FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENTS ON MALCOLM STREET FROM CRAIG STREET TD LANCASTER AVENUE AND HAYNiE STREET FROM CRAIG STREET TO LANCASTER AVENUE; MAKING TH1S ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HI~REWITH; AND PROVIDING AN EFFECTIVE DATE. That in addition to those amounts allocated to the various City departments far Fiscal Year 2004-2005 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Wa#er Capita! Project Fund in the amount of .$159,385.18 and the Sewer Capital Project Fund in the amount of $209,876.23 from available funds for the purpose of funding a contract with Stabile & Winn, Inc. for pavement reconstruction and water and sanitary sewer replacements on Malcolm 5tree# from Craig Street to Lancaster Avenue and Haynie Street from Craig Street to Lancaster Avenue. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $369,261.41 from the Water & Sewer Operating fund to the Water Capita! Project Fund in the amount of $159,385.18 and Sewer Capital Fund in the amount of $209,876.23; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Water Capital Project Fund in the amount of $159,385.18 and Sewer Capital Project Fund in the amount of $209,876.23, from available funds; and 3. Authorize the City Manager to execute a contract with Stabile & Winn, Inc. in the amount of $547,750.20 far pavement reconstruction and water and sanitary sewer replacements on Malcolm Street from Craig Street to Lancaster Avenue and Haynie Street from Craig Street to Lancaster Avenue. DISCUSSION: On June 21, 2002, the Handley Neighborhood Association received the City's 13th Model Blacks Program award of $1.2 million, which included the street improvements for bath Malcolm and Haynie Streets from Craig Street to Lancaster Avenue in the Handley Model Block area. As part of this neighborhood iprove- ment program, the Model Blocks steering committee set aside $459,768.00 for the street improvement project. On October 21, 2003 (M&C C-19818}, the City Council authorized the City Manager to execute an engineering agreement with HNTB Corporation, Inc. to prepare plans and specifications far pavement reconstruction and water and sanitary sewer replacements on Malcolm Street from Craig Street to Lancaster Avenue and Haynie Street from Craig Street to Lancaster Avenue. This project was advertised to have three different options not to exceed the existing funds for construction available for these streets. Option One included the reconstruction of both Mafcalm Street and Haynie Street with 6-inch hot mix asphalt concrete over an 8-inch stabilized sub grade; new concrete, curb, gutter, driveways and sidewalks as indicated on the plans. Option Two included reconstruction of only Malcolm Street. Option Three included reconstruction of Malcolm Street with a 3-inch application of hot mix asphalt concrete over 8 inches of pulverized sub grade. The Water Department has determined that the severely deteriorated sanitary sewer lines require r.~Qn~~,P~ anNra.r.r.nMUavnrT~ p~nP ~ replacement prior to street reconstruction an Malcolm Street and that the water and. sanitary sewer lines require replacement on Haynie Street. The project was advertised for bid October 7 and October 14, 2004. On November 18, 2004, the following bids were received: Bidder Dption One Option Two Option Three Time of Contract Stabile &Wnn, lnc. $723,991.70 $547,750.00 $648,073.30 120 Working Days McClendon Construction Co., Inc. $744,396.00 $562,814.80 $688,965.60 Peachtree Construction Ltd. $833,946.10 $649,629.90 $745,933.20 After reviewing all the bid proposals and recommendations from the Housing Department, who previously met with the area neighborhood association during a public meeting, City staff recommends Option Two t`or construction based upon available funding. The reconstruction of Maicalrn Street will be completed frst and an inter-focal agreement with either the Transportation and Public Works Department or Tarrant County will be entered for resurfacing of Haynie Street. In addition to the contract amount, funding in the amount of $23,078.83 {water $9961.57 and sewer $13,117.26) is required for associated water and sanitary sewer construction inspection and survey casts. The contingency funds to cover change orders for water and sanitary sewer work are $16,484.88 {water $7,115.41 and sewer $9,369.47). The contingency fund required for paving reconstruction is $10,902.61. Stabile &Wnn, inc. is in compliance with the City's M/IIVBE Ordinance by committing to 4% M/WBE participation and documenting good faith effort. Stabile & Winn, Inc. identified several supplier opportunities. However, the MIWBEs contacted in the identified areas did not respond. The City's goal on this project is 22%. The project is located in COUNCIL DISTRICT 5, Mapsco 80J. FISCAL INFORMATIIONICERTIFICATION: The Finance Director certifies that upon. approval and completion of recommendation No. 1 and the adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water and Sewer Capital Projects Fund and fhe Grants Fund.
