HomeMy WebLinkAboutContract 27158� �ETY aE���i►4�Y - , � ! , ��Ni�ACi i� . � -- STATE OF TEXAS COUNTIES OF TARR.ANT § ANll DENTON WHEREAS, the Ciky Cauncil af Fort Worth and the Fort Worth Tndependent School Distric� Board of Trustees have dete�ined tha� the security and we11-being of students at middle and elemeniary schools during after-school hours of 3:Oa to 6:OQ PM are of prime impartance; and WHEREAS, the City Council of Foi-t �ortk and the Fort Worth 7ndependent Sclzool District Bo�d of Tnzstees by consensus agree that the activities of elementary and vuddle school chilcl�en during these critical hours are of paramau.nt importance to both go�ernment entities; aiid WHEREAS, the Fort Workh Independent School District proposes to contix���e an After-Schoal Prograrn in conjunetion with the City of Fort Worth; NOW, THEREFORE, I�NOW ALL BY THESE PRESENTS: That %r a�d i�1 consideration of the mutual covenants, promises and agreements contained hereii�, th.e Ciiy of Fort Warth, hereinafter referred to as "City," acting by and through Libby Watson, its duly authorized Assistant City Manager, and the Fort Wort� Independent School District, hereinafter refez-red to as "District," acting by and through Dr. Thomas Tocco, its duly authorized Superintendent, do hereby covenant and agree as follows: 1. City ai�d Disirict togethe�- covena��t and agree to fully cooperate in the aperation of this proj�ct and both parties agree that: A. A Coordinating Board slzall continue to aversee the implementation and operation of ihe After-School Progra.in. Said Coardinating Board shall meet at least quarterly and cansist af the follovving persons: � Director, Our City Our Children � Executi�e Direetor, Crime Prevention Resource Center � Assista��t Director, Tarrant County 3uvenile Services � Assistani Cifiy Manager, City of Fort Wort� � Associate Superintendent, Fort �Vorth Independent Schaol District � Chief of Police, City of Fort Worth � Direct:or of Student Affairs, Fort Worth Independent School District o Director af Parks and Co�rununity Services, City of Fort Worth � Director of Athlefics, Fort Worth Independent School District -- -—..... � � :. �I � . -�,' � , ' �.f �,. I . ., � � The Coordinating Board shall have the following responsibilities', 1. Approve prograen-wide scope, goals ax�d objec�ives 2. Approve site selection process 3. Select sites based an selection criteria 4. Evaluate reported results fram campus programs 5. Evaluate funding needs 6. Recommend future direction and standards B. The Distric� shall be respansible for day-to-day administration of the After-,�chool Program and will at a rx�.inimum �rnploy a Director, four Program Coordinators and a grant writerlfund development professional. C. The Disfrict shall establish a site-based advisory commiitee at ea�h middle and elementary school which operates an after-schnol program. This cotrunittee may be a new body, a group continued from a previous year of aitier-school aperations or the site-based management team provided it inchldes the principal and representatives of the cammunity, faculty, and studeiit body. D. The District shall coniinue to worlf with an independent entity to conduct an in-depth longitudinal evaluation af the After-Scl�ool Pragram. This evaluation process shaIl continue for three (3) additional consecutiv� years, with an in-depth written evaluation provided following the conclusion of the fourth year. During intervening years the evaluatar shall provide ari overview and feedback on existing programs and recarrunendations %r improvement. E. The City Council a�Fart Worth and the �'ort Worth �ndepend�nt School District Board of Trustees shall meet annually to review the After-School Program. 2. The inission of the After-School Program shall be: "To enable needs-based after-school pro�rams in a safe environment that result in educational, physical, and social devejop�nent for elementary and middle-school aged children.". Goals of the After-School Program shall include, at a minimum: � To provide homework assistanee, tutorial, and relevant educational programs m To improve t11e awareness of the importance oi learning � To ceduc� the level of truancy -2- o9�io�zoai v�.o � • Tn addr�ss the students physical needs + To provide activities that promote so�ial development � To reduce juvenil� arrests + To reduce juvenile victims of crimes during the target hours Operational Imperatives are: To establish prograin goals and objectives that are measurable and result in desired outcames through a scieniific evaluation process Ta ensure tllat pz•ogra�n participants achieve unprovement in core program outcomes through an accountable system of ineasureznent To ensure that existing progra�ms axe a�ot duplicated, or if appropriate, are expanded or cornplimented �hrough an inventory and evaluation of existing programs. 3. It is undersiood that during SY 2001— 20D2 the City of Fort Worth shall provide $1,100,000 dallars for the support of ihe Af�er-SchooI Program to the Di�trict. It is also understood that the Dist�-ict shall also provide at a minimum $1,100,040 for ihis proj ect. Th� Cily and District may, acting through the Coordinating Board, establi�h a sliding fee- scale for participation in the program so long as no child at a partieipating school gets turned away and volunteer time by a parent, guardian, or designee can be counted towax'd the fea. It is agreed that any fees collected shall be expended towards the After-�chool Prograin priz�narily� at the site where ihe fees a.re collected. The City of Forf Worth will make four equal payments of $275,�04 each on Qctober 15, 2401; Januaxy 15, 2002; April 15, 20D2; and July 15, 2002, following receip� of an invoice from the District. 