Ordinance No. I ~~ "~~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND iN THE AMOUNT OF $18,600, SUB.lECT TO RECEIPT OF THE HAZARDOUS MATERIALS EMERGENCY PREPAREDNESS GRANT FROM THE STATE OF TEXAS D6VISON OF EMERGENCY MANAGEMENT, FOR THE PURPOSE OF FUNDING THE ENHANCEMENT OF HAZARDOUS MATERIALS PREPAREDENESS PROGRAMS IN THE FIRE DEAPRTMENT, OFFICE OF EMERGENCY MANAGEMENT; MAILING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE lT ORDAINED 13Y THE CITY COUNCIL OF THE CITY OF FORT WDRTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $18,600, subject to receipt of the Hazardous Materials Emergency Preparedness Grant from the State of Texas Division of Emergency Management, far the purpose of funding the enhancement of hazardous materials preparedness programs in the Fire Department, Office of Emergency Management. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Approve submission of a grant application by the City Manager o.n October 28, 2004 to apply for a one-year grant for $18,600 from the State of Texas Division of Emergency Management; 2. Authorize the City Manager, subject to grant receipt, to enter into an agreement with the State Division of Emergency Management and adhere to grant specifications; 3. Accept a contribution from the Tarrant County Local Emergency Planning Committee of up to 50°/a of the $3,100 matching funds for this grant; 4. Approve the use of $3,100 as required for the 20% match; and 5. Adopt -the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $18,600 subject to receipt of the funds. DlscussloN: The US Department of Transportation, through the State of Texas ©ivision of Emergency Management, is providing funding for local jurisdictions tv enhance hazardous materials preparedness programs. The Hazardous Materials Emergency Preparedness {HMEP) grant of $18,600 wiq help better educate citizens how to reac# to chemical release incidents, as well as, better prepare the first responders in the City of Fort Worth. This will be achieved through the distribution of informational literature at various schools, institutions and events; as well as updating Hazardous Material databases so that first responders wilt be aware of possible hazards when responding to an incident This grant requires a funding contribution {called a "match") from local agencies, which would amount to $3,100 of the tv#af $18,600 for the purposes of this grant, the matching funds are defined as 20°/a of the state's share of the total {$15,600). The Tarrant County Local Emergency Planning Committee {LEPC) and the City of Fort Worth Office of Emergency Management will be the primary source of the 20% match. The Fort Worth OEM match will be approximately 50% of the total matching amount and came -from their operating supplies account. Any allowable "soft" match {labor, equipment casts tied to the execution. of the grant funded activi#ies) will be applied and will reduce the overall amount of the monetary "hard" match. Match funds for this grant were identified immediately prior to the deadline; however, staff believed this program was worthwhile and submitted the application on October 28, 2004 for which we are now seeking Logname: 36HMEP Faye 3 ~,f2 confirmation. if the City Council desires, the application may be withdrawn. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that upon award and receipt of the grant, approval of the above recommendation, and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
