covered by this agreement within
90 calendar days after ha�in� been instruct�d to do so, in writing, by fhe Director of
Transportation and Pub�ic warks. It is understood that the developer will initiate the
construction of all improvem�nts to conform with his awn schedule, except for thase
improvements which the Transportat�on and Public Works Director deems necessary
for �he proper and orderly de�elopmen� of the area. fn the event De�eloper faiis to
carry out any such instrucfions within the 90-day period, the Developer gives the Cifiy
the right to design and award a contract, and inspect the im�ro�emenfs in question,
and agrees to pay to the City prior to the award of the contract, the amount af t�e
low bid.
M. City participation in "current impro�ements" shall not exceed 125% of cost shown in
Summary of Cost.

2. STREET LIGFiTS WORK DESCRYPTION:
1. The Developer shall provide for the installation o� streetlights at
the approximate locatians shown in �xhibit "C", immediately after
�ina]� acceptance of the street construction, in accordance with
engineering plans and specifieations approved by �.he Transportation
and Fublic Works Department.
2. Streetlights nn residen�a.a�. and /ar collectar streets can be
installed using overhead or underground con.ductors wi�h �he approva�
of the Director of Transpor�a�.ion and Publ.ic Works.
3. 5treetlights on �rterial streets shall be instalI.ed with underground
conduit and conductoxs.
4. The Developer shall provide for �he a.nstallation of a 2-inch
schedule 40 PVC candui.t at a depth not less than 3Q inches and a�
least 18-inch behind the curb, "clear from a11. o�her utilities".
5. The Developer shall provide for the installa�ion of a 2-inch
schedul.e 40 PVC condua.� between streetlights proposed for
insta�lation and the power source to become opexa��.onal.
6. A 3-inch schedule 80 PVC conduit is requir�d when cxassing streets
at a depth not less than 30 inches, unless indicated otherwise on
the plans concre�e pul� boxes shall be provided at the c�ossing
points.
7. The develop�r shall pay a four percent (40) fee of the construc�ion
cos� far construction engineerinq and inspec�ian of the street light
installation.
8. Street light conduit and footings shall be install�d by the
developer's contractor as part of and at ihe time of street
aonstructian. The city will obtain electric service and complete the
s�.reet light construction in accordance w�th approved plans.
9. The developer or their con�ractor sha11 contact City's stree� light
division 48 hnurs prior to starting any ins�.all.a�ion of conduit
an.d/or streetlights at ($17) 871-8100 �o insure �roper inspeetion of
work.
10. The procedure for installing conduit and footings will be with the
inspeator on the job site or you can raquest a copy by calling 817-871-6596

A. It is a�reed and understofld by the parties hereto that the developer shall
�m�loy a civil engineer, kicensed to practice in the State af Texas, for the
design and preparation af plans and specifications for the construction of all
current impro�ernents co�ered �y this contract, subject to Paragraph B.
B. For any �roject estimated to cost less than $10,000 or for any project
designed to ser�e a single fot or tract, the de�eloper may, at his option request
the City to pravide the design engEneering, and if such request is granted, the
developer shall pay to the City an amount equai ta 1 � percent of the final
constructio� cost of such project for such engineering services.
C. In #he event the developer emplays his own engineer to p�epare plans and
specifications for any or a�l current impro�ements, the plans anc! specifications
so prepared shall be subject to appraval by the department having jurisdiction.
One t11 reproducible set of pians with � 5 prints and 35 specifications for each
facility shall be #urnished the department ha�ing jurisdiction. It is agreed and
understood that in th� event of any disagreement on the �1ans and
specifications, the de�ision ofi the TransportationlPul�lic Warks Depart�nent
Director, andlor Water Department Directar wilk be final.
D.� It is further agreecf and understoad by the parties hereto that upon acceptance
by the City, title to ali facilities and improvements rnentior�ed hereinabove shall
be �ested at all tim�s in the City of Fort Worth, and de�elaper hereby
relinquishes any right, title, or interest in and to said facilities nr any part
hereo#.
E. ft is further agreed that the decision of the City to nnt collect funds for "ftature
irnpro�ements" required in pre�ious CFA agreements daes not cons�titute an
obligatio� on the part of the City to constr�ct such "f�ture improvements" at
its ex�ense.

