Inc, an independent contractor "Consultant". City and Consultant may be referred to herein individually as a Party, or collectively as the Parties. WITNESSETH That for and in consideration of mutual covenants and agreements herein contained, the Parties hereto mutually agree as follows: ARTICLE 1 SERVICES Seciion 1. Consultant hereby agrees to perform as an independent contractor the services set forth in the Scope of Services attached hereto as Attaclunent "A": These services shall be performed in connection with Lake Country Estates Draina�e Master Plan. (66Proiect"l. Section 2. Additional services, if any, will be requested in writing by the City. City shall not pay for any work performed by Consultant or its subconsultants, subcontractors and/or suppliers that has not been ordered in writing. It is specifically agreed that Consultant shall not be compensated for any alleged additional work resulting from oral orders of any person. ARTICLE 2 COMPENSATION Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "B". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "A". However the total fee paid by the City shall not exceed a total of $279,100 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly. The Consultant shall provide monthly invoices to the City. Payment for services rendered shall be due within thirty (30) days of the uncontested performance of the ordered and receipt by City of Consultant's invoice for payment of same. particular services so , _--_-_ _- -- — -_, ;! �;�+W��=b���tL ����t�ti � CIiY �ECIiETARY ��'� WOR�'�, T� Acceptance by Consultant of said payment shall operate as and shall release the City from all claims or liabilities under this Agreement for anything related to, done, or furnished in connection with the services for which payment is made, including any act or omission of the City in connection with such services. ARTICLE 3 TERliR Unless terminated pursuant to the terms herein, this Agreement shall be for a term of twelve (12) months, beginning upon the date of its execution, or until the completion of the subject matter contemplated herein, whichever occurs first. ARTICLE 4 INDEPENDENT CONTRACTOR Consultant shall operate hereunder as an independent contractor, and not as an officer, agent, servant, or employee of the City. Consultant shall have exclusive control of and the exclusive right to control the details of its work to be performed hereunder and all persons performing same, and sha11 be solely responsible for the acts and omissions of its officers, agents, employees, contractors and subcontractors. The doctrine of respondent superior shall not apply as between City and Consultant, its officers, agents, employees, contractors, and subcontractors, and nothing herein sha11 be construed as creating a partnership or joint venture between City and Consult.a.t�t, ARTICLE 5 PROFESSIONAL COMPETENCE AND INDEMNIFICATION Section 1. Work performed by Consultant shall comply in a11 aspects with all applicable local, state and federal laws and with all applicable rules and regulations promulgated by the local, state and national boards, bureaus and agencies. Approval by the City shall not constitute or be deemed to be a release of the responsibility and liability of Consultant or its officers, agents, employees, contractors and subcontractors for the accuracy and competency of its services performed hereunder. Section 2. In accordance with Texas Local Government Code Section 271.904, the Consultant shall indemnify, hold harmless, and defend the City against liability for any damage caused by or resulting from an act of negligence, intentional tort, intellectual property infringement, or failure to pay a subcontractor or supplier committed by the Consultant or Consultant's agent, consultant under contract, or another entity over which the Consultant's exercises control. Consultant shall not commence work under this Agreement until it has obtained all insurance required under this Article and the City has approved such insurance, nor shall Consultant allow any subcontractor to commence work on its subcontract untiY all similar insurance of the subcontractor has been so obtained and approval given by the Ciiy; provided, however, Consultant may elect to add any subconsuitant as an additional insured under its liability policies. Professional Liability $1,000,000 per claim and aggregate. Professional Liability insurance may be written on an occurrence or claims- made basis. If coverage is written on a claims-made basis, the retroactive date shall be coincident with or prior to the date of the contractual agreement. The certificate of insurance shall state that the coverage is claims-made and include the retroactive date. The insurance shall be maintained for the duration of the contractual agreement, and for five (5) years following completion of the service provided under the contractual agreement, or for the warranty period, whichever is longer. An annual certificate of insurance submitted to the City shall evidence coverage. Commercial General Liability $1,000,000 each occurrence $1,000,000 aggregate Automobile Liability $1,000,000 each accident (or reasonably equivalent limits of coverage if written on a split limits basis). Coverage shall be on any vehicle used in the course of the Project. Worker's Compensation Coverage A: statutory limits Coverage B: $100,000 each accident $500,000 disease - policy limit $100,000 disease - each employee Section 2. Additional Insurance Requirements a. Except for employer's