WHEREAS, the City of Fort Worth, a municipal corporation srtuated in Tarrant
Ca�nty, Texas hereinafter called "Cit�' and Ca�p Dresssz' & McKee Inc., h�re after
called "Engineer" mac�e and ent�red into City Secretazy Con#ract No. 22767, (the
Contract) which was authvrized by the City Council by M&G C-16D32 on the 6�` day of
May, I997; amended by City Secretazy Cantract No. 23865 (Amendment No. 1} which
was authorized by the City Cauncil by M&C C-1667� on the 17�' day vf March, 1998;
and amended by City Secretary Contract No. 26801 (Amendment No. 2) which was
authorized by tk�.e City Councii M&C C-i8419 on the 9th da,y of January, 2001,
W'�-TEREAS, the Contract invo�ves engineering services for the foliowing projec�:
Eagle Mountain Water Treatment Plant
30 MGD to 60 MGD Expansion
WI�EREAS, it has become necessary to execute Amendment No. 3 to said
Can�ract to include ar� increased scope of work and re�ised rrfaximum fee;
NOW THER.EFORE, City and Engineer, actang herein by and throug� their duly
authorized representatives, entar into th.e following agreement, which amends the
Contract:

Article I, af the Contract is ame�ded to include the additional engineering
services listed below and specified in proposed letters dated May 29 anc� May 30, 2�01,
copies of which ar� attached hereto and incorporated herein.
Process Canirol Svstem (PCSI Functional Dernonstration Test fFDT). The
engineer wi11 conduct additional onsite fiinational demonstration testing for the
plant process control system. The initial FDT fail�ed. This testing will be
conducted to demonstrate fhat the system has been correc�ed ta meet the
requ�rements a:f the punch list provided following the original testing.
Extended Construcizon Schedule. The Engineer will provide general construction
serviccs thraugh 7�tne 2001. The construction schedule is projected ta continue
through ,Tune 2041. Tlus will require additiona.t general canstruction services
from the previously amend�d completion date of January 2401.

not exeeed the sum of $3,153,209.00.

Dear Mr. Tawnsend:
Camp Dress�r & McKee In�, (CDM} was cantaracted by the City of �ort Worth in May 1997
to design �h.e �0 mgd expansian �o the Eag1e Mountain WTP and to provide sex�zces duxis�g
constructifln thxough the specaii.ed constxuction coxnpletian date af August 2000. Our
engineeri�g servx.c�s agr�ement has twice been amended to cave� the cost fox aut of scope
items that CDM has perfor�ed du�ing th.e couxse of the praject. Th� l.at-�st amendment
it�cluded addiiional fees f�x consi�uction services related �a azt exte�ded cons#ruction
schedule of siac nn.o:nths thxough Januar�r 20Q1. CDM has perform�d ar will be performing
additional �gineering services irhat we consider to be �ut of scape to aux amended
engineerizlg can�ract. A discussion of these adclitional services is presented below. VVe
have also provided the additional cost to CDM ioz each 4� these items.
Prncess Controi 5ys#em (PCS) Functionaf D�monstra�zon Test (FDT). A F'DT was
reguired for the process ins#rumentation a�d contral system. The purpose of the FDT is to
dem�nstrate and c�nfirm proper operation of all components of the system. It serves as a
prerequisite forr the 35-day Site Acceptance Test. Prior to calling for ihe FDT, the
Operational Readiness (ORT) Tes� are t� be co�plefed by the Contractox ta show that the
ez�tire systenn is xeady for testing.
Phase I of the PDT was conducted between October 31, 2000 and November 2Q, 2a0D. CDM
was present for about �3 days duzixig this testing. The contractor �nras not ready for Phase I
of the test when called, but CDM warked with the Cantractor ta resolve ur�coaanpleted
issues in the field so testing could pxoceed. CDM prepared a p�ch list fallawing initial
testing and then r�t�irned to retest following coznpl.etion af the punch
lisfi items. Phase II of the FDT was conducted bet-w�een Apri13, 2001 and Ap�I 1.3, 2001.
CDM was present for the eniire testing periad. Although szgnificaz�t pragress had been
made siz�.ce the Phase I FDT, it was apparent that the sysiem was not ready for the FDT.