effect at the time of such renewal, Developers must r�cognize that City funds
may not be availab{e ta pay' alf or a}aortion afi the narmal City share far
renewal cflntracts. lt must be understood by all parties to the Community
Faciiities Contract that any of the #acjfities or requirements included ir� the
contract that are to b� performed by the de�eloper, but not perfo�med hy the
de�eloper within the time periods stated above, may be completed by the City
at the de�eloper's ex�ense. The City af Fort Worth shall not be obligated to
make any refunds clue ta the dev�loper on any facilities construct�d ur�der this
,, agreement �ntil all provisions of the agreement are fulfilled�
G. PERF�RMANCE AND PAYMENT GUARANTEES

Performance and Payment bonds or cash deposits acceptable to the Citiy
are rec�uireci to be furnished by the developer for t�e installa�ion of
stre�ts, storm clrains, street lights, and street name signs, on a non-
assessment basis, and must be fumished fia the City prior ta execution

of this cantr�ct. The performance and payment 6onds shaif be in the
amount of ane hundred percent (100%} of the developer's estimated
share of the cost of t�e streets, storm drains, street lights, and street
narne signs. if the deposit is in the farm of casF�, the deposit shall be in
the amaunt of one hundred twenty #ive percent [125%) of the
c���eloper's estimated cost of the streets, storm drains, street I�ghts,
street name signs, and change arders (duri�g the course of the project).
2, �or Future lmarovement:
Performance and paym�nt bands or cash de�osits, acceptabl� to the
C�ty are required to be furnished by the developer for one hundred
percent {10Q%j of the devel�per's estimated eost resulting from the
paving, drainage, lighting and name sigrtage of border streets on an
assessment paving basis. (Reference Section VI, ftem 3, Developmen#
Pracedures Manual.) Said performance and payment boncis or cash
depos�ts must be furnisl�ed ta the City pr9or to exec�ti�n of this
contract.
Wh�re the City lets the contract, performance and payment bands shalk
be de�osit�d, in the amount of one hundred Qercent �100%j of the
estimated cost of canstruction as stated in the construction cantract, is
requireci prior to issuance of a work order by the City.
3. For Water and Sanitary Sewer Facilities,:

4-. Tvnes af Guarantees:
a. Perfor.mance anci Pavment Bands.: Are required for the
canstruetion of streets, storm drains, street lights, and street
name signs, the foilowing terms and conditions shai{ app�y:
{ 1) The bonds will be standard perfarmance and paymen�t bonds
provided by a ficensed surety campany on farms furnished
by that surety company.
�27 The bands wifl be sui�ject to the �eview and approVal by the
City Attorney.
(3) The performance bond sha11 b� payable to the City and shall
guarantee performance of the street, storm drain, street
light, and street name sign construc�ion contemplated under
t�is contract.
(4} The Payment Bo�d shail guarantee �ayment far al� labar,
materials and equipmen�t fiumished in connection with the
str�et, storm drain, st�eet light, and street name sign
canstruction contemplated under this contract.
(5) In order for a surety company to be acceptable, the name of
the surety s�a1i be included on the curr�nt U.S, Treasury list
of acceptabte sureties, and the arnount of bond written fay
any or�e acceptab{e company shall not exceed the amount
shown on the Treasury list for that campany.
b. Cash Deoasits: A cash deposit shall be acceptaF�ie with
verification that an attempt �o secure a bond ras been der�ied,

