P00043) BY THE SAME AMOUNT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be adjusted estimated receipts and appropriations in the Stormwater Capital Projects Fund, by increasing estimated receipts and appropriations in the Basswood Boulevard at Old Santa Fe Trail Traffic Signal project(City Project No. 103998)in the amount of$80,000.00 and decreasing estimated receipts and appropriations in the Drainage Improvement Projects programmable project(City Project No.P00043)by the same amount. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in the Stormwater Capital Projects Fund in the amount of$80,000.00 by increasing estimated receipts and appropriations in the Basswood Boulevard at Old Santa Fe Trail Traffic Signal project(City Project No. 103998)and by decreasing estimated receipts and appropriations in the Drainage Improvement Projects programmable project(City Project No.P00043)by the same amount;and 3. Amend the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: In July 2022,City Secretary Contract Number 57860 was administratively approved authorizing LJA Engineering Inc.to provide engineering services for the design and construction of the Basswood Boulevard at Old Santa Fe Trail Traffic Signal project(City Project No. 103998).This project was identified as part of the 2022 Bond Traffic Signals Program with initial project funding authorized by City Council in January 2021 with Mayor and Council Communication(M&C)21-0076.The scope of this project includes design and construction of a new traffic signal,accessible pedestrian signals(APS),and Americans with Disabilities Act(ADA)ramps.The design for this project is close to completion,and the City will be issuing a task order using the existing on-call contract with Bean Electrical, Inc.for construction of the project. During one of the community outreach meetings for this project,residents requested to improve drainage conditions near the intersection,The City reviewed the request and made the decision to update the scope of this project to include drainage improvements.This Amendment No. 1 and additional funding appropriated with this M&C will be used for engineering and construction services related to the drainage improvements. The action in this M&C will amend the FY2024-2028 Capital Improvement Program as approved in connection with Ordinance 26453-09-2023. Funding is budgeted in the TPW Dept Highway&Streets Department's Drainage Improvement Projects programmable project within the Stormwater Capital Projects Fund for the purpose of funding the Basswood&Old San Fe Traff Signal project,as appropriated This project is located in COUNCIL DISTRICT 2 and COUNCIL DISTRICT 7. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are currently available in the Drainage Improvement Projects programmable project within the Stormwater Capital Projects Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance,funds will be available in the current capital budget,as appropriated, in the Stormwater Capital Projects Fund for the Basswood&Old San Fe Traff Sig project.
