FIRST RENEWAL AND AMENDMENT TO CITY SECRETARY ·
CONTRACT NO. 41004
WHEREAS, on October 25, 2010, the City of Fort Worth ("City") and Ace Pipe
Cleaning, Inc. ("Contractor"), collectively the ("Parties"), made and entered into City Secretary
Contract No. 41004 (M&C C-24471, Sept. 21, 2010) (the "Contract") for Water and Wastewater
Emergency Response Services at Various Locations Citywide; and
WHEREAS , the Contract is approaching the end of its original financial term; and
WHEREAS, the Contract may be renewed up to three times at the same terms,
conditions , and unit prices as originally bid; and
WHEREAS, the Parties desire to amend the Contract to change the expiration tenns to
allow the contract to run to the latter of 3 65 days or the maximum expenditure ; and
WHEREAS, in order to protect the public's funds, the contractor will be bound to the
unit prices as found in the bid tabulation section of the original agreement.
NOW , THEREFORE, the Parties , hereby agree as follows:

a. Contract No. 41004 , at Section D-8 of the Special Conditions , is hereby amended
to read as follows: "LIFE OF CONTRACT -The life of this Contract shall not
exceed 365 calendar days following the date of the Notice to Proceed nor exceed
the limit of the bid price, whichever should occur last."
b . The Unit Prices originally bid by Contractor upon which basis the Contract was
awarded, shall remain in effect for the duration of the Contract, as renewed.
c. Task orders will continue to be issued and remain contingent upon the availability
of funds and the availability of the contractor.
II.
All other terms and conditions of the Contract not amended herein remain unaffected and
in full force and effect, are binding on the Parties and are hereby ratified by the Parties.

SUBJECT: Authorize the Execution of a Contract for Water and Wastewater Emergency Response
with Ace P ipe Cleaning , Inc ., in the Amount of $49 ,300 .00 (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute a Water and
Wastewater Emergency Response Contract with Ace Pipe Cleaning , Inc ., in the amount of
$49 ,300.00 .
DISCUSSION:
The City of Fort Worth owns and operates water and wastewater plants , lift stations , and meter
stations that periodically require an emergency response using jet-vac trucks , vacuum tanker trucks ,
bypass pumping , plugging , and/or temporary piping. The purpose of this contract is to assist
operations and maintenance personnel with unforeseen , unscheduled , or emergency operations and
maintenance activities . This Emergency Response Contract will ensure that the City has a contractor
that can rapidly mobilize to a facility upon notice to perform these emergency serv ices which will help
the City stay in compliance with state and federal regulations .
This contract shall have three options to renew, under the same terms , conditions , and unit prices .
The project was advertised for bid in the Fort Worth Star Telegram on June 24 , 2010 and July 1,
2010. Bids were received on July 22 , 2010 , with Ace Pipe Cleaning , Inc ., being the only bidder.
M/WBE - A waiver of the goal for M/WBE subcontracting requ irements was approved by the M/WBE
office because the purchase of goods and services are from sources where subcontracting or
supplier opportunities are negligible.
This project is located CITYWIDE .
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current operating
budget , as appropriated , of the Water and Sewer Operating Fund .