such deposit shafl be made in the Treasury ofi the City of Fort
Worth. The City of Fort Worth will not pay interast on any such
cash deposit.
(� j At such tim� that the contract is bid far prajects other than
assessment prajects, the cash depflsit shall be adjusted to
one hundred twenty five percent f 125%1 of the actual t�id
price. Na contract shall be awarded ar�d no work order shall
be issued until such adjustment is made.
(21 When a cash deposit is made, the additional twe�ty-five
psrcent �25%) beyond the one h�undred perc�nt (lOQ%j af
the estimated developer's s�are represents additiana) fiunds
#flr change arders during #he course of th� project. This
twe�ty #ive p�rcen� (25%) shail be considered the
develo�aer's cha�ge flrder funt#.
(3i If th� devefaper makes a cash ciepasit with the City, the
developer may malce timely withdrawals from the cash
funds in arder to pay the contractor andlor subcontractor
based on amo�nt of constructio� work complefied as
appro�ed an�l veri�ied by the City Engineer or autharized
representative, For �rojects wF�ose actual total contrac�t
cost 'ts $40Q,0�0 or greater, such refease of security shail
equal the percentage of work com�leted for that period
multiplied by �inety-five percent (95%j. This p�rcentage
shall be applied to t1�e actual current total contract cost to
determine the amaunt that rnay be reciuced upon request of
de�eloper. Far projects whose actual tQtal cor�tract cost is
less than 5400,000, s�ch release o� security shafl equal the
percentage af work completed fior that period multiplied by
ninety �ercent t90%}. This �ercentage shail #hen be applied
to the actual current tatal contract cost to determine the
amount of secur�ty that may be reduced upQn request af
develaper. The remaining security, �five pe�eent (5 °�6) for
projects of 540�,000 or greater a�d t�n percent (10%) fior

projects less than $4�0,000 together with the remaining
funds from the De�elaper's Change Order F�nd, if any, will
be , released to the develaper after the project has been
accepted by the City. Partial release of fu�ds shall be limited
to once per month. There shall be na partial release of funds
for projects of I�ss than 525,000. Proof that the de�eloper
has paid the contractor shall be required for partiai releases.
5. Pur�ase, Term and Renewal of Guaran#ees:
a. Performance and payment bonds, and cash deposits furnishe�
, hereund�r shall be for the purposes of guaranteeing satisfactory
compliance by the develaper with al� requirerr�ents, terms and
conditions o� this agreement, includir�g, but nat limited to, the
satisfactory completian of the improvements prescrilaed herein,
ar�d the making of paymen#s to any person, firm, corporation or
other entity witY� whom the de�eloper has a direct contractual
relationship for the performance of work hereunder.
b. Developer shall keep said performanc� and payment bonds, andlor
cash deposits in full force ar�d effect untfl such time as d�veloper
has � fiully complied with the terms and conditions of this
agreement, and failure to fceep same in force and �ffect shall
cons�+tute a defaul�t and breach ofi this agreernent. .
H. The City sha11 assume its share of the cost of the im�aravements covered by
this agreement alang wit� the engineering fee only if funds are available fnr
such participation. In the ev�nt that no funcis are availabfe for City
participation, the developer sF�aik award the contract and deposit with the City
a performanc� and {�ayment bonds or cash for 100 percent of the estimated
Cotal construction cast af the improvements [plus ten percent (10%) far
engineering and miscellaneaus costs if the City prepares the plans].
i, On all faciliti�s included in this agreement for which the devefoper awards its
own canstruc�ion contract, the de�eloper agrees to follow the following
pTocedures:

1, kf the City participates i� the cost of the facilities, the construction
contract must be advertised, bid and awarded in accordar�ce with 5tate
statutes prescribing the requirements for the letting of contracts for the
construction of public wark. This includes advertising in a focal
newspa�er at least twice i� one or more newspap�rs afi general
circulatior� in the county or counties in which the work is to be
perform�d. The secont4 �ublicatior� must be on or 6efore the tenth
(1 Dth) day befare the first date bids may be submitted. The bids must
be opened by an officer or employee of the City at or in an office af the
City.
2. To employ a construction contractor, who is a�proved by the Director of
the Department having jurisdiction over the fiacil�ty to be sn constructed,
said contractor to meet City's requirements for being insured, licensed
and bonded to do work in public right of way.
3. Ta require the contractor to furn�sh to the City payment, performance
and maintenance bands in the names of the City and the developer for
one hundred percer�t �Z 00%) af �the cantract price of the facility, saic{
bands to be furnished bEfore woTk is camme�ce. Developer further
shall require the contractar to pravide p�blic IiabiEity insurance in the
amour�ts required by the City'.s specifications cov�ring that particular.