The con�ractor dzd not have all equipment and subsysterns xeady for the Process Coritrol
5ystexr► Integrator to iest with the cantrol system and did not pzavide adequate planning,
caoxdi.zzation, and support for the testing. The FDT failed. CDM prepared a punch list of
items that wexe to be corre�ted. Follo�ving these caarxection�, the syste�t was then retested.
This retest toak approxirnately one week to properly demanstrate the sysfiexn. CDM
provided the sexvi.ces of a CDM senior en�ironmental engineer and an en�ineering
technieian during the retest. The retest passed with some p�unch lisf ite�ns remaining to be
complefed, CDM is also proviciing the retest punch list items.
CDM did not originally budg�t the arnount a# #xme that was actually necessary for
conduciing the FDTs. These tes�.s should have taken a total af about fou.r weeks, i�wo weeks
pex phase of the FDT. CDM reques�s additional carnpensation for the serviees provided
during #he system retest and demonstration and assaciated fallaw up woxk, TEii�s
additional. c4�npeansation is �o cvver the cost of two weeks of labar for a seniar
enviranmental eng�xteez, one week of labor �or the engixieer�ng technician, and assoatated
travel expextses for one week for the retes�.
The additional cost for CDM to perform fihese services is $15,000.
Extended Construcfion Schedu�Xe. Based upon the anost cxzrrent evaluation of the
contractor`s schedule, it appears that construction will cantinue through at least june 2001,
eleven naonths beyond the original construction schedule and an addii��na1 five months
beyand_the schedule revision included in Aynendnlent Na. 2�o au� Caz�ixact. To continue
ta pr�vzde general consi:rruction ser�nices throughout construction, CDM estin�ates
ap�roximateiy $2,0�0 pex rnoz��h based upon wozk pear£ormed duxin.g the pxevious xecent
znozi.ths. These costs are based solely on the extended construction schedule and not foz�
services that are independent of the schedule.
T`he additional cost for CDM ta perform �hese services is $1Q,000.
CDM request� con�ideration of the al�ave iterns and amendmeni of oux confisact to cnver the
costs associated with periorming these tasks_ It is our apinion that the requested casts are
the result of bflth the contractor's failure to properlp coordinate and be ready for the FDT
and the extended canstruction schedule. A su�n�nary of fhe taslcs and associaied costs are

Task 1 � Sfudy
Tl�.e purpase of this task is to detex�nixie the optimal rneans for expanding the Narthside III
(NSIII) high �ervice pump station. The follow�ng s�btasks will be conducted.
Task 1,1 Praject Meeti�tgs
CDM will conduct a kickoff ineeting to develap the paran�eters for the pump station s�g
and desigx�. Project zneetin.gs will alsa be conducted �ollvwing co�apletion of distribution
system modeling and completion of the draft evaluation report.
Task 1.2 Disfribution Modeling
To properly size and select new high sezvice pumps, a ran.ge af sys#em head cur�res rnust be
developed based upon existing and fixture operatirig and water demand scenarias. CDM
will develop the model based upan. our current model of NSIII with changes that the City
plans to implemer►t such as new developments.
T'he distribution model wi11 b� run at variaus demand candi'tions so that the pumps
selected can �an.eet fihe ra�nge of conditions thaf can be expected.
Task 1.3 Existing WetwelI Evaduation
The existing pu.�np station wetwell wall be evaluated to deter�ni�ne if any modifications w�ill
be required upon addition af new punnps. This �valuation �nrill Iook at the potential xteed
for adcling divi.tier walls ox othex devices fo ensure pxoper flow conditions to the existing
and new pumps.
Task Z.4 I�urnp Siafiorz Expansion A2ternatiue EvaIuation
CDM will deve�op alterzZate nleans for expanding the purnp statxon, evaluate each, ar�d
recoanmend t-Ite best alternative for incorporaiion. Each alternative will rneet the
reqt�iremen�s of nna�ci i�ing �low wa.�hout requirix�g major electrical revisions. Al�ernarives
may in�lude additian of two new ptimps (approximately 10-mgd each) to aperate �vi�h the
�iree existing 3-nngd pun�ps and fhe addition of two new S-mgd pumps and replacing nne
existixtg 3-mgd pump wi�t anather new S-mgd pump.
Task 1.5 Report
A report will he submitted in draft and final fornR presenting both the pump station
expansion alternatives and the pxe�ixx►inary design of the recomrnended option. Estimated
casts �vill also be provided.

engineering agreemen# with Camp, Dresser & McKee, � Inc.
No. 22767) for ihe design of t�e Eag1e Mountain Water
Expansion, increasin� the contract amaunt by $�95,000, from
On May 6, 1997 (M&C G16032}, the City Counci[ author€zed #he execution of an
engineering agreement with Camp, I]resser & McKee, Inc. for t�e design of the Eag�e
Mountain Water Treatment Plant 30 MGD Expansion. The Eagle Mountain Water
Treatment Plant (EMWTP} 30 MGD Expans�on was requir�d to meet the new projected
water sup�ly demands in the Alliance growth area.
Amendment No. 1 was fo� design of the 1�-inch water transmission main (North Side IIE
Pressure Rlane} from the existing water system southeast af the EMWTP to the piant
site.
Amendment No. 2 was for development ot the Plant Process Computer Controi System
Integrator Evalua#ion Process, attendance at the factory acceptance test of p�ant
process computer confirol system, coordination with TX Utilities for more reliable power
suppfy to EMWTP and Eagle Mo��tain Raw Water Pump Station, and design
modificatians to Norti� 5ide ill fi�igh serv�ce pumps far proposed de�elopment in north
Fort Worth.
The proposed amendment is for the engineer to conduct additio�al Process Computer
Control System f�nctionai demonstration tests (FDT). T�e cantract requires that the
engin�er attend one F17T, to con#irm p�oper operation of afl compu#er and
inst�-urnentation compon�nts. Th� iniiial test failed and the engineer had #o not only
attend additional tests, but had to r�erify t�af uncompletedlnan-operational issues had
been resolved. T�e addifional eost associated with this item is $15,00�. Also, the
