AMENDMENT No . 4
TO CITY SECRETARY CONTRACT No. 50217
WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 50217 (the
CONTRACT) which was authorized by M&C C-28545 on the 23rd day of January, 2018 in
the amount of $1,795,070.00; and
WHEREAS, the CONTRACT was subsequently revised by Amendment No.l in the
amount of $48,720.00 administratively authorized on April 6th, 2021, Amendment
No. 2 in the amount of $49,256.00 administratively authorized on March 3rd,
2022, and Amendment No. 3 in the amount of $263,400.00 authorized by M&C 22-0414
on June 14th, 2022; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Clear Fork Lift Station and Force Main; and
WHEREAS, it has become necessary to execute Amendment No. 4 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional engineering
services specified in proposal attached hereto and incorporated herein. The
cost to City for the additional design services to be performed by Engineer
totals $99,500.00.

Article II of the CONTRACT is amended to provide for an increase in the
fee to be paid to Engineer for all work and services performed under the
Contract, as amended, so that the total fee paid by the City for all work and
services shall be an amount of $ 2,255,946.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Dear Liam:
This letter is in reference to a contract between Kimley-Horn and Associates, Inc. ("Engineer" or
"Kimley-Horn") and the City of Fort Worth (the City) dated 01-31-2018 referred herein as the
"Contract".
This amendment is to provide additional construction phase services for the construction phase portion
of the project. ENGINEER will provide the services outlined as follows:
CONTRACT TASK 8 — LIFT STATION — CONSTRUCTION PHASE SERVICES:
( Water $0, Sewer $44,400)

8.4 Shop Drawing Review
ENGINEER will complete the following additional tasks in accordance with the Original Contract:
• Review up to fifty (50) additional shop drawings, samples, and other submittals submitted
by the Contractor.
8.5 Request for Information (RFI):
ENGINEER will complete the following additional tasks in accordance with the Original Contract:
• Provide necessary interpretations and clarifications of the Contract Documents, and make
recommendations as to the acceptability of the work for up to thirty (30) additional RFIs.
8.9 Supplemental Construction Phase Services
ENGINEER will complete the following additional tasks in accordance with the Original Contract:
• Site Observation
• ENGINEER will be on site for an additional eighty (80) hours to perform site
observation.
• City and Contractor Coordination
• ENGINEER coordinate with City staff and the Contractor on an as -needed basis
for an additional twenty (20) hours.

15.2 Materials Testing Coordination and Evaluation
ENGINEER will complete the following additional tasks in accordance with the Original Contract:
• Maintain Report Log
• ENGINEER will maintain a log of test results as they are received.
• Coordination with Testing Lab and City
• ENGINEER will coordinate with Testing Lab regarding any discrepancies as well
as timing of proposed testing. ENGINEER will notify CITY of failed tests.
• Review of Testing Reports
• ENGINEER will review materials testing reports as they are received to determine
conformance with the Construction Contract Documents, and whether further
clarification is required from the Testing Lab.
• Limitation of Responsibilities
• ENGINEER shall not be responsible for the acts or omissions of the City's testing
lab. ENGINEER shall not have the authority or responsibility to direct the work of
the City's testing lab.
15.3 On -Site Observation
ENGINEER will complete the following additional tasks in accordance with the Original Contract:
• Make up to ten (10) additional site visits in order to observe the progress of the Work.
15.5.2 Change Orders
ENGINEER will complete the following additional tasks in accordance with the Original Contract:
• Provide support for up to twenty (20) change order requests, and associated revisions to
the Drawings.

We recommend that the City increase the budget by $99,500 for these additional services.
