HomeMy WebLinkAboutContract 28877"1ECRETARY FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 22150 ROANOKE WHOLESALE WATER CONTRACT WHEREAS, on the 17'h day of September, 1996, the City of Fort Worth and the City of Roanoke entered into City of Fort Worth City Secretary Contract No. 22150, providing for the sale of treated water by the City of Fort Worth to the City of Roanoke; and WHEREAS, the City of Roanoke desires to obtain a second point of connection to the Fort Worth System; NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: 1. City of Fort Worth City Secretary Contract No. 22154 is hereby amended by adding a new paragraph 23, which shall be and read as follows: 23. Additional Point of Connection 23.1 Customer is granted a second point of connection to the Fort Worth System at the approximate location as shown on Exhibit "A" attached hereto and made a part hereof for all purposes. The meter to be installed at such connection shall be an eight -inch (S") meter. 23.2 Customer, at its sole cost and expense, shall be responsible for the design and construction of the meter vault and the installation of all metering equipment, which shall be subject to the review and approval of Fort Worth. The metering equipment shall be in compliance with paragraph 3.1 of City of Fort Worth City Secretary Contract No. 22150. All construction shall be inspected by and acceptable to Fort Worth. Upon completion and acceptance of the meter vault and metering equipment, the operation and maintenance of same shall be the responsibility of Fort Worth, the cost thereof being a System Cost. 23.3 Customer, at its sole cost and expense, shall be responsible for constructing the water main extension from the existing main in Henrietta Creek Road and independence Parkway, to the meter station. 23.4 Customer, at its sole cost and expense, shall design and construct install a backflow prevention device, or air gap, together with any necessary housing therefore, which shall be subject to the review and approval of Fort Worth. Customer, at its sole cost and expense, shall be responsible for the operation and maintenance of such backflow prevention device and housing. OFFICIAL RECORD CITY SECRETARY FT. WORTH, TX 23.5 Customer agrees that upon completion of the new meter station, hereinafter referred to as "Meter Station No. I", that the existing temporary meter will be abandoned permanently at its present location. At such time that Customer may require additional supply, the construction of a new meter station, ground storage tank and pump station will be considered at an alternate site, if additional capacity is not available from the Fort Worth system at Meter Station No. 1. 23.5 If additional capacity is available from the Fort Worth System at the Meter Station No. 1 location, and in the event Customer desires to have a larger meter installed at a time when the eight -inch (8") meter is not otherwise in need of replacement, Customer shall make written request to Fort Worth for its consideration. If Fort Worth, in its sole discretion, approves the installation of the larger meter, Customer, at its sole cost and expense, will be responsible for the design of the improvements, such design being subject to Fort Worth's written approval and the installation of the larger meter will be at Customer's sole cost and expense. 2. All other terms, conditions, and covenants contained in City of Fort Worth City Secretary Contract 22150 not amended herein continue in full force and effect. DISCUSSION: The uniform wholesale water contract requires additional points of connection to the Fort Worth water system be mutually agreed upon by the wholesale customer and the City of Fort Worth. The City of Roanoke has requested an additional water connection in the vicinity of Independence Parkway, north of Henrietta Creek Road. Under the terms of the contact, the City of Roanoke will pay the cost of the new metering facilities and any cost associated with connection to the Fort Worth water system. In addition, the City of Roanoke agrees to abandon the existing temporary meter station located at US 377 and Highway 170. City staff has reviewed the requested meter location and capacity issues with the City of Roanoke and recommends approval of this connection.
