HomeMy WebLinkAboutOrdinance 20866-08-2013 Ordinance No. 20866-08-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $2,136,691.42, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING A CONTRACT WITH CONATSER CONSTRUCITON, TX, LP, FOR WATER AND SANITARY SEWER MAIN RELOCATIONS FOR THE TRINITY RIVER VISION — CENTRAL CITY PROJECT AND THE TRINITY UPTOWN SERVICE AREA PHASE I — BRIDGE AND CHANNEL RELOCATIONS, PARTS 6 AND 12, WHITE SETTLEMENT ROAD BRIDGE WATER AND SANITARY SEWER RELOCATIONS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL,OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$2,136,691.42, from available funds, for the purpose of funding a contract with Conatser Construction, TX, LP, for water and sanitary sewer main relocations for the Trinity River Vision — Central City Project and the Trinity Uptown Service Area Phase I — bridge and Channel Relocations,Parts 6 and 12, White Settlement Road Bridge and Water and Sanitary Sewer Relocations. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached Appropriation Ordinance increasing the estimated receipts and appropriations in the Special Trust Fund, Trinity River Vision Project in the amount of$2,136,691.42 from available funds; 2. Authorize the transfer of$2,1 36,691.42 from the Special Trust Fund (Trinity River Vision Project) to the Water Capital Projects Fund; 3. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$2,136,691.42 from available funds; and 4. Authorize the execution of a contract in the amount of$3,982,719.00 with Conatser Construction, TX, LP, for Water and Sanitary Sewer Main relocations for the Trinity River Vision - Central City Project and the Trinity Uptown Service Area Phase 1 - Bridge and Channel Relocations, parts 6 and 12, White Settlement Road Bridge water and sanitary sewer relocations. DISCUSSION: On April 15, 2008, (M&C C-22765)the City Council authorized the City Manager to execute an Engineering Agreement with Kimley-Horn and Associates, Inc., for Water and Sanitary Sewer Main Relocations for the Trinity River Vision— Central City Project and the Trinity Uptown Service Area Phase 1 - Bridge and Channel Relocations. The overall Trinity River Vision (TRV) Project includes construction of the White Settlement Bridge over a future bypass channel between the Trinity River and Clear Fork Trinity River. This project, Parts 6 and 12, provides for the installation of water and sanitary sewer mains on Harrold Street, Viola Street, Commercial Street, Kansas Street and Greenleaf Street to accommodate the proposed bridge.