� 4. Ta gi�� 48 hours notice ta the department �aving juris�ietion of inten�
ta commence construction ofi the facility so that C'tty inspection
personnel will be available; and to require the contractor to ailow the
construction to be subject to inspection at any and a{I times by City
inspection forces, and not to install ar�y paving, sanitary sewer, storm
drain, or water pipe unless a respansible City inspector is present and
gives his consent ta proceed, and to malce sUc� la6oratory tests of
materials being used as may be required by the City.
5. To secure approval by the Director of the D�partment having �urisdiction

of any and ali partia) and fina! payments Co the contractor. Said
appro�al sha{l be subject to and in accordance with requirements of this
agreement, and is nat to constitute approvat of the quantities of w�rich
payment is based.
C. To delay connections of buildings to service lines of sewer and water
mains constructed under this contract tantil said sewer and wa�er mains
and service lines have been completeci to the satisfaction of the Water
Department.
7. It is expressly und�rstood by and between the developer and th� City of
Fart Vtrorth, that in the event the dev�laper elects to award ane singl�
construction contract for storm drainage and pavement, said contract
shafl be separated in the bidding and City participation, if ar�y, shail be
limited to the lowest possi�le combination ofi b�ds as if each of the
above were awarded as separate ca�tracts.
.!. A�ytl�ing to the contrary herein notwithstanding, for and in consideration of
the pramises ar�d the covenants herein made by the City, the de�elaper
co�e�ants and agrees as follows;
1. The developer shall mak� separate elactions with regard to water andlor
sanitary sewer facifities, storm drainage, street impro�ements and street
lights as to whether the work prescribed herein shail b� performed
` by th� City, or by its contractor, ar by the devefaper, through its
contractor. Each separate election sha11 be macie i� writing and
deliv�red to City no later than six {B? months prior ta 'the ex}�iration of
this agreement. [n the e�ent any of such separate eEections has not
bee�n made and c�elivered to Ci�ty by such date, it shal! be conclusively
presumed tF�at the dEueEoper f�as elected that such work be performed
by t1�e City in accordance with all of the terms af this agreement, and in
particular Paragraph V-F hereof.
2. Irrespectiv� of any such election and whether the work is to be
performed k�y the City, or by its contractor ar by the develo�er thraugh
its cantractor, the cfe�eloper covenants and agrees to defiver to the City

a p�rformance and payment guarantee ir� accordance with the pro�isions
of Paragraph V-� of this agreement.
3. ln addition to the guarantee required in the preceding �aragraph, in the
event developer elects that the work be performed by the City, or by the
City's contractor, ar such election is pr�sumed as provided a�o�e, the
deve[oper covenants and agrees to pay to the City the developer's shara
of the estimated eonstruction costs. The amaunt of such estimated
payment shall be computed as set out on the Sumrnary of Cost her�ofi,
based upon the lowest respansive b�d far s�tch wark, as determined by
City, or u�an a cost estimated to be perforrned by City forces prepared
by the City, as appro�riate, and shall be subject ta adjustment to act�al
costs u�on fina! completion o� the subject work. Such estimated
payment s�al! be mad� promptly capon demanci by Gity, it being
understoad that such payment wi11 b� made after the receipt af bicis for
work, bu# in e�ery case �arior to the award of any canstruction contract,
unless otherwise specifically set out herein.
4. De�efoper furtt�er cover�ants a�d agrees to, and by these presents daes
hereby fully inciemr�ify, hald harmless and defend the City, its afficers,
agents and empfoy�es from and against any and a11 claims, suits or
causes o� action of any nature whatsoever, whetl�er real or
asserted, braught fior o� an account of any in�uries ar damages to
persons or property, ir�cluding death, resuiting from, or in any way
connectec� with, this agreement, or the cnnstr�ction af the
im�aro�ements ar faciiities described herein, whether or not caused, in
whole or in nart. bv the neaGqerrce of of�icers� ac�ents. or emplovees, of
the City. In addition, the c�evelaper covenants to ir�demnify, hold
harmless and def�nd the City, its officers, agents and em�loyees from
and against afl claims, suits, or causas or action of any nature
whatsoever brought for, or on account of any injuries or damages to
persons or praperty, including death, resulting frc�m any failure fio
properly safieguarci the work or an accaunt vf any act, in�entional ar
otherwise, neglect or miscanduct of the developer, its cantractors,
subcontractors, agents ar employees, whether or not

