Justifications for Change Order 2
Item 130 -In September 2010 the condition of the storm drain junction box in the intersection of Ninth
Street and Commerce Street after it was excavated was so poor that it could not be tied to a new drain
line. The existing junction box had to be demolished and a new reinforced concrete box reconstructed
in place at a cost of $4,825.40.
Item 131 -After curbs were moved in on Ninth Street to increase the walkway widths, field surveys
found that storm water would not fully drain from adjacent property and flood the walkway in two
locations . One additional storm drop inlet is needed to drain the alley between Houston and Main
Streets, and four more inlets will drain the sidewalk area adjacent to the parking lot on the north side of
Ninth between Commerce and Calhoun. The total cost for this work is $8,325 .31.
Item 132 -The proposed irrigation controller at Ninth and Main Streets was designed to be powered by
connecting to an existing electrical box in General Worth Square. The box did not contain the proper
electrical qualities, and the nearest alternative connection point is several hundred feet across the
square . To avoid the long run of wiring traveling under several paved areas, a solar power controller is
recommended . The cost to exchange the controllers and modify some irrigation valves to accommodate
the solar controller is $1,532.57 .
Item 133 -In November 2010 it was found that new walkways built to existing elevations in Hyde Park
near the Flatiron Building wou ld have resulted in water being directed toward the building doorway and
basement openings during rainfall events. Grading the walkways away from the building and placing
three drop storm inlets in low spots are required to avoid possible water damage to the building and
standing water on the walkway. The total cost for the new storm drain inlets is $3,629.63 .
Item 134 -Two existing marble benches that were constructed with the Panther Fountain were not
shown on the contract documents. In order to preserve the benches and integrate them into the new
improvements, the benches and bases require moving to a secure location on site and replaced into the
new Hyde Park layout. The total cost for this work is $1,000.00.
Item 135 -The contractor was directed by the plans to demolish the existing concrete walkways in Hyde
Park in preparation for the new architectural walkway construction . As demolition progressed in June
2010 the Panther Fountain plumbing and electrical circuits were found to be cast i nto the concrete that
was demol is hed . Replacement piping, conduit and electrical circuits are needed to restore the
operation of the fountain . The total cost for this work is $4 ,9 53 .00 .
Item 136 -The electrical power service to the Hyde Park area was designed to handle single phase 100
amp power. Oncor only delivers three phase power to the downtown area . The total cost to substitute
the service hardware, increase the conduit size and provide additional wiring is $994.07.
Item 137 -All of the existing planters on Throckmorton have electrical receptacles for maintenance and
tree ligh ting purposes. A receptacle in each of the four new plan ters on Throckmorton is required, but
not included in the plans. Also a pavement embedded street lighting circuit was damaged during
demolition . A new 1-1/4 inch conduit is required to replace the damaged one . The total cost for this
work is $3 ,320 .12 .
Item 138 -An additional 243 square yards of walkway pavement in front of the Convention Center is
required to be removed due to excessive cracking and displacement . The removal operation at that
location requires special equipment because of its large distance from the curb . The total cost of the
work is $6 ,084 .23 .
Item 139 -After Ninth Street was milled in December 2010, an assessment of the hidden underlying
pavement was made . Approximately 267 square yards of pavement in several locations in Ninth Street
are deemed unsound and is required to be demolished and removed before replacement. The cost for
this demolition and removal is $8,554.72 .
Item 140 -At a number of locations along Ninth and Throckmorton Streets sidewalk grades adjacent to
the project limits have to be modified to comply with the Americans with Disabilities Act and storm
drainage needs . Slopes on pathways are required to be constructed within maximum and minimum
standards . Demolition of 133 square yards of sidewalk pavement is necessary for compliance . The total
cost of this work is $2 ,802 .09 .
Item 141-In Change Order No . 1 one thousand cubic yards of former library basement rubble was
excavated and backfilled to allow construction of the Ninth Street/Throckmorton intersection . When
work resumed in Hyde Park north of Ninth Street in November 2010, the north portion of the basement
was discovered after the remainder of parking lot was demolished . Excavation of 1600 cubic yards of
rubble, partial wall demolition and backfilling with common fill soil are required to construct planting
areas, place walkways and plant trees . The total cost of the excavation and wall removal is $65,424.00 .
Item 142 -The two bus passenger shelters are served with electrical power through the Hyde Park
service connection. To determine The T's share of power costs, a sub-meter is needed to be installed in
the park electrical circuitry . The cost for furnishing and installing this meter is $1,095 .11.
Item 143 -In January 2011 during an inspection after traffic was restored on Ninth Street, the bus
turning paths were found to cross over pavement markings at Jones Street, Houston Street and
Throckmorton Street intersections. Prior to applying permanent pavement markings, placement of
temporary pavement marking tabs to widen the bus paths is requ i red for uninterrupted traffic to
operate safely . The total cost of this work is $920 .00 .
Item 144 -In July 2010 during pavement demolition the base of a large pole mounted sign was
discovered in a planting bed adjacent to the Throckmorton Street east sidewalk . To eliminate the six
foot deep safety hazard the top foot of the twelve-inch diameter pipe requires removal and the hole
backfilled to the surface of the ground. The total cost of this work is $500 .00.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Change Order No. 2
in the amount of $113,930.65 to City Secretary Contract No. 40241 with The Fain Group, Inc ., for
Hyde Park Transit Plaza and Ninth Street Improvements, thereby increasing the contract amount to
$2 ,788 ,381.76 .
DISCUSSION:
On May 4, 2010, (M&C C-24203) the City Council authorized the City Manager to execute a contract
in the amount of $2,611 ,672.61 with The Fain Group , Inc., for the Hyde Park Transit Plaza and Ninth
Street Improvements . On September 14, 2010, (M&C C-24438) the City Council authorized Change
Order No . 1 totaling $62,778.50 to compensate the contractor for additional materials not included in
the contract for backfilling the former library basement at Ninth and Throckmorton and waterproofing
material for the Public Safety Building basement.
Change Order No. 2 consists of the following materials not included in the original
contract: additional storm drop inlets, storm drain junction box , solar powered controller for tree
irrigation , additional conduit and electrical wire , additional sidewalk demolition, additional pavement ,
temporary pavement markings, electrical receptacles, pipe removal , additional backfill for former
library basement, electrical sub-meter for passenger shelters, Panther Fountain plumbing and
electrical replacement , and existing Hyde Park marble bench storage and relocation within
plaza. The total amount of Change Order No. 2 is $113,930.65 .

Staff considers the Change Order No. 2 amount to be fair and reasonable. The costs associated with
this change order will be funded with the project's contingency funds.
The Fain Group, Inc. is in compliance with the City's DBE Program by committing to an overall 28
percent DBE participation on this contract, inclusive of the work performed on this Change Order No.
2.
Construction on the project was substantially complete on January 24, 2011 .
The project is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budgets , as appropriated, of the Grants Fund and the Critical Projects Improvements Fund.