liability insurance coverage under Consultant's worker's compensation insurance policy, the City, its officers, employees and servants shall be endorsed as an additional insured on Consultant's insurance policies. Certificates of insurance shall be delivered to the Transportation and Public Works Department, Attention: Steven Eubanks, 1000 Throckmorton Street, Fort Worth, TX 76102, prior to commencement of work. c. Any failure on part of the City to request required insurance documentation shall not constitute a waiver of the insurance requirements specified herein. d. Each insurance policy shall be endorsed to provide the City a minimum thirty days notice of cancellation, non-renewal, and/or material change in policy terms or coverage. A ten days notice shall be acceptable in the event of non-payment of premium. e. Insurers must be authorized to do business in the State of Texas and have a current A.M. Best rating of A: VII or equivalent measure of fmancial strength and solvency. f. Other than worker's compensation insurance, in lieu of traditional insurance, City may consider alternative coverage or risk treatment measures through insurance pools or risk retention groups. The City must approve in writing any alternative coverage. g. Workers' compensation insurance policy(s) covering employees employed on the Project shall be endorsed with a waiver of subrogation providing rights of recovery in favor of the City. h. City shall not be responsible for the direct payment �f insttrance premium costs for Cons�alta.nt's ins�z.ra.r�ceo i. Consultant's insurance policies shall each be endorsed to provide that such insurance is primary protection and any self-funded or commercial coverage maintained by City shall not be called upon to contribute to loss recovery. j. In the course of the Agreement, Consultant sha11 report, in a timely manner, to City's officially designated contract administrator any known loss occurrence which could give rise to a liability claim or lawsuit or which could result in a property loss. k. Consultant's liability shall not be limited to the specified amounts of insurance required herein. 1. Upon the request of City, Consultant shall provide complete copies of all insurance policies required by these Agreement documents. ARTICLE 7 TRANSFER OR ASSIGNMENT City and Consultant each bind themselves, and their lawful successors and assigns, to this Agreement. Consultant, its lawful successors and assigns, shall not assign, sublet or transfer any interest in this Agreement without prior written consent of the City. Professional Services Consultant Agreement Rev 10.6.09 Page 4 of 10 ARTICLE 8 TERMINATION OF CONTRACT Section 1. City may terminate this Agreement for its convenience on 30 days' written notice. Either the City or the Consultant for cause may terminate this Agreement if either Parly fails substantially to perform through no fault of the other and does not commence correction of such nonperformance with 5 days of written notice and diligently complete the correction thereafter Section 2. If City chooses to terminate this Agreement under Article 8, upon receipt of notice of termination, Consultant shall discontinue services rendered up to the date of such termination and City shall compensate Consultant based upon calculations in Article 2 of this Agreement and E�ibit "B" attached hereto and incorporated herein. Section 3. All reports, whether partial or complete, prepared under this Agreement, including any original drawings or documents, whether furnished by the City, its officers, agents, employees, consultants, or contractors, or prepared by Consultant, shall be or become the property of the City, and shall be furnished to the City prior to or at the time such services are completed, or upon termination or expiration of this Agreement. ARTICLE 9 �GH� '�'O A�I�' (a) Consultant agrees that the City shall, until the expiration of three (3) years after final payment under this Agreement, have access to and the right to examine any directly pertinent books, documents, papers and records of Consultant involving transactions relating to this Agreement. Consultant agrees that the City shall have access during normal working hours to all necessary facilities and shall be provided adequate and appropriate workspace in order to conduct audits in compliance with the provisions of this section. City shall give Consultant reasonable advance notice of intended audits. (b) Consultant further agrees to include in all its subcontracts hereunder, a provision to the effect that the subcontracting consultant agrees that the City shall, until the expiration of three (3) years after final payment under the subcontract, have access to and the right to examine any directly pertinent books, documents, papers and records of such subconsultant, involving transactions to the subcontract, and further, that City shall have access during normal working hours to all subconsultant facilities, and shall be provided adequate and appropriate work space in order to conduct audits in compliance with the provisions of this article. City shall give Consultant and any subconsultant reasonable advance notice of intended audit. (c) Consultant and subconsultants agree to photocopy such documents as may be requested by the City. The City agrees to reimburse Consultant for the cost of copies at the rate published in the Texas Administrative Code in effect as of the time copying is performed. Professional Services Consultant Agreement Rev 10.6.09 Page 