4. The term of this agreeiraent is for a period begiruling an June 1, 2001, and ending on Septeinber 30, 2002, and shall cover the etltire SY 2001-2002. This contract may be renewed by both parties on an annual basis thraugh the apprnval of an addendurn setting a new term of the agreement and any other changes agreeable to both parti es. 5. It is expressly understood and agreed by and between the parties hereto thai this agreemezat is wholly conditioned upon the actual receipt by City of funds frorn the Fort Worth Crime Control and Prevention District and that if such funds frozarx the Fort Worth Critne Control and Prevention District are not timely forthcoming, in w�iole ar in part, City may, at its sole discretion, tezm�naie this cantract and agreemeni. -3- o�i�azoai �i.o � 6. This agreenzent may be terminat�d by either party hereto, in whole or in gart, at any time az�d far any reason, upon written notice ta the a�her party. Such writien notice sha11 specify to what extent tlie worlc under ihe contract is being te�ninated and the effeetive date of termination. 7. District shalI operate hereunder as an independent District and not as an officer, agent, servant or employee oFCity. District shall be solely responsible for the acts and omissians of its officers, members, agents, s�rvants, and employees. Nerthe�' City nar District shall be responsible under the Dactri�e ofRespondeat Superior for the acts and oinissions of its officers, members, agents, servants, err�ployees, or officers of the other. : City and Dis�ict each covenant to the other that neither such party nor any af its officers, members, agents, employe�s, program participants, or subcontractors, while engaged in perFarming this contract shall in eonnection with the employment, adwancement, or discharge of employees, or in connection with the terms, conditians ar privilcges of their employrnent, discriminate a�ainst persons because of their age, except an the basis of a bona fide occupational qualifieation, retirernent plan, or statutory requirement. 9. City and District, iz� the e�ecution, perfc�rmance or a�tempted performance of this contract and agreement, will not discriminate against any person or persons because of sex, race, relzgian, color or natianal origin, nor wi11 District permit its agents, ernployees, subconiractors or pragram participants to engage in sucl� discrimination. 10. City and District covenant and agree that in the event ei�her party fails to comply with, or breaches, any of the terms and provisions of this agreernent, each pai-ty shal] pzovide written notice to the other as soon as reasonably possihle after the non-breaching pa�-ty beco��nes aware of the faihue to coinply or breach of contract. Tn the even.t that the breaching party fails ta cure or correct such breaches within a reasonable tiine follo�ving the receipt of notice, such reasonable time not to exceed 30 days, the non-breaching party slaall have the right io declare this agreem�nt immediately terminated, and neither party shall l�ave furth�r responsibility or liability hereunder. 11. � 0411�/2001 vi,Q The provisions of this agxeement are severable and if for any re�son a clause, sentence, paragraph or other part of thzs agreemant shall be determined t� be invalid by a court flr federal or sta�e ag�ncy, board or comn:�ission baving jurisdiction o�er the s�xbject matter tbereof, such in�alidity shall not affeci other provisions vvhich can be given effect without the in�valid provision. 12, Tl�e failure of City or District ta insist upan the perfonx�ance of any term or provision af this agreernent or to exercise any rigl�t herein conferred shall not be constt-ued as a waiver or reli�quishment to any extent of City's or District's right to assert or rely upail any such term or right on any future occasian. 13. Should any action, whether real or assezted, at law or in equiiy, arise out of the exeeution, performance, attempted performance or non-performance of this contract and agreement, venue for said action shall lie in Tarrant County, Texas. 14. During tF�e I�tter pa�t a# the year, the need for a muf�i-disciplinary task force ta explore after-schoal programs became a clear imperative and a committee was formed consisting of represer�tatives from the Parl�s �nd Community Serv�ces Department, the Police Department, the FWiSD, Tarranf County Ju�enile 5ervic�s, Our City Our Children, and the Crime Prevention Resource Center. Based upon the recommendations of the �lanning task force, or� August 8, 2000 (M&C C-18183), t�e City Council approved an agreement to initiafie a program called Fort Worth After Schoo{ at selected elem�ntary and middle schools in the FWtSD. Ha1f of fhe fundirrg for the project was pro�ided by the Fart Worth Crime Control and Preveniion District in the amour�t of $1.1 mi{lio�r. The remaining funds are provided by the FWiSD. After some implemenfation delays, the program was fully operaiional by the middie of the school year. A section of Texas A&M U�iversity was selected to conduct an evaluatian of the pragram. The evaluation team is headed by Dr. Peter Witt, and t�eir initial reports gave the program overall high marks and many helpful suggestions for the second year, most of which have been implemented. For the second year of the crime prevention project, funding remains at $1.1 million and is included in the FY2Q01-2002 Fort Worth Crime Control and Prevention District budget. FINISD will again pro�ide matching funds in the amount of $1.1 million. The �WISD is also praviding administrative persannel for the project.
