SERVZCE AREA; PROCEDUR�S Eort Worth wi�l provide fire pro�ection serv�ce a� �he service level specifiecE hereinaft�r to Benbrook in the service area, the exact location of wh.i.ch is designated in a location map marked Attachment "A," hereto incorpo- rated and specifica�.�y made a part of this aqreement. Fire protection se�- vices wi11 be provided in accordance with s�andard opera�ing procedures o� the �'ort iniorth Fire Departmen�, in conformance with Fort Worth's rules, xegu- lat�.ons and oxdinances relating to provision of such services. I� is recagnized arid understoad that Fort Worth cannot and does not assume responsibzlity for the provision o� fire services beyond thase of th2 service �evel chosen by Benbrook, nor outside the service area. 2. DUk2ATIOI+I; RENEWAL This agxeement shall be in effect for a period of £ive (5y years, com- mencing Octoher l, 2001, and expiring September 30, 2006, unless terminated earlier for cause as specified below. Cost adjustments shall be made on an annual basis, pu�suant to the farmula set out in Sec�ion 3, "Cost Calcu�ation Formula," az�d the respective attaehments thereto. At expiration, the -�erms an.d conditians of this agreemen� may be extended for addi�ional fi.ve-y�ar pe- riods� u�aon mutual consen� o� Fort Worth and Benbrook an writing. 3. COST CALCUE,ATi4N FDRMULA As cansideration fox the grovisinn of fixe s�rvices, Benbraok �rill pay Fort Worth the amount set out in Attachment "B" which sha11 be cal.culated on �he basis af the following factors, subject to annual revision and adjust- ment: A. Fort Worth's pe� capita cost nt fire protection; B. Benbrook's population served by this agreement; C. The hazard potential �ac�or �or t�?e area covered under thzs agreement; b. The level of service pravided. �ach of these factors is analytically set aut in greate� dEtail in Attachment "C" incorporated and specifically made a�art of this agreemen�. Th� actu,a.l calculation figures �ar the ce�rren� �rear of the cantract, including service level chosen and hazard patential faetor ra�ing, shall appear in Attachment I '•� q . COAIBInERA'riON Fort Wor�h and Beni�raok, as tax�aayer-suppor�ed entities, xecognize th� a.mportance of timeliness of prov.iding cos�t figures for purposes of budgetary convenier�ce. Therefore, Fort Worth covenan�s that it w�J�]. cause to be sent to Benbraok no later than August lst of each year a calculation of the cost of fire service for th� fallowing year similar in �armat to l�ttachment "B" hereo�. Should Benbrook fail ta receive said cost calcula�ion by August J�st o� that year, i� shall noti£y Eort Worth of that fact by registered or certified mai1, requesting �ort Warth to zmmediately provide same, �'nrt War�h covenants that i�. will u�e its best efforts to provide app�opri.at� cost information to Senbrook in a timely �nanner. �enbxaok agrees �o tendex to Fort fn7orth twelve (12) equal monthly pay- ments, each payment representing 1/].2 a� the total amount due under �he terms of this cantract. The first payment will be due on o� ]�efare Octab�r 15, 2001, and month�y payments therea�ter sha11 be mad� no later than the fifi- teenth (15th) day o� each month. Payment sha11 be by certz�ied check or by any other methac€ agreed to by Benbrook and Fort Wo.�th. �. T�i�MINA�ION FOR CAUSE Bath cities recognize the importance of tire service and ag.�ee ta act in utmos� goad faith in their re�ations with one another under this agree- ment. Unilateral termination of this agreement shal.l be limited to the fol- lowing circumstances and onl.y a€ter the defaulting party has been gizren rea- sonable opiaortunity to cure : A. Fort V+lorth may te�minate this contract for nonpaymen� upon one hun- dred eight�' (180} days` written notice. B. Benbrook may terminate this cont�act �or failure of Fort Worth �o provide service upon one hundred eighty {180) days' wri��en notice. 6. LIABILITY (a) In acco�danc� with section 791.006 of the Tez�as Interloeal Coopera- tion Act, (T�x. Gon'T CooE Arirr. § 791. OQ1 et 5eq. [Vernon 1994] ), an�r civi�. lz- abiiity arising from �urnishing fire pro�ection servaces under -this contract shall be �he responsibility of Benbrook. (b) Subject to ti�e faregoing, Fort Worth and Benbxook agr�e to tF�e followinq: 1. Title to a�l equipmen� used by t�ae k'ort Worth Fire Department �o carry out the terzns a� this contract will remain .i.n the City of Fort Wor�h. 2. T,itle to all equipment used by the Benbrook Fire Depa�tment to carry oait the terms of this contract will remain in th� City of Benbrook. 