KNOWN ALL BY THESE PRESENTS:
THIRD AMENDMENT TO
CITY SECRETARY CONTRACT NO. 41383
THIS THIRD AMENDMENT to City Secretary Contract No. 41383 is entered into by and
between the City of Fort Worth ("City"), a home-rule municipality in the State of Texas,
acting through Fernando Costa, its duly authorized Assistant City Manager, and
Accutest Laboratories Gulf Coast, Inc., a Texas corporation ("Contractor''), acting
through Stephen Grant, its duly authorized Vice President.
WHEREAS , the City and Accutest Laboratories Gulf Coast, Inc . have entered into that
certa in agreement identified as City Secretary Contract No. 41383 ( also the "Contract")
commencing on January 14, 2011 for serv ices involving laboratory analytical services of
air, soil, water, sludge, sediment, tissue, and various other types of materials and media
as authorized by Mayor and Council Communication C-24592; and
WHEREAS , Mayor and Council Communication C-24592 provides for an initial contract
term of one year and provides for the extension of the terl]l of the agre"~.rnent for up to
three additional periods of one year each; and
WHEREAS, municipal contracts for services are exempt from the provisions of Chapter
252 of the Texas Local Government Code under the General Exemption provided for
procurements necessary to preserve or protect the public he'a ~th <!>r :· safety of a
munic ipality's residents ; and
WHEREAS, the parties wish to extend the term of the initial contract for an additional
year (fourth of four) and sufficient funds have been appropriated; and
WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain
the same as stated in City Secretary Contract No. 41383;
NOW, THEREFORE , for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged and confessed, the parties hereto agree as follows:

2. Compensation Not to Exceed Amount:
Compensation shall not exceed one hundred thousand dollars ($100,000.00) for the
term of this amendment, billable according to the fee schedule of City Secretary
Contract number 41383 and subject to all other terms and conditions as stated in City
Secretary Contract number 41383.
3. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract number 41383
shall remain unchanged except as expressly set forth herein.
IN WITNESS THEREOF, the parties have executed this contract in triplicate in Fort
Worth, Texas, on the dates written below.

Authorize the Execution of a Professional Services Contract with Accutest Laboratories Gulf Coast , Inc., for
Laboratory Analytical Services , Not to Exceed $100 ,000 .00 Per Contract Year
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute a profess ional services
contract not to exceed $100 ,000 .00 per contact year with Accutest Laboratories Gulf Coast , Inc ., for
laboratory analytical services .
DISCUSSION:
The Transportation and Public Works Department , Environmental Services Division requ ires a
professional services contract for the furnishing of all labor , materials and equipment necessary for
performing environmental laboratory analyses of air , soil , water and asbestos samples collected for
various projects and inspections.
The cost for the laboratory analytical serv ices will not exceed $100 ,000 .00 per contract yea r. The
proposed agreement will commence on the date the contract is fully executed and cont inue for a period of
one -year with three one-year options to renew . Renewal may be effected by written notification by the City
Manager or his designated representative to the contractor within 30 days of the expiration of the prior
term and does not require specific City Council approval , provided the City Council has appropriated
sufficient funds to satisfy the City's obligations during the renewal term .
The Environmental Services Division requested proposals for environmental laboratory analysis on July
22 , 2010 . Proposal packages were received on August 12 , 2010 from the following firms :
Accutest Laboratories Gulf Coast , Inc .
Ana-Lab Corporation
ERMI Environmental Laboratories , Inc .
Oxidor Laboratories , LLC
Southern Petroleum Laboratories , Inc .
TestAmerica Laboratories , Inc .
TraceAnalysis , Inc .
Xenco Laboratories
The proposals were evaluated and scored based on a pre -determined list of factors including cost ,
performance on EPA proficiency tests , experience , qualifications of personnel , testing capabilities , and
subcontractors . Based on the above described evaluation , staff is recommend ing the contract be awarded
to Accutest Laboratories Gulf Coast , Inc .
A waiver of the M/WBE requirements was reque st ed by the department and approved by the M/WBE

office because the purchase of services is from sources where subcontracting or supplier opportunities
are negligible . j

The Financial Management Services Director certifies that funds are available in the current operating
budget , as appropriated , of the Environmental Protection Ope rating Fund.