5 of 10 ARTICLE 10 MINORITY AND WOMAN BUSINESS ENTERPRISE (M/WBE) PARTICIPATION In accordance with City Ordinance No. 15530, the City has goals for the participation of minority business enterprises and woman business enterprises ("M/WBE") in City contracts. Consultant acknowledges the M/WBE goal established for this Agreement and its commitment to meet that goal. Any misrepresentation of facts (other than a negligent misrepresentation) and/or the commission of fraud by the Consultant may result in the termination of this Agreement and debarment from participating in Ciiy contracts for a period of time of not less than three (3) years. ARTICLE 11 OBSERVE AND COMPLY Consultant shall at all times observe and comply with all federal, state, and local laws and regulations and with a11 City ordinances and regulations which in any way afFect this Agreement and the work hereunder, and shall observe and comply with all orders, laws ordinances and regulations which may e�st or may be enacted later by governing bodies having jurisdiction or authority for such enactment. No plea of misunderstanding or ignorance thereof shall be considered. Consultant agrees to defend, indemnify and hold harmless City and all of its officers, agents and employees from and against a11 claims or liability arising out of the violation of any such order, law, ordinance, or regulation, whether it be by itself or its employees. �aaac�,� �2 VENiTE AND JURISDICTION If any action, whether real or asserted, at law or in equity, arises on the basis of any provision of this Agreement, venue for such action shall lie in state courts located in Tarrant County, Texas or the United States District Court for the Northern District of Texas — Fort Worth Division. This Agreement shall be construed in accordance with the laws of the State of Texas. ARTICLE 13 CONTRACT CONSTRUCTION The Parties acknowledge that each party and, if it so chooses, its counsel have reviewed and revised this Agreement and that the normal rule of construction to the effect that any ambiguities are to be resolved against the drafting party must not be employed in the interpretation of this Agreement or any amendments or e�ibits hereto. ARTICLE 14 SEVERABILITY The provisions of this Agreement are severable, and if any word, phrase, clause, sentence, paragraph, section or other part of this Agreement or the application thereof to any person or circumstance shall ever be held by any court of competent jurisdiction to be invalid or unconstitutional for any reason, the remainder of this Agreement and the application of such word, phrase, clause, sentence, paragraph, section, or other part of this Agreement to other Professional Services Consultant Agreement Rev 10.6.09 Page 6 of 10 persons or circumstances shall not be affected thereby and this Agreement sha11 be construed as if such invalid or unconstitutional portion had never been contained therein. As a result, some of the current floodplain delineations and studies may be outdated. Some streams within the City were never studied in detail. The purpose of these open channel studies is to assess the existing conditions of select open channels and to develop a master plan of improvements as needed. The existing conditions analysis includes detailed hydrologic and hydraulic analyses to determine probable flooding areas during exceedance storms and a comparison of results to existing studies (if available). The revision or development of a master plan of improvements for the study area will include a set of conceptual improvement alternatives to minimize flood impacts to homes and buildings. These studies may require the submittal of a LOMR to FEMA if the resultant flood analysis is significantly different from the current flood insurance study delineation and base flood elevations. Because of the number of studies that will be conducted, the City would like to develop a standardized approach for consistent data management and model development. The City has embarked on the development of a GIS inventory of the existing storm water management system. These studies will have data that will be relevant to the City's ongoing GIS inventory. Therefore, the submittal of GIS data to the City is required. For data management purposes, all of the reports and detailed analyses will be submitted to the City in an approved format. A standardized approach to documentation, submittals and approach will assist the City with data management of these and future studies. Task 2: Data Search. Collection, Field Reconnaissance, Stream Condition Assessment, and Survevs a. Dataset Search and Collection The City of Fort Worth will provide the Consultant with the following watershed data in GIS format, in addition to the available models and reports: stream centerlines, street centerlines, 2007 aerial imagery, 2007 terrain surFace in LAS format, existing and future land use data, 2007 subbasin delineations (may not be delineated for each site), high- water marks (if available), and zoning maps. Historical rainfall data and the as-built drawings of the hydraulic structures may be available from the City. The Consultant shall submit a written request to FEMA for all relevant available data from the effective Flood Insurance Study (FIS) including but not limited to: LOMRs, hydrologic and hydraulic data, reports, working maps, etc. The City shall determine the e�ctent of the st�dy along the �trearrt. The Consultant shall use the City-provided watershed description, stream centerline, and 2007 terrain surFace as part of the base data for modeling and mapping. If necessary, the Consultant may modify the stream centerline alignment during Tasks 3 and 4 according to topography, 2007 aerial imagery, or new survey data. Any errors identified or revisions made to the City's stream centerline and watershed boundary datasets shall be reported and discussed with the City's Project Manager. The Consultant will review and identify known flooding and drainage issues referred to as "hot spots" within the study area. The City will provide available drainage complaint reports to the Consultant. The identified "hot spots" shall be compiled into a GIS geodatabase. The City of Fort Worth's Storm Water Management Division shall assist the Consultant in locating required data available from the City, but the ultimate responsibility for identifying data needs and for finding, collecting, developing, analyzing, and creating all necessary data shall reside with the Consultant. If required data is unavailable, the Consultant shall inform the City in writing and discuss with the City's Project Manager for actions or determination. ATTACHMENT "A" Page 3 of 18 secondary control points for survey. Primary control points are typically iron rods that are suitable for future reference. Secondary control points are set at each surveyed cross-section and are intended to establish the primary control data at each cross- section. Secondary control points are typically nails and are not intended to be permanent. The current version of FEMA Guidelines and Specifications for Flood Hazard Mapping Partners Appendix N: Data Capture Guidelines shall be used a guide io setting elevation reference marks. Field surveys of stream cross-sections shall be representative of the natural ground of the channel and overbanks. Surveys of bridges, culvert, dams or other hydraulic structures shall be representative of the hydraulic structure's geometry. A typical ground cross-section shall be surveyed upstream of the structure. Measurements and survey points defining the geometry of the hydraulic structures shall all be recorded in field notes. Field survey notes shall represent graphically and clearly, in plan and profile view, what was surveyed, photographed, and recorded. All of the sketches should depict the upstream face of the structure as well as the direction of flow. Digital photos shall be taken at each surveyed stream cross-section looking upstream and looking downstream at the channel. Photos of the upstream and downstream faces of the hydraulic structures shall be taken along with the upstream and downstream channel. VVherev�r possible, the pictures should contain the entire face of th� structure. The Consultant will use the survey codes and format outlined in the FEMA Guidelines and Speci�cations for Flood Hazard Mapping Partners Appendix N: Data Capture Guidelines for survey text files. The text files shall include point number, northing, easting, elevation, and description. The Consultant shall submit the survey data as text files and in a GIS shapefile format. It is the responsibility of the Consultant to obtain property owner permission to perForm surveys outside of City easements. The Consultant shall notify the local property owners that surveys and field reconnaissance will be conducted for a certain period of time. e. Finished Floor Elevations The Consultant shall determine the finished floor elevations and lowest adjacent grades of buildings and residential homes within the current effective floodplain and anticipated revised areas. The Consultant shall meet with the City's Project Manager and discuss which buildings and homes will be surveyed prior to a final scope of work. Finished floor elevations shall be a separate budget item from the field surveys. �Consultant: Add to project task unique activities particular to study that are beyond the standard scope.] ATfACHMENT "A" Page 5 of 18 o Consultant will provide all the finished floor survey data including control, finished floor elevations lowest adjacent grade elevations and locations, GIS files, field notes, and ASCII text files. One set of CD/DVDs containing electronic versions of all information (intermediate and final data and photos) gathered in this Task. Task 3: Deveiopmeni of Detailed Fivdroioqic Niodels The Consultant shall develop detailed existing land-use conditions (and/or ultimate- development land-use conditions based on 2009 comprehensive plan if applicable) HEC-HMS models for the watershed. The City will determine if ultimate development land-use conditions are warranted for the study. The Consultant may use HEC- GeoHMS as a preprocessor to provide base information for the new hydrologic model. The hydrologic model shall be fully geo-referenced for seamless incorporation into the City's GIS inventory. The Consultant shall fully annotate the HEC-HMS model, including descriptive comments in all relevant fields, and clearly label the simulation runs with respect to the return period. The Consultant shall coordinate any occurrence of inter-basin transfer of flow with the City's Project Manager. If knowledge of inter- basin transfer of flows is known during the preparation of the scope, the Consultant shall provide details on how the hydrology and hydraulics will be modeled. The Consultant shall use the 2-, 5-, 10-, 25-, 50-, 100-, and 500-year return events to develop hydrologic and hydraulic rnodels, water surface elevation profiles, and floodplain rraapse If the ba�in i� f�lly