AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE GRANTS FUND IN THE AMOUNT OF ~w2,440.44, FROM INTEREST EARNED, FOR
THE PURPOSE OF FUNDING A "MOW DOWN AIR POLLUTION" MOWER EXCHANGE
PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CGNFLIGT HEREWITH: AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments far Fiscal Year 2408-2649, there
shat( also be increased estimated receipts and appropriations in the Grants Fund in the amount of
$2,400.00, from interested earned, for the purpose of funding a 'Mow Down Air Pollution" mower exchange
program.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
Thaf this ordinance shall be cumulative of Ordinance No. 18283 and aII other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, In which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption,

Texas Commission on Environmental Quality for a Mower Exchange Event and Adapt Appropriation

It is recommended that the Gity Counci[.•
1. Authorize the City Manager to accept up to $50,000.00 in Fiscal Year 2009 from various parties based
on the agreement with Texas Commission on Environmental Quality to receive voluntary Supplemental
Environmental Project contributions fora "Mow Down Air PoAution" Mower Exchange Event;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in an amount not to exceed $50,000.00, upon receipt of Supplemental Environmental Project
funds;
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in the amount of $124.16 from available funds;
4. Authorize a transfer of interest earned from Supplemental Environmental Project Fiscal Year 2008 grant
to Fiscal Year 2009 grant in the amount of $1,114.09: and
5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in the amount of $2,000.00 from interest earned.

where approximately 200 operational gas-powered walk-behind mowers were traded in for a discount on
clean-running electric mowers. A total of $43,3$7.00 in SEP funds were received by the City in Fiscal Year
2008.
The Fiscal Year 200$ SEP grant earned interest in the amount of $1 „238.25; TCEG2 has authorized the
expenditures of $124.16 during the Fiscal Year 200$ and the transfer of $1,114.09 to the Fiscal Year 2fl09
grant year. Any future interest earned will be authorized to spend on the SEP grant.
As of May 2009 three separate parties have been identified to provide $20,108.00 in contributions to the
City of Fort Worth in settlement of an enforcement action brought by the TCEC2. The City plans to use
these and any additional funds identified by the TCEO to host a "Mow Down Air Pollution" Mower
Exchange Event this summer. Funds identified to date will remove approximately 100 gasoline-powered
walk-behind mowers from service and result in an estimated reduction of three and one half tons of
volatile organic compound (VOC} emissions and removal of seven and one half tons of carbon monoxide
emissions per year. The event will also assist in educating citizens on ways they can reduce ozone-
forming emissions.

The Financial Management Services Director certifies that upon approval of the above recommendations
and adoption of the attached appropriation ordinance, funds will be available in the current operating
budget, as appropriated, of the Grants Fund.
