(Developer) entered into a Community Facilities Agreement, City Secretary Contract No. 40274 ("CF A"); and WHEREAS , it has become necessary to execute Amendment No. 1 to the CF A to allow City participation in an amount not to exceed $48,353.77 for the City's portion of costs associated with construction , inspection , and material testing of the 12-inch waterline contemplated by the CFA; and WHEREAS, the City Council authorized execution of Amendment No. 1 to the CFA on the 4ft day of (J't2JU<-tLf;7 , 201 {! via M&C t -~Y l9 ] Y-. NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives , enter into the following agreement, which amends the CF A: 1. The City 's portion of inspection and material testing fees are directly allocated to the City's accounts for charges and does not reimburse the Water Inspection and Material Testing Fees to the developer. The City 's participation estimate shall be based upon unit prices contained in City of Fort Worth Ordinance No. 19192 (or by public bid). DISCUSSION: The developer Steel Grafters , Inc., has executed a proposed contract for community facilities to serve a development located in Fort Worth (see attached map). The total construction cost for water improvements for this development is $155,988.29 . There will be City participation for the 12-inch water main in Parker Henderson Road that will improve the service to the surrounding area. The Developer and the City estimated costs for water improvements are subject to construction inspection fees. Upon Council's approval, City staff will execute an amended Community Facilities Agreement to include city participation between the City and the Developer. IA. Water and Sewer Construction 11.