3. Each city sha.11 bear its own adrninistrative expenses incurred pursu- ant to and arising out the performance of this contract. 4. Pursuant to the terms of the statute referenced above, Benf�rook agrees to be responsible for all liability fox any damage to Fort Worth equipment, and for all lia�ili�y for persannel and employee benefits for Fo�t Worth personnel providing services under this agreement, in- cludinq �rorkers' compensatian, �ension and r�tirement benefits. 7. NON-WAIVER OF IMM[JNTTTES AND DEFENS�S T� is expxes5ly understood and aqxeed that, in the execution of th�s agxeement and contractp neither city waives, nar shall be deem�d hereby to waive, �ny imznunity or defense �hat would athe�-wise he available to it against third-party c].aims arising ir� the exercise of governrnentaJ. powexs and functions. B. �ON-ASSIGNABILITY This agre�ment zs not assignable b� either party and any attempt to as- sign it is vo�d. 9. �MENDMENT This agreement may b� amended at any time by zttutual consent of the par- ties. SEVERABTLITY The provisions of this contract are severable. III. HA2�ARD PQTENTTAL �"ACTOR The Hazard Po�entzal. Eactar determines whether the a�ea �o be covered has a c�reater or 1ik� fire protaction fac�or as Fort Worth. The Eactor is based on an assess�n�nt of: A. Varying types of properties in the area to be protected, mhis in- cJ.ud�s a survey of smail homes and businesses which have a mini- mal po�ential to escalate beyond a first alarm assignment; larger homes, light indtistrial. area, and other propert�es that have a potential for escalation to a higher alarm level; i.n�ustria.� ax- eas, hazardous operations, highrise buildzngs, laxge public as- sembly areas, and a.nstitutianal properties where life hazard is a�ove averag� and other properties where the paten�ial to esca- late to a maximum response is high. H. Transporzatian Routes. T�anspartation routes are factored due to �he special problems railroads, highways, and major traffia routes can add �o fire protection e�foxts. C. Open Land. Soth deveioped and undeveloped open land is included since tires in these typas of areas �equi�e special kinds of equipment and, at times, large numbers of manpower. In evaluating this category, consideration is given to area� accessibility, �nd ground cover. D. Other Fire Protect�an Facto�s. This includes water supply, fire and build�ng cad�s and their enforcement, sprinklers, standpipes, an� smoke and heat detectors. E. Special Facto�s. Any special factors unique to potential protec- tion a�ea and inconsistent with the �ire department's experience. Al1 ratings o� �he potential protection a�ea are don� based on the re� lationship of each factor t4 th� "norm" of Fort Worth. A rating of 1 means that a�actor is appxoximately the same as is common �o like fa�tors in the City af For� Worth; a greater hazard factor would receive a higher rating. LEVEL OF SERVTCE TD BE PROVIDED The final factox in the formula allows a ciient city �o ahoose one of four J�ev�ls of service to be provided by the Fire Depa�tment. Level 1 Full fixe p.�atection service� including �ull fiire suppression; eme�g�ncy medical first responder services; inspection of aI� schaal.�, water hydrants, commercial esta#alishments, and chuxches; arson inves�iga�iori; bamb squad; £ire safety education; hazardous materials xesponse; emergency management; all other fire services recaived by Fort Worth residents. The cast o� Level 1 service is based on the full per capi�a cost af Fort Worth fire protecti.on. Level 2 Full fire suppression s�rviee, emergency medical services first respor�dex service, inspection of water hydran�s, and hazardous mat�rials incident response. I� the Fort Worth Fare Department Incident Commancler determines that any specialized serviees, in- cluding but not limited to hazardous materials response, techni- cal rescue, and/or emergency medical services are required for a part.i.cu�.ar inciden� responded to in �he contracting city by the Fort Wa�th E'ire �epartment the contrac�ing ci�y will not be charged for such addi�ional servicas.
