I ~Z" ~ ~"~~ ~ AN ORDINANCE ADOPTING THE CITY OF FORT WORTH ZOOS COMPREHENSIVE PLAN; ANALYZING POPULATION, ECONOMIC AND FINANCIAL TRENDS; DESCRIBING MUNICIPAL SERVICES AND FACILITIES; DESCRIBING ECONOMIC AND TECHNOLOGICAL ISSUES AFFECTING DEVELOPMENT; DESCRIBING IMPLEMENTATION TOOLS; DIVIDING THE CITY INTO 16 PLANNING SECTORS; PROVIDING MAPS DESCRIBING PROPOSED FUTURE LAND USES AND RECOMMENDED LAND USE POLICIES FOR EACH SECTOR; ESTABLISHING GOAIIS AND RECOMMENDED POLICIES; INCORPORATING THE 2005-2009 ANNEXATION PROGRAM, PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS the City Council approved Ordinance No. 15889 adopting the Fort Worth 2004 Comprehensive Plan on February 24, 2004; WHEREAS the 2004 Comprehensive Plan is the City of Fort Worth's general guide for making decisions about growth and development; WHEREAS the 2004 Comprehensive Plan includes, without limitation, provisions on land use, housing, parks and community services, libraries, human services, neighborhood capacity building, economic development, transportation, education, historic preservation, urban design, arts and culture, police services, fire and emergency services, environmental quality, public health and municipal facilities; WHEREAS it is the City Council's intent to update the Comprehensive Playa anzaually; WHEREAS after conducting a joint work session with the City Plan Commission and the Zoning Commission on August 25, 2004, and briefing the City Council on August 31, 2004, the Planning Departzaaent issued a public review dxaft of the 2005 Comprehensive Plan; WHEREAS tlae Planning Departxaaent conducted a series of 29 community meetings and held a Citywide Forum. on October 18, 2004, to receive comments on the 2005 Comprehensive Plan; WHEREAS on January 26, 2005, the City Flan Commission conducted a public hearing on the 2005 Comprehensive Plan and the 2005-2009 Annexation Program and recommended that the City Council approve the plan with five revisions: delete a goal to adjust City policies that conflict with the City's historic preservation goals, delete an objective to prepare Administrative Regulation (AR) providing for review of City-sponsored projects affecting historic resources, modify the boundary of the SH 121/FM 1187 mixed-use growth center in the Far Southwest sector to remove existing residential parcels and to follow parcel lines in response to requests by property owners, redesignate future land use along Croarnwell Street in the Southside sector firom light industrial to low density residential in response to a request by property owners, and incorporate into the 2005 Co~~prehensive Plan, as part of Appendix G, the annexation program as recommended by the Annexation Program Advisory Committee; WHEREAS the recommended 2005 Comprehensive Plan is attached hereto as Exhibit A; WHEREAS the 2005-2009 Annexation Program identifies 27 areas totaling 18 square miles within Fort Worth's extraterritorial jurisdiction that the City might wish to consider for annexation during the next five years, including: 22 enclaves within the City's water service area, two limited- purpose annexation areas to be considered for full-purpose annexation, two areas with anticipated urban development, and one mixed-use growth center; WHEREAS the 2005-2009 Annexation Program will be reviewed annually as part of the Comprehensive Plan update; WHEREAS the City Council conducted a public hearing on the 2005 Comprehensive Plan and the 2005-2009 Annexation Program on ~`ebruary 8, 2005, at which the public was given the opportunity to give testimony and present written evidence; 2 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH: ,SECTION 1. The 2005 Comprehensive Plan of the City of Fort Worth is adapted as set out in Exhibit A attached and incorporated as if captained herein, specifically including existing plans and studies described in Appendix A to the Plan which are incorporated by reference. SECTION 2. The City of Fort Worth 2005 Cainprehensive Plan supersedes and replaces the 2009 Comprehensive Plan. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ardinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such u~acanstitutionality shall nat affect any of the re~x~aining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph ar section. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: On November 30, 2004, the City Council authorized staff to release a public hearing draft of the 2005 Comprehensive Plan for public review. The 2005 Comprehensive Plan reflects the following substantive revisions to the 2004 Comprehensive Plan: Routine Updates . Incorporated the most current data available; ® Refined various goals, objectives, policies and strategies based on comments from the City Council, City departments and cooperating agencies; ® Added Lake Arlington to the list of Neighborhood Empowerment Zones in the Housing chapter; ® Added a section to the Transportation chapter an the Mobility and Air Quality Plan; ® Added a recommended strategy to the Environmental Quality chapter to determine the feasibility of an idling restriction ordinance for all vehicles; « Added programs to the Environmental Quality chapter to reduce ozone-forming pollution; . Reorganized the Financial Incentives chapter to include incentives previously covered in the Housing and Economic Development chapters and to be consistent with the City's draft incentive policy; . Added the North Greenbriar Model Block Plan and the 2004 Park, Qpen Space and Recreation Master Plan as existing plans in Appendix A; ® Updated future land use maps in Appendix C in response to land use changes, zoning and platting decisions, and other factors; and ® Removed completed or cancelled capital improvement projects in Appendix D, and added new projects to Appendices D and E. Recent Policy Decisions . Added a current policy to the Land Use chapter to support single-family residential development with compatible single-family lot sizes; to support the creation of small-lot single-family zoning districts in proximity to mixed-use growth centers, where the City seeks to concentrate employment and public services; and to support the creation of larger-lot single-family residential zoning districts in more remote IOCatianS; « Added Nance Ranch as a regional mixed-use growth center; . The City Plan Commission held a public hearing an the plan an January 26, 2005. After receiving input, the City Plan Commission voted to recommend adoption of the plan with the following five revisions: e Delete the goal to adjust City policies that conflict with the City's historic preservation goals, as this goal has been achieved; ® Delete the objective to prepare an Administrative Regulation (AR} providing for review of City-sponsored projects affecting historic resources, as this objective has been achieved; ® Modify the boundary of the SH 12111=M 1187 mixed-use growth center in the Far Southwest sector to remove existing residential parcels and to follow parcel lines in response to requests by property owners; . Redesignate fu#ure land use along Cromwell Street in the Sauthside sector from light industrial to low density residential in response to requests by property owners; and . Incorporate into the 2005 Comprehensive Plan, as part of Appendix G, the annexation program as recommended by the Annexation Program Advisory Committee. Pro ased Annexation Pro ram On September 7, 2004, the City Council adapted an updated annexation policy for the City, which provides for the formulation of a five-year annexation program. The annexatian program is to be incorporated into the Comprehensive Plan and updated annually. The annexation program identifies areas within Fart Worth's extraterritorial jurisdiction that the City might wish to consider for annexation during the next five years. The annexatian program is not legally binding. inclusion of an area in the annexation program does oat obligate the City to annex that area, nor does omission of an area from the annexation program prevent the City from annexing the area. The annexation program identifies 27 areas totaling 18 square miles to be considered for City-initiated annexation during the five-year period from 2005 through 2009. These areas include: 22 enclaves within the City's water service area, two limited-purpose annexatian areas to be considered for full-purpose annexatian, two areas with anticipated urban development and one mixed-use growth center. The City has identified capital improvements, beyond those covered by the current band program, that will be necessary to provide adequate municipal services to the potential annexation areas. The-.City involved property owners from the extraterritorial jurisdiction, as well as those from within the City, in formulating the five-year annexation program. The City conducted numerous meetings with pertinent local governments and property owners directly affected by potential annexations. At least 410 citizens participated in these meetings to ask .questions and provide comments. In addition, the City Plan Commission conducted a public hearing an January 20, 2005, to receive additional comments on the annexation program from interested citizens. The City Council held a public hearing on February 8, 2005 (M&C G-14678}, an the plan as recommended by the City Plan Commission.