devel�p�d then ultimate land-use condition� will be assumed as "Existing Conditions". The Consultant shall model the 100-yr return event for ultimate conditions if existing conditions in the basin are not fully developed. The Consultant shall use representative historical rainfall data to perform hydrological analysis to perForm a high water mark simulation/validation with hydraulic models. a. Rainfall The Consultant shall use a 24-hour duration storm (SCS Type II or frequency) for the meteorological model and shall use the City of Fort Worth Storm Water Management Design Manual Appendix A rainfall depth-duration-frequency tables. b. Data Sources The Consultant shall review the current effective hydrologic Letters of Map Revision (LOMRs) approved after the current City of Fort Worth land development projects and incorporate appropriate. and hydraulic models, effective FIS study and them into the study as The Consultant may obtain "as built" drawings from the City (if available) for constructed regional ponds and other large residential and commercial ponds to be modeled. The stage-storage-discharge (SSD) rating curve for these ponds used in the model shall be verified as being accurate. If necessary, the SSD curves may be re-developed. In all cases, the SSD rating curve shall be the same for both the hydrologic and hydraulic models. Routing The Consultant shall use the Modified Puls or the Muskingham-Cunge routing methods to attenuate the runoff hydrograph. Other routing methods shall require the approval of the City. The detailed summary shall include design criteria, software used, source data, watershed delineation method, watershed parameters, modeling considerations, and any special technical issues and resolutions. o A summary of results and a comparison with effective discharges. o Any relevant correspondences, discussions, and technical decisions regarding model development including review comments and special issues. • Digital Data o Hydrologic Model: One digital copy of the final, working, and fully- annotated HEC-HMS hydrologic model that provides peak flow rates for the 2-, 5-, 10-, 25-, 50-, 100-, and 500-year floods together with all supportive GIS and modeling da#a (including DSS files) for the HEC-HMS models (curren# non-be#a �lEC-HR!!� dersion at #irr�e of delidery). o GIS Data: Supportive GIS and modeling data including the vvatershed delineation, longest flow path. (If applicable) An ArcGIS 9.2 or later version of a personal geodatabase containing all final vector information developed under this task. o Support: Electronic versions of all information gathered, supporting materials and data in developing the hydrologic models, and work products created in this task, such that the models can essentially be duplicated with the backup data. • The Consultant shall submit two sets of DVDs containing electronic versions of all information gathered and work products created in this task. Task 4: Develoument of Hvdraulic Models and Floodplain Maps The Consultant will use the latest HEC-RAS model soflware to develop hydraulic models for the study. The Consultant may use HEC-GeoRAS as a preprocessor to provide base information to the hydraulic model and as a post-processor to map the floodplains. The Consultant shall fully annotate the HEC-RAS model, including descriptive comments in all relevant fields, and clearly label the flow data profiles with respect to return period. Task 7: Qualitv Assurance and Qualitv Control Procedures The Consultant shall develop a QA/QC procedure meeting or exceeding the requirements of FEMA for FEMA Digital Floodplain Insurance Rate Mapping projects. The QA/QC program shall include a multi-level approach to ensure that senior members of Consultant's staff review, comment, and approve the completed work. Quality control check lists shall be created for the survey, hydrology, hydraulics, and mapping elements of the work. Each checklist shall include milestone review events that describe the items to be reviewed and include documentation of the comments by the reviewer and responses from the Consultant's Project Manager. All project materials presented to the City as draft or final products must be accompanied by QA/QC certification or they will be rejected by the City. Work on a task shall not proceed until the milestone event has been reviewed and all necessary revisions to the data are complete. The checklists shall be signed by the senior task leader, Project Manager, and the Principal, and are included in the FINAL REPORT. The Consultant shall provide copies of their QA/QC efforts to the City of Fort Worth. The Consultant shall retain all work products generated and information gathered and used during the course of the project. Field Surveys for Neighborhood Structures and Streets: In addition to the scope of services described in Task 2d, the Consultant will perform a partial topographic survey of the study area outside the limits of the open channel studies. The purpose of this survey is to provide the Consultant with general grades, elevations, and geometry of the existing roadways and drainage facilities within the study area. This information will be used in the hydrologic and hydraulic analysis. This is not a design level survey. The intent of this partial survey is to provide the Consultant with general cross-sectional information of the existing drainage facilities in order to perform the hydrologic and hydraulic analyses. Detailed survey will need to be obtained before proceealing