HomeMy WebLinkAboutOrdinance 16295-02-2005~~ ORTINANCE NO. ~ ~~~~. ~~ ~ ~~~ AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY BETWEEN LOT 15-R, BLOCK. 20, CIIAMBERLATN ARLINGTON ~-IEIGHTS ADDITTON AS RECORDED TN CABTNET A, SLTDE 6457 PLAT RECORDS FORT WORTH, TARRANT COUNTY, TEXAS, AND LOTS I-6, FLOCK 3, HILL-CREST ADDITION AS RECORDED IN VOLUME 388, PAGE 17 PLAT RECORDS FORT WORTH, TARRAN'T' COUNTY, TEXAS, FROM A POINT AT BRYCE AVENUE TO A POINT AT CAlVIP BOWIE BOULEVARD BEING APPROXIMATELY 28Q FT LONG AND 19 FT WIDE, AND CONTATNING 5,013 SQUARE FEET, MORE OR LESS; PROVIDTNG FOR REVERSION OF FEE IN SATD LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITIT; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TE.L 11..1. R../ 6 SECTION 1. That an approximately 280 foot long by 19 foot wide alley located between Lot 15~R, Block 20, Chamberlain Arlington Heights Addition as recorded in Cabinet A, Slide 6457 Plat Records Fart Worth, Tarrant County, Texas, and Lats l-6, Block 3, Hill-Crest Addition as recorded in Volume 388, Page 17 Plat Records Fort Worth, Tarrant County, Texas, from a point at Bryce Avenue to a point at Camp Bowie Boulevard, containing approximately 5,Q13 square feet, and as mare specifically described in Exhibits "A", "B" and "G", attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2, That the fee to the land in the above-described vacated alley is hereby released and shall revert to the adjacent owner as provided bylaw. 5EC'I'T®lei 3. A twenty-faat utility easement will be dedicated on the repiat at the location of the alley and said easement shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. DISCUSSION: Adoption of the attached ordinance would vacate an alley between Lat 15-R, Block 20, Chamberlin Arlington Heights Addition as recorded in Cabinet A, Slide 6457 P.R.T.C.T., and Lots 1-6, Block 3, Hill-Crest Addition as recorded in Volume 388, Page 17 P.R.T.C.T., from a point at Bryce Avenue to a point at Camp Bowie Boulevard being approximately 280 feet long and 19 feet wide and containing 5,013 square feet, more or less. Chris L. Blevins of Brittain and Crawford LLC, has requested vacation of the above referenced Alley in order to create a building lot out of the land, as shown an the attached plat of Lot 3R, Block 3, Hill-Crest Addition. The Engineering Department, Real Property Services Division, states that $1.00 the receipt and sufficiency of which is hereby acknowledged, satisfies public interest. Reviewing City departments and public utility companies have raised no objections to this request. The City Plan Commission recommended approval of this request at its meeting an December 17, 2004. An acceptable replat has been received (see attached). The entire area will be retained as a utility easement and the northern portion (65.6 - 75 feet} will be retained as an access and utility easement as shown on the attached replat.