caused, in w�ole or �n oart. bv the nealiaence of afficers. aaents, or
emalovees v# the �itv.
5, Developer covenants and agrees th�t it discriminates against no
individual invol�ing employment as prohik�ited by the terms of Ordinance
No. 7278 (as amended by Ordinance No. 7400}, an ordinanc� prohibiting
diserimination in emplayment �ractice because of race, creed, color,
religion, natio�al origin �except for i1lEgal aliens), sex or age, unless sex or
age is a bonafic{e occupational qualification, subcontractor or
employment agency, either furnishing dr referring applicants ta such
c#.e�elaper, nor any agent of deveio�er is discriminating against any
indi�icival involving employment as prohibited by the terms of suc�
�rdir�ance No. 727$ (as amended by Ordinance No. 7400y.
K. Ver�u� nf any actian brought hereunder shall be in Fort Worth, Tarrant County,
Texas.
L, The City's Policy for the lnsta{lation of Community �acilitEes, as adopted by the
City Council �n September 1992, is hereby ineorporatetf herein by reference,
anci Developer covenants and agrees to comply w�th said Policy as a conditio�
o# this contrac# and as a conditian ta the platting of the su�ject prop�;rty.
M. The following descriptions of work appVy, as appropriate, to the areas includad
in the Community Facilities Agreement:
� . STR�ETS
Streets as shown in Exhibit B will be in accordance with plans and
specificafions prepareci by the Ow�er's engineer and approved by the
Direcfor of Engineering.
2. STORM DRAINAGE
Storm drain as shawr� in Exhibit B-- 1 wiil be in accordance with plans and
specifications prepared by the O�vner's engineer and approved by the
Director af Engineering.

3. STREET L1GHTING
a. Th� Developer sha11 provid� far the installation of streetlighis by the City
forces at tha approximate focations shown in Exhibit C, immediately
after final accep#ance of the street construction, in accordance with
engine�ring plans and specifications approved by the Transpa�iation and
Public Warks Departm�nt.
b. Str�etlighis o� residential and 1 or collector streets can be installed using
overhead or under�round conductars with the approval afi the streetlight
Engineer.
c. 5treetlights on ar�erial streets shall be installed with underground conduit
and conductors.
d. The Developer shall prouide for th� +nstallation of a 1'/d inch schedule 40
PVC canduit at fhe depth not less than 30 inches and at least 18 inch
�ehind the curb, "clear from atl ather utilities".
e. The Develop�r shall provide for the instaliation of a 1�/� inch schedule 40
PVC conduit 1�etween stre�tlig�ts proposed for installation and #i�e power
source to become operational.
f. A 3 inch sc�edule 80 PVC conduit is required w�en crassing streets at
depth rtot less than 30 ir�ches, unless indicated otherwise on the plans.
Car�crete pul� boxes shal{ t�e provided at the crossing points.
g. Luminaire bailast shafl be rated for multitap operation a�d each luminaire
shall have it's o�vn photocelL
° 4. TRAFFI� CONTROL DEVICES
a. The Develope� agrees to pay for tf�e street n�me sign installations required
�y this development to the extent af $80.00 Per inspection. TF�is unit cost
will be re�ised annually by the Departrnent of Transportation and Public
Works to reflect prevailing costs of mater�als and labor.
b. This develo�ment creates the following number �ntersections at a total cosf
as shown to tha Developer.
�. The D�veloper may either deposit cas� funds with �he City equal to the
following arnount at the time of Community Facilities Agreement approval
ar wait until the streei name signs are to be installed. If the Develaper
elecis to wait, the cost of street r�ame signs will be at the rate
prevailing when the Developer dep�sits ftands witn the City.

d. The City wi11 instalf the street name sigr�s upon final approval of the street
constructian. The street name signs will remain the properiy of, a�d will be
maintained by, the City.
5. 4THER WORKS
in the event that other works is raquired it will be included as specific
requirements to Community �acilities Agreement. .
N. De�eloper and City agree that this Agreement represents the camplete and
exclusive statement of the mutuaf understandings af the parties and tt�at this
Agreement supersedes and cancels afld previous written and orai agreements
and communications related to the subject matter ofi this Agreement.
