WHEREAS, the City of Fort Worth (City) and Jacobs Engineerimg
Group Inc., (Engineer) made and entered into City Secretary Contract No.
39252, (the Contract) which was authorized by the City Council by M&C ~-
23735 on the 18th day of August 2009 and amended by City Secretary
Contract No. 39252-Al on the 18 th day of May 2010; and
WHEREAS, the Contract involves engineering services for
following project:

WHEREAS, it has become necessary to execute Amendment No. 2 to
said Contract to change scope of work in order to allow Engineer tlo
provide professional services for a Phase I Environmental Sitle
Assessment for each parcel of land acquired for BNSF main line Right-of-
Way;
NOW THEREFORE, City and Engineer,
their duly authorized representatives,

Article I, of the Contract is amended to include the additionl l
engineering services specified in a proposal letter dated April 2 1,
2010, copies of which are both attached hereto and incorporated herein.
The cost to the City for the additional services to be performed Jy
Engineer total $49,708.63.

Article II of the Contract is amended to provide for an increase
in the fee to be paid to ENGINEER for all work and services performJd
under the Contract, as amended, so that the total fee paid by the Ciby
for all work and services shall not exceed the sum of $1,843,918.22.

I am requesting an amendment to the Alliance Airport Runway Extension Project Phase VIII contract. This
amendment is for additional work that was not part of the original contract. The City of Fort Worth has
requested the Jacobs Team to provide professional services for a Phase I Environmental Site Assessment
for each parcel of land acquired for BNSF main line Right-of-Way . A summary of the additional work
items are shown below. The detailed scope of work , fee proposals and schedule are attached for your
information.

Scope of Work
Jacobs will provide additional program management activities for a Phase I Environmental
Site Assessment associated with the relocation of the BNSF main line . Jacobs will monitor
the progress of the subconsultant TranSystems performing the Environmental work. Jacobs
will also review the Phase I Environmental Assessment Report.

It is TranSystems understanding the proposed task is a Phase I Environmental Site Assessment for the
linear transportation project consisting of the Burlington Northern and Santa Fe Railway (BNSF) traak
realignment.
This section of BNSF railway real ignment track is located to the west of an existing track al ignm ent in
northern Tarrant County and southern Denton County . This new alignment is approxim ately 11 .55 miles
in length and requires acqu isition of additional land .
The Phase r is to be developed for both the City of Fort Worth (CFW} and the BNSF Railway. The prima ry
purpose of this Phase I is to conduct an environmenta l site assessment of parce l s of commercial real
estate with respect to satisfying one of the requirements to qualify for the innocent landowner,
contiguous property owner, or bona fide prospective purchaser limitation of CERCLA liability and "All
Appropriate Inquiry" (AAI).
It is TranSystems' understanding that the land will be acquired initially by the CFW and at a later date b

transferred to BNSF. As a result of this time delay, an addendum to the report is to be developed t o
discover and update any potential visual or Standard Environmental Record Source changes.
2.0 Scope of Services
Phase I
A Phase I Environmental Site Assessment will be developed in accordance with ASTM Standard E 1527-
05, Standard for Environmental site Assessments : Phase I Environmental Site Assessment Process . j
The PHASE I Environmental Site Assessment is to identify recognized environmental conditions m
connection with the property and shall have four major components .
• Records Review
• Site Reconnaissance
• Interviews (property owners and occupiers, and government offici als), and
• Report and Evaluation
The draft report w ill be reviewed by both the CFW and the BNSF Railway.
A statement will be included in the report that the report is for both the CFW and BNSF .
BNSF Addendum
An Addendum to original report is to be developed within 60 days of property transfer to BNSF to update
visual and ASTM/AAI Database of orig inal report .
This Phase I Environmental Site Assessment BNSF Addendum w ill be developed in accordance witil
ASTM Standard E 1527-05, Standard for Env ironmental site Assessments: Phase I Environmenta l Site
Assessment Process for updating .
A statement will be includ ed in the addendum to reflect it is developed for both the CFW and BNSF .
The draft report wi ll be reviewed by both the CFW and the BNSF Ra ilway (BNSF ).
3.0 Fees Scope of services
Based on the scope of se rv ices outlined above , discussions with Jaco bs Engineering , Brad Penn and DI°

The new alignment is either located partially on existing railway property or new property located to the
west of the existing alignment. The chain of title and environmenta l liens are to be obtained for only
those properties located west of the original railway track alignment on which additional ROW is to be
acquired. It is presently estimated that there are 27 such properties. If the chain of title search revels
more properties are impacted or that some of the properties in history area split and require additional
property searches, then additional cha in of title searches requ ired will be billed a $275 per search .
Mileage w ill be billed at Current IRS rates.
4.0 Schedules
TranSystems will deliver the Phase I within 60 working days of the authorization to proceed and will
coordinate with the CFW for site visits. CFW will coordinate and arrange for site access for site visits
with property owners .
TranSystems will deliver the Phase l Addendum afte·r the in itial Phase I is finished and within 15 working
days after receiving authorization from both CFW and BNSF to proceed with the Addendum, in order 1:6
facilitate the 60 day BNSF requirement for clos ing.
