•Article I, of th� Contract is amended to include the addition-
al engineering serv�.ces specified in M&C C-18797, adapted by the
City Council on the 16th day af Octo}�er 2001 and further amplified
in a proposal. letter dated Septembe� 21, 20�1, copies of which are
both attached hereto and incorparated herein. The cost to City far
the additional serv'ices to be p�rformed by �ngineer total
$62,364.00.

Article xX of the Contract is amended to pro�cride for an
increase in the �irnum fee to b� paid to Engzneer for all work and
services p�rfax�►ed under the Contract, as amended, sa that the
total fee paid by the City for all work and sexvices shall not
excee�l the sum of �5392,617.�4.

RECOMMENDATION:
lt is �'ecommended that the City Council. au#horize the City Mana�er ta execute Amendmer�t No. 3 to
City Secretary Contract No. 24245 with RJN Group, Inc. in the amount of $62,3fi4 to provide for
additional d�s9gn and su�-vey services, the�eby increasing the contract amo�nt to $392,617.

On 5eptember 8, '1999 (M&C C-'16981), the City Cou;ncil authorized the City Manage� #o execute a
co�tract w�tF� RJN Graup, Inc. in the amount of $3D1,343 for �the Clear Fork Parallel Refief Sani#ary
Sewer. The cont�ack was subsequently revised by two previous amendments to#afing $28,91 D.
Th� contract pro�ided far a 48-inch parallel relief sewer line to be designed wiihin ihe same 30-foot
wide utiiity easement as an existing 48-inc�'sewer main. However, during design, it w�s determin�d
that there is insuffic�en# space witF�in the existing easement to ir�stall the proposed sewer main due to a
42-inch water main and a large diameter storm drain pipe that is also located within the easement. This
amendment will allow the consultar�t to develop alternate aEignments for the proposed rrefief sewer, and
to provide additio�ai c#esign and survey services ir�ciuding a� easement descriptEon for th� selected
alignment.
In addition, the amendment will allow RJN Grou�, I�c. to Qrepare the necessary documentation needed
to obtain an antiquities permit from khe Texas Stat� Histaric Preservation Office {SHP�). SHPO has
requested that the Ciiy conduct a si#e investigation of an area neaf a segment of the proposed sewer
line which runs parailel to the o1d channei of th� Clear �ork af the Trinity River�, in order ta determEne
wh�ther intact archeological de�osits are contained within the area. �
City staff considers #he proposed fee to be fair and reasortable for the additional services to be
provided. �
RJN Group, Inc. is in compliar�ce with the City's MIWVBE Ordinance by committ�ng to an additional 53%
MIW�E partici�atiart on this Amendment No. 3. .

This [et�er constitutes a request for Contract Amer�dment No. 3 tn the Clear Fork Parallel
Relief Sewer Project & Sanitary Sewer Main M� 34R Reha�ilitation Project, Part 1. As the
design and constr�ction of the wastewater collection system improvements for the project
have proceeded, i# has been necessary ta revEs� the scope of #he engineering services
pro�ided to the City of Fort Worth by R,JN Gro�ap, Inc: {1�,lN}. This letter summarizes the
scope a�d related costs for the additional seniices to the contract, as fo[Eows;
1. Contract Amendment No. 3 adjusts the contract amount for the pre�ar�tior� of State
Re�olving Fund (SRF') dacumentat�an anc� coardinatian wifh governmental agencies
�s req�ire� for the �reparatian of an Environmental Assessment 5taiement (EAS),
as authorized E�y the City of Fort Worth. RJN and our Subconsultant on the praject,
Wendy Lopez & Associates, Inc. (WLA), began meeting wiih the City of Fart Workh
regarding the City's �esire to prepar.e an EAS for t�e �roject in May of 2001. RJN
submit#ed a proposal to tF�e City of Fort Worth to prepare the E�vironmenta!
Assessment 5tatement for.the Clear Fork Parallel Relief 5ewer Project, Pa�ts 1& 2
on June 8, 2001. The proposa� irtcluded a very aggressive schedule to complete ihe
praject. Th� C�ty of Fort Worih author�zed RJN to begin work on tne proj�ct on June
21, 2001, as outlin�d in the scope of services submit#ed with the prop�sal.
On July 18, 2001, Mr. Mike Domenech informed RJN that t�e City of Fort Worti� was
pursuing other funding sources for const�ruction ofi the project, which would negate
the requirement for the City to do an EAS on t�e project. Therefore, on that date,
RJN was asked to discontinue work on the EAS, with th� exception of obtainir�g
approval from the Texas Histarical Commission, Archeological Division, which is still
�equire� by other state regulations. At that #im� we were also requested to submit
an amendment request and billing for al! labor and rnaterial costs accru�d to ciate on
the project, as we[l as those expenses necessary to close the project auf wi#h
agencies i�itially contacted as �art of th� EAS process.

