Ordinance No. ~ i~ -~a ~'O~D~~ AN ORDINANCE INCREASING ESTIMATEb RECEIPTS AND APPROPRIATIONS IN THt~ SOLID WASTE CAPITAL IMPROVEMENTS FUND IN THE AMOUNT OF $903,529 FROM AVAII.ABI-E FUNDS, FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH DI;OTTE, INC. FOR THE LANDFILL ACCESS ROAb FROM EXISTING SOUTHEAST LANDFILL WEIGH STATION TO I.H. 20 ANb IMPROVEMENT TO THE I.H. 20 ACCESS ROAD NEAR THE SOUTHEASET LANDFILL ACCESS ROAD; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THI= CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Solid Waste Capital Improvements Fund in the amount of $903,529 from available funds, for the purpose of funding an engineering agreement with DeOtte, Inc. for the Landfill Access Road from existing Southeast Landfill Weigh Station to I.H. 20 and Improvement to the I.H. 20 Access Road near the Southeast Landfill Access Road. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be c~m~lative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said canfliating provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing appropriations in the Solid Waste 1=und by $9p3,529.00, and decreasing unreserved retained earnings by the same amount; 2. Authorize the transfer of $903,529.OQ from the Solid Waste Fund to the Solid Waste Capital improvements Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Solid Waste Capita[ Improvements Fund by $9a3,529.D0 from avai[abie funds; and 4. Authorize the City Manager to execute an engineering agreement with DeOtte, Inc., in the amount of $79(3,92Q.a0 far the Landfill Access Road from existing Southeast Landfill Weigh 5tafiion to I.H. 2Q and Improvement to the I.H. 20 Access Road near the Southeast Landfill Access Road. ©ISClISSIDN: The Gity's Southeast Landfill is accessible through the City of Kennedale via Dick Price Road. In the past two years, accessibility to the landfll has become a point of contention between the two cities. In order to provide better ingress and egress for garbage trucks to the landfill, City staff recommends that an alternate roadway be constructed that will provide unlimited all-weather access to the City's facility. After considering several alternatives, it was determined that the best alternate was to provide access to the Eandfill from l.H. 2t7. The scope of the project consists of the preparation of plans and specifications for the construction of Landfill Access Road fram the City`s southeast landfill weigh station to I.H. 20 and the E.H. 2a Access Road to the Landfill Access Road. DeOtte, Inc., proposes to perform the necessary engineering design and survey work for a lump sum fee of $790,920.OD. City staff considers this fee to be fair and reasonable fray the scope of services proposed. In addition to the contracfi amount, $112,fi09.Oq is required for project management by the Engineering Department. DeOite, Enc., is in compliance with the Gity's MlWE3E Ordinance by committing to 28.% MlW13E participation. The City's goal on the project is 26%. ~ nr.r...rn n. FISCAL INFORMATIONICERTIFICATION: The Finance Director certifies that, upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of the Solid Waste Capital Improvements Fund.
