AN ORDINANCE VACATING AND EXTINGUISHING A REMNANT OF
A VARIABLE WIDTH ALLEY, LOCATED WITHIN THE WILLIAM
BUSSELL SURVEY, ABSTRACT NO. 151, AND BEING A PORTION OF
BLOCK 10, K.M. VAN ZANDT'S 2ND ADDITION, FORT WORTH,
TARRANT COUNTY, TEXAS ACCORDING TO THE PLAT RECORDS
RECORDED IN INSTRUMENT NO. D219019593 AND VOLUME 106,
PAGE 118, RESPECTIVELY, OF THE DEED RECORDS OF TARRANT
COUNTY, TEXAS, CONTAINING APPROXIMATELY 5,525 SQUARE
FEET OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF
FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a remnant of a variable width alley, located within the William Bussell Survey,
Abstract No. 151, and being a portion of Block 10, Van Zandt's 2nd Addition, an addition to the
City of Fort Worth, Tarrant County, Texas, as shown in the plats thereof recorded in instrument
no. D219019593 and Volume 106, Page 117, respectively, of the Deed Records of Tarrant
County, Texas, containing approximately 5,525 square feet of land more or less, and as more
specifically described in Exhibits A and B attached hereto and incorporated herein by reference
be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.

SECTION 3.
All existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
BEING a 5,525 square foot (0.1268 acre) tract of land situated in the William Bussell Survey, Abstract No.
151, and being a portion of Block 10, K.M. Van Zandt's 2nd Addition, recorded in Instrument No.
D219019593, Official Public Records, Tarrant County, Texas, and being a portion of Block 10, K.M. Van
Zandt's 2nd Addition, recorded in Volume 106, Page 118, Deed Records, Tarrant County, Texas, and
being more particularly described as follows:
BEGINNING at a 5/8-inch iron rod with "KHA" cap set at the northeast corner of Lot 8R, said Block 10
(Inst. No. D219019593), and being in the south right-of-way line of West 6th Street (an 80-foot
right-of-way);
THENCE South 89047'09" East, along the said south right-of-way line, a distance of 25.00 feet to a
3/8-inch iron rod found at the northwest corner of Lot 7R, said Block 10 (Inst. No. D219019593);
THENCE South 00012'51" West, departing the said south right-of-way line, and along the west line of said
Lot 7R, a distance of 141.00 feet to a point for corner, being the northeast corner of Lot 13, said Block 10
(Vol. 106, Pg. 118);
THENCE North 89047'09"West, along the north line of Lots 13, 12, and 11, said Block 10 (Vol. 106, Pg.
118), a distance of 150.00 feet to a point for corner, being the northwest corner of said Lot 11, and being in
the east right-of-way line of Currie Street (a 60-foot right-of-way);
THENCE North 00012'51" East, along the said east right-of-way line, a distance of 16.00 feet to a point for
corner, being the southwest corner of Lot 10, said Block 10 (Vol. 106, Pg. 118);
THENCE South 89047'09" East, along the south line of Lots 10 and 9, said Block 10 (Vol. 106, Pg. 118),
and along the south line of aforementioned Lot 8R, Block 10, a distance of 125.00 feet to a 5/8-inch iron
rod with "KHA" cap set at the southeast corner of said Lot 8R;
THENCE North 00'12'51" East, along the east line of said Lot 8R, a distance of 125.00 feet to the POINT

RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a remnant portion of an alley in block 10, K M Van Zandt's Addition,to be replatted with the adjoining
property for a new commercial development along West 7th Street;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Kimley-Horn and Associates, Inc.,on behalf of JLC West 7th, LLC, has requested vacation of this remnant portion of the alley to be replatted with
the adjoining property for a new commercial development along West 7th Street.The City Plan Commission recommended approval of this
request at its meeting on April 26,2023.An acceptable final plat(FS-23-134)has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the alley.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