2, i#em No. 2 inciudes comp�nsation for the� alternativ� analysis, feasibility and public
relations portions of the project. The origir�al intent of the projecfi was io plac� th�
proposed 48" diameter Clear Fo�k relief sewer lin� parallel to and in the same 30'
wide eas�ment as the existing 48" M-272-D Sewer Li�e. This necessitated
su�veying the existing alignmen# a�td al1 ot�er utilities withi� the existing easemer�t,
and prepari�g a proposed sewer alignment within the easement.
When it became a�parent ihat the proposed line couid not be designed within the
existing easement ciue to conflicts with an existing 42" Water Line and large
diameter storm sew�r line located witF�in the same easement, R.lN was asked to
laok at alternate al�gnments for the project. R�N ultimafely proposed four (4)
differer�t alignme�ts for th� project, which required addit�onal costlbenefit analysis,
exhE�it preparatEon, coordination meetings, surveying expenses for the alt�rnati�e
alignments, and engineering design services. Due to th� addi#ional survey and
design scope, RJN also had to increase the contract amounts for Subconsultants
�sed by RJN on the pra�ect, including Gorrondona & Assoc. and Garcia & Assoc., as
itemized belaw. A capy of documents listing each Subconsultant's amended
contract amount is attached, as backup.
item No. 2 also includes compensation for additional fees associated wiih
�reparation of documents for the Public Relations portion of the project. It inc�u�es
attendance at meetings, pre�aration afi exhibiis, doar-to-�oor delivery of
annauncements, and other additional costs associated with the preparatian for the
Public Meeting, and natifieations posted on the Gity of Fort Workh Website, regarding
the design and construc�ion of the praj�ct.

Wendy Lopez & ASsociates, Cnc. {WLAj is pl�ased to submit this Cetter agreement to perform
cultural resources services in conjunctian with the construction of the Clear Fark Relief S�wer in
Fort Worth, Texas. To f�rther facilitate an understartding of the se�vices proposed by WLA, a
s.ummary af tt�e task and assumptians to complete the task is described below. W LA's Cost
Propasal is provided as Attachment A.
SCOPE O� SERVIC�S:
Cul#ural �tesource ln�estigations
The Texas Stat� Hisforic Preservation Office (SHPO) has recammended geoarchaeolagiaal
trenching to the same depth as tt�at proposed for the sewer pipe along the portion af
Aiignment B�etween the railraaci tracks and the ri�er, wes# of the bridge. This area
paralCels t�te oric�inal c�annel of the Clear Fork ofi the Trinity River, and may contain iniact
deposits that could contain cultura! material. A minimum of two trenches will be excavated,
witF� additional trenches excavated depending upon tne findings from the initiaf trenches.
Upon campletion of fi�ldwork, W LA will compile a dra#t letter report to RJN and to the SHPa
incorporating the geoarcha�ological assessment, analysis of any arkifacts recovered during
the trenching, and arahaeological and historical �nformation gathered during the background
search. Upon receipi of camments firam SHPO, WLA wiH update the report to final form and
submit twenty copies to t�e SHPO per th�ir req�irem�nts.

i�vestigatian is warranted, the adc{itional wark req+�ired will be cnnsidered autsicie this scape
and cost estimate.
if historieal sites are found, the SHPO will r�quire archival research, which is an additional
cost not included in this cost estimate. Furthermore, if significant historical. structures are
located during this survey, the SHPO will reguire a historical architect to assess the
Qroperties. The costs associated with this assessment are not included in this cost estimate.

Additional Services
Deviations from this scope of work rnay anly be made by vvritten agreement signed by both
parties. RJN may request WLA to pertorm adc�itional services, d�fined as any task that is
outside of the Scope of Services pravided in the abo�e sect9ons. A�#ditional services will be
performed on a time and materials basis, unless a lump sum fee is agreed upan by WLA
and R,�N.
�ROJ�Ci SCH�DUI�E
W LA is ava�lable to comm�nce work ar� this project immediately upon receipt of written notice-
to-proceed. We anticipate a field time of an� day, v++rith appraximatefy 4 hours of travel time and
eight hours of fieldwork for a crew of two persons. Approx9mately 5 days will be req�9r�d for
compl�tion af the letter repart. This work schedule does not accaunt for SHPO review.

Per#orma�ce of these tasks wiihin the proposed sehedufe is dependent upon timely receipt af
data anc� materials from RJN and timely agency review. Additional culturaf resources services
requir�d after �ompletion of the backi�oe trenching are outside the scope of this contract.
BA51S O�' �ILLING _
Billing will be based on time ar�d materials, witF� a fee not to exceed $8,280.0�. lnvoices will be
submitted to RJN monthly, based on percent complete, and upon �rojecfi completion. Payment
shall be made by RJN within thirty days af receipi of WLA i�voices with 1.5% increase charged
per rnonth fior late payment. The fee is based on the Scope of Ser�ices outlined in th9s
proposal. �
