its waste(s} will be eonsolidafed at the ECC with the waste(s} of other condifionalEy-exempt
small quantity generatars and household hazardous waste(s).
F. CfTY will act under fh[s Agreement in accordance wiih all applicabfe sta�e and federal

G, Cl'iY reserves the right to reject any and all waste(s},
4. C�SQG'S OBLfGAi1�NS AND RESP��IS��ILITI�S o
A. CESQG agrees that it shall� safely trans�ort to the ECC its waste{s) for d�sposaf under
this AGREEMENT folbwing al! state and federal laws. CESQG understands that
regulations under Title 49 of th� United States Code of Federal Regulatians apply for
the transpo�t of hazardous mater[ais� in commerce.
B. CESQG agrees that it shal! bring only the type(s) of waste(s) that is acceptable purs�ant
to Section 3 A above. �
C. CESQG agrees that it shall bring wast��s) to the ECG only after first getting a wriiten
cost estimate from CfTY and scheduling an appointment. CESQG agrees that it s�all
bring wasfe(s) only at its scheduled appointment dates and #irr��s.
D. CESQG agrees #hat the waste{s} it brir�gs to t�e ECC shall be represented and
ic�entifiad to CITY fo ti�e best o# CESQG'S ability. CESGQ agrees that it shal[ not bring
unknown waste�s) to ti�e ECC. .-
E. The pf�ysical a�dress(es) of CESQG'S facilities that are cavere�cf under this

C. PARTIAL QUANTITIE5 - Any partlal gallon ar any partial pound of was#e shall be
charged as a full gallon or pound.
D. CESQG understands that paymenk to GIYY is required at tt�e time of delivery of waste(s)
to the ECC, and agrees that it shall make such payment at such tlme, by check oniy,
payable ta "Ciiy of Fort Wpr�h - D�M". Charges to C�SQG shall be based upan ti�e
actua! type and amount of waste(sj del�vered to the �CC by C�SQG and not upon the
written estimate �ravided tv C�SQC by CIiY. In additian, a$25,OD return check fee wili
be charged far any check that is d�shonored.
E. CESQG understands and agrees #hat �ITY wil) require additional payment if it is
determined #hat waste{s)-broug�t to the ��C by GESQC ?�ave been misidentified and
that the cost to ClTY to dispase of such waste(s} is more ti�an arfglnally est(mated.
CiTY shal! biil CESQG for these additfonal costs by written statement. C�SQG agrees
��to p�ay� no ��ater�than 30 days fol�owing the date af the statement.

7. T�RMiN�4ilOA1--
CITY reserves the right to terminats this A(aR�E1VlENT at any time, without cause and
far any reason whatsoever, by pravidEng wrftten notice io CESQG. Such kerminatian
shall be effective immediately.

DISPOSAL, TREATMENT OF WAST�(S} G�NERAGTED BY CESQG.
The obligations of the � Contractar under this 5ection shall survive the �xpirati�n of this
contract and the discharge of al! other obligations owed by the parties to each other.
9. ��lTIRETY - This AGREEMENT and ail delivery dacuments signed under this AGREEMENT
contain all commitmenis and agr��ments of t�e �arkies hereto, and no ofher oral or written
commitments shall have any farce or effiect if nat contained herein.
�0, SEVERAgILITY - In fhe event any an� o� mare of the provasions contain�d in this
AGREEM�NT s�all for any reason be held ko be invalid, illegal, or �nentorceable in any
respect, such invalidity, �illegality, ar unenfarceability shall r�at affect any other provision thereof
and t�is AGR�EMENT shall be construed as if such i�valid, illegal, ar unenforceable
provisions hac! never been cankained ner�in.
11. V�NUE - Snauld any action, real ar asserted, at faw or in equity, arise out of the tarms and

RECOMM�NDATION:
, It is recommended that the City Council:
1. Authorize the ap�roval of program changes for the Small Business Hazarc{ous Waste Pro�ram at
the Enviranmental Collection Center; and
2. Authorize extension of the prograrn to include a{I small businesses wifhin Tarrant County; and
3. Authorize a rate increase to cover program costs.
DISClJSSION:
�n August 22, 2000 (M&C G-12992), tF�e City Council approued the Small Business Hazardous VIlaste
pilot program at the Environmer�tal Callection Center �ECC). Over the past year, the ECC has disposed
af approximately 17,000 pounds of wast� during the pilot program, for an average of 1,000 pour�ds per
business served.
Or� Octaber 1, 2000, in an effort to better serve small businesses and hvusing contrac#c�rs, fhe ECC
instituted a pilat program for businesses classified as Con�itionally Exempt Small Quantity Generators
(CESQGs}. Part of the pilot pragram was #o ailow only businesses from For� Worth to utilize the
serv�ces at th� ECC.
Over the last year, the ECC has turned away flver 20 small businesses f�-om outside ofi Fart Warth
(Arlington, White Settlement, Halfom City, etc.) who wanted to dispose of hazardous waste properly.
StafF is recommending the C�SQG prvgram be expand�d ia include businesses from al! of Tarrant
County. The Texas Natural Resources Conservation Commission afsa has endorsed the expansion of
the CESQG program to include all af Tarrant CoUnty.
The propased rate schedule ir�creases the flat fee for handling fhe wa�te from $55.40 �to $130.00 as
economies of scal� are nat yet at optimal feveks. Ra#� increases are the resuli of price i�creases for
disposal senrices and fo recoup overhead costs. Rates will ap�ly ta all sma11 businesse� served.