forward wcth fena! design of any pe-oposed ier�proverraent� or altemative designs. The limi�s of the pa�tial survey are desc�ibed in Exhibit E- 1 and will include the following: • Survey of minor and major intersections as shown in Exhibit E-3 (approximately 85) • Survey of drainage flumes and curb inlets as shown in Exhibit E-3 (approximately 100 structures) • Survey of the cross sections shown on Exhibit E-2 (approximately 90) b. Data Collection: The Consultant will collect available record drawings to assist in the hydrologic and hydraulic analyses. The Consultant will conduct up to one (1) site visit to compare the record drawings to existing conditions. The Consultant will also coordinate with other consultants who are currently working on the City's capital improvement projects to incorporate their designs into this project. c. Rational Hydrologic Analysis: The Rational Method will be used for all hydrologic analyses including, but not limited to, closed systems, flumes, and roadway capacities. The Consultant will delineate drainage areas for each design point within the limits of study. The Consultant will also conduct up to two (2) site visits to verify the drainage area EXHIBIT "A-3" Page 4 of 5 boundaries. The Consultant will meet with the City to discuss the key design points. This scope includes the Consultant evaluating the ultimate build-out conditions within the limits of study. The hydrologic analysis will be in accordance with the City's 2006 adopted drainage criteria. d. Hydraulic Analysis for Neighborhood Structures and Streets: The analyses of flumes, closed systems, and roadway cross sections will be modeled using Flowmaster and StormCAD. These systems will be modeled assuming steady state conditions. A hydraulic analysis will be performed using the 5-year and 100-year storm events and peak discharges determined in Task 9b. The Consultant will determine the capacity of each drainage structure indicated on Exhibit E-3. The Consultant will determine the street and right-of- way capacity at each location shown in Exhibit E-3. The Consultant will limit the hydraulic analysis to within the right-of-way. Localized flooding within private property will not be analyzed. e. Proposed Mitigation Alternative Analysis for Neighborhood Structures and Streets: After Task 9b and 9c are complete, the Consultant will evaluate the capacity of the drainage structures to determine if the structures need to be improved. The Consultant will discuss the evaluation with the City prior to developing alternatives to improve the structures deficiencies. As part of the evaluation, the Con�ultar�# vvi!! rediew the existing conditi�n� of the drainage �tructure9 the roadway condition, and the r�-iagnitude of the impacts associated with the deficient structure. The Consultant will recommend mitigation alternatives for up to finrenty drainage structures. Additional evaluations for deficient drainage structures will be considered additional services. Task 9 Deliverables • A summary of the hydrologic and hydraulic assumptions and methodology used in the analysis • An overall drainage area map for the hydrologic analysis. A drainage area maybe delineated for each drainage structure that is analyzed. • An exhibit showing the design points that were analyzed which may include flumes, closed system, curb inlets and roadway cross sections. • A summary of the hydrologic analysis results. The results will include a summary of the 5-year and 100-year peak flows generated for each drainage area. The 25-year peak flow may be analyzed on a case by case basis depending upon the type of drainage structure being evaluated. • A summary of the drainage structure evaluation and condition assessment. • A summary of the mitigation alternatives. • A summary of the costs associated with the mitigation alternatives. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Stormwater Utility Fund in the Amount of $279,100.00 and decreasing the unreserved, undesignated fund balance by the same amount; and 2. Authorize the City Manager to execute an Agreement with Kimley-Horn & Associates, Inc., in the amount of $279,100.00 for the Lake Country Estates Drainage Master Plan. DlSGUSSION: In order to address stream flooding and neighborhood flooding, detailed drainage studies are required to determine runoff rates and flow depth, identify flooding areas and deficiencies in current drainage facilities, to verify and correct Federal Emergency Management Agency (FEMA) Flood Insurance Rate Maps, to develop a master drainage plan consisting of proposed storm drain and channel improvements, detention and other measures to reduce building and street flooding. In November 2007, a Request for Qualifications (RFQ) was advertised for neighborhood drainage studies. Twenty-three statements of qualifications were received and Kimley-Horn & Associates, Inc., was selected to prepare the Lake Country Estates Drainage Master Plan, Storm Water Study SWS- 032, to address flooding in this neighborhood. The scope of work will include: 1) a detailed study of two unnamed tributaries; 2) preparing documents to obtain a FEMA letter of map revision; 3) identification of erosion repair and other minor projects which may be needed; and, 4) development of a watershed master plan for future improvements to further reduce stream flooding and a drainage master plan of the surrounding neighborhood in order to identify future capital improvements and to estimate project costs. Kimley-Horn & Associates, Inc., proