HomeMy WebLinkAboutOrdinance 20865-08-2013 Ordinance No.20865-08-2013 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $2,136,691.42, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE WATER CAPITAL PROJECTS FUND FOR THE PURPOSE OF FUNDING A CONTRACT WITH CONATSER CONSTRUCITON, TX, LP, FOR WATER AND SANITARY SEWER MAIN RELOCATIONS FOR THE- TRINITY RIVER VISION — CENTRAL CITY PROJECT AND THE TRINITY UPTOWN SERVICE AREA PHASE I -- BRIDGE AND CHANNEL RELOCATIONS, PARTS 6 AND 12, WHITE SETTLEMEN'I'ROAD BRIDGE WATER AND SANITARY SEWER RELOCATIONS; PROVIDING FOR A SEVERABILfTY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of$2,136,691.42, from available funds, for the purpose of transferring said funds to the Water Capital Projects Fund for the purpose of funding a contract with Conatser Construction, TX, LP, for water and sanitary sewer main relocations for the Trinity River Vision—Central City Project and the Trinity Uptown Set-vice Area Phase I —bridge and Channel Relocations,Parts 6 and 12, White Settlement Road Bridge and Water and San=itary Sewer Relocations. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached Appropriation Ordinance increasing the estimated receipts and appropriations in the Special Trust Fund, Trinity River Vision Project in the amount of$2,136,691.42 from available funds; 2. Authorize the transfer of$2,136,691.42 from the Special Trust Fund (Trinity River Vision Project) to the Water Capital Projects Fund; 3. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$2,136,691.42 from available funds; and 4. Authorize the execution of a contract in the amount of$3,982,719.00 with Conatser Construction, TX, LP, for Water and Sanitary Sewer Main relocations for the Trinity River Vision - Central City Project and the Trinity Uptown Service Area Phase 1 - Bridge and Channel Relocations, parts 6 and 12, White Settlement Road Bridge water and sanitary sewer relocations. DISCUSSION: On April 15, 2008, (M&C C-22765)the City Council authorized the City Manager to execute an Engineering Agreement with Kimley-Horn and Associates, Inc., for Water and Sanitary Sewer Main Relocations for the Trinity River Vision— Central City Project and the Trinity Uptown Service Area Phase 1 - Bridge and Channel Relocations. The overall Trinity River Vision (TRV) Project includes construction of the White Settlement Bridge over a future bypass channel between the Trinity River and Clear Fork Trinity River. This project, Parts 6 and 12, provides for the installation of water and sanitary sewer mains on Harrold Street, Viola Street, Commercial Street, Kansas Street and Greenleaf Street to accommodate the proposed bridge. The project also includes the replacement (non-TRV related) of a deteriorated water Logname: 60TRVP612-CONATSER Pagel of 3 main on Northside Drive to provide increased water efficiency and delivery to customers north of the Commerce Street/Northside Drive intersection. The project was advertised for bid on April 18, 2013 and April 25, 2013, in the Fort Worth Star- Telegram. Louis Construction of Texas, Ltd $4,584,777.00 ;ARK Contracting Services, LLC $6,544,086.00 In addition to the contract amount, $68,000.00 (water: $60,000.00; sewer: $8,000.00) is required for construction staking, project management, material testing, inspection and $124,800.00 (water: $117,000.00; sewer: $7,800.00) is provided for change order contingencies. Of the $3,982,719.00 construction cost associated with this contract, $2,845,501.00 is considered TRV- related while the remaining $1,137,218.00 is considered non-TRV related. With approval of this Mayor and Council Communication, the City will have contracted for a total amount of$26.6 million in City funds with actual expenditures of$19.2 million (as of May 31, 2013)on the TRV project for design and construction activities associated with water/sewer utilities and roadway/bridge activities. In order to not exceed the City's $26.6 million commitment, $2,136,691.42 of the TRV-related portion of this contract cost ($2,845,501.00)will be paid for using Tarrant County Reimbursements received for the TRV Project, while the remaining $708,809.58 will be paid for using City Water Capital Revenue to complete the City's $26.6 million commitment to TRV. Since 2009, Tarrant County has provided the City of Fort Worth with annual reimbursements for bridge and utility work associated with the TRV Project. M/WBE Office - Conatser Construction, TX, LP, is in compliance with the City's BDE Ordinance by committing to nine percent MBE participation on this project. The City's MBE goal on this project is seven percent. This project is located in COUNCIL DISTRICTS 2 and 9, Mapsco 62Q and 62Y. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies funds are available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund and that upon approval of the above recommendations, and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of the Water Capital Projects Fund and the Special Trust Fund.
