AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF A
VARIABLE WIDTH RIGHT OF WAY KNOWN AS WEST VICKERY
BOULEVARD, SITUATED IN THE SARAH JENNINGS SURVEY,
ABSTRACT 844, AS DEDICATED BY LOT 1, BLOCK 1, JENNINGS
NORTH ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT THEREOF,
RECORDED IN CABINET B, SLIDE 484, OF THE PLAT RECORDS OF
TARRANT COUNTY, TEXAS, AND LOT 1, BLOCK 2, HEMPHILL
LAMAR ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT RECORDS
THEREOF, RECORDED UNDER INSTRUMENT NUMBER D216055664,
OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS,
CONTAINING APPROXIMATELY .271 ACRES OF LAND; PROVIDING
THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES
EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
1. That a portion of West Vickery Boulevard, a variable width public right of way, situated
in the Sarah Jennings Survey,Abstract No, 844, as dedicated by Lot 1, Block l, Jennings
North Addition, an addition to the City of Fort Worth, Tarrant County, Texas, according
to the plat thereof, recorded in Cabinet B, Slide 484 of the Plat Records of Tarrant
County, Texas and Lot 1, Block 2, Hemphill Lamar Addition, an addition to the City of
Fort Worth, Tarrant County, Texas, according to the plat thereof, recorded under
Instrument Number D216055664, of the Plat Records of Tarrant County, Texas,
containing approximately 0.271 acres of land more or less, and as more specifically
described in Exhibit"A" and "B" attached hereto and incorporated herein by reference be

and the same is vacated and extinguished.
SECTION 2.
That the easements to the land in the above-described vacated street right of way are
hereby released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

LEGAL DESCRIPTION
RIGHT-OF-WAY ABANDONMENT
BEING 0.271 acre of land situated in the SARAH JENNINGS SURVEY, Abstract No. 844, Fort
Worth, Tarrant County, Texas, and being a portion of West Vickery Boulevard (a variable width
public right-of-way). Said 0.271 acre of land being more particularly described by metes and
bounds as follows:
BEGINNING at a "Y" cut in concrete found at the Southwest corner of Lot 1, Block 1, Jennings
North Addition, to the City of Fort Worth, Tarrant County, Texas, according to the plat recorded
in Cabinet B, Slide 484, of the Plat Records of Tarrant County, Texas, and said point lying at the
intersection of the Southeast right-of-way line of Interstate Highway No. 30 (a variable width
public right-of-way)with the North right-of-way line of said West Vickery Boulevard;
THENCE along the South boundary line of said Lot 1 and the North right-of-way line of said
West Vickery Boulevard, as follows:
1. N 890 12' 50" E 973.49 feet, to a "Y" cut in concrete found at the most Southerly
Southeast corner of said Lot, and said point lying at the Southeast corner of a 9-foot-
wide portion of West Vickery Boulevard previously vacated by City Ordinance No,
10897;
2, N 000 47' 10"W 9.00 feet, to a "Y" cut in concrete found in the South boundary line
of said Lot 1, Block 1, and the East boundary line of said City Ordinance No. 10897, to a
"Y" cut in concrete found in the South boundary line of said Lot 1, Block 1;
3. N 890 12' 33" E 295.24 feet, to an "X" cut in concrete set at the Southeast corner
of Lot 1, Block 2, Hemphill Lamar Addition, to the City of Fort Worth, Tarrant County,
Texas, according to the plat recorded in County Clerk's File No. D216055664, of the
Official Public Records of Tarrant County, Texas, and said point lying in the West right-
of-way line Hemphill Street (a 120' wide public right-of-way);
THENCE severing said West Vickery Boulevard, as follows:
1. SOUTHWESTERLY 17.03 feet, along a non-tangent curve to the right, having a
radius of 512.96 feet, a central angle of 01' 54' 08", and a chord bearing S 000 40'
01" W 17.03 feet, to an "X" cut in concrete set at the intersection of the West right-
of-way line of said Hemphill Street with the North right-of-way line of the aforesaid
West Vickery Boulevard;
2. S 89' 13' 00"W 900.98 feet, to an "X" cut in concrete set;

It is recommended that the City Council:

Addition,and Lot 1,Block 2,Hemphill Lamar Addition,to be replatted with the adjoining property for a multifamily development;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.

8hVnin and Crawford,on behalf o1 Trademark Property Company,has requested vacation ofa portion ofhVht-o#way along VK Vickery Boulevard
to be replatted with the adjoining property for a multifamily development,The City Plan Commission recommended approval of this request at its
meetings nn November, 1S.2U21 and May 25.2U22 An acceptable final plat(FS-23-226)has been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned rights-of-way through plat dedication.The City does not own any fee interest
in the rights-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement. In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council an March 6,2007,Mayor and
Council Communication(M&C G-1 5624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
wayooxomontfor\heotmet.
This project is located in COUNCIL DISTRICT 9.
