CITY wi[I acf �nder this Agreement in accordance with all applicable state and federal laws, G. CITY reserves t�e right to reject any and all waste(s). 4. C�SQ�'S O��,IGATIONS �►I�D ��S�ONS1�1�1'Ti�S - A. CESQG agrees that it shall safely fransport to the ECC its waste(s) for disposal under this AGREEMENT following all state and federaf laws. CESQG understands that regulations under Title 49 ofi the United States Code of �ederal Regulations apply far the transpo� of hazardous materials in commerc�. B. CESQG agrees thaf it shall bring only the type(s) of waste{s) that is acceptable pursuant to Section 3 A aboue. C. CESQG agrees that it shal[ bring waste(s) to the ECC only after first getting a written cost estimate from CITY and sched�tling an appointmeni. CESQG agrees thaf it shall bring waste(s) only at its scheduled ap�ointment dates and times. . D. CESQG agrees that the waste(s) if brings to the ECC shall be represenf�d and identified ffl CITY to the besi ofi CESQG'S a4ility. A��horize a rate increase io caver pragram costs. � DISCUSSION: On Aug�rst 22, 200fl (M&C G-12992}, the Cifiy Cauncil ap�roved tne Small Business Hazardous Wasfe pilot program at the Environmentaf Colleetion Cent�r (ECG). Over the past year, the ECC has disposed � af approximately '{7,t}00 paunds of waste dUring the pilot program, for an average of 1,D00 pounds per business served. 4n Octaber 1, 200�, in an effort to better serue small busin�sses a�� housing con#ractars, the ECC instituted a pilot program for businesses classified as G�nditionally Exempt Small Quantity Cenerators {CESQGs). Part of the pilat program was to a�fow only businesses from Fort Worth to utilize the services at the ECC. . Over th� last y�ar, tF�e ECC has turned away over 20 sm�ll 6usinesses from autside of For� Worth {Arlington, White S�ttlement, Haltom City, etc.) who wanted to dispose af I�azardaus waste properly. 5taff is recommending tlie CESQG program be expanded io incfude busin.esses from -al! of Tarrant County. The Texas Natural Resources Conservation Gommission afso has endorsed fhe expans�on af the-CESC,�G program to include all of Tarrant County. The proposed rate schedu{e increasas the flat fee for handling the waste fram �$55.OD �to $130.OD as econcimies pf scale are not yet at optima{ le�els. Rate increases are the result af price increases for disposal services and to recoup averhead costs. Rates will apply to all smalf b�s�ne�ses ser�ed. .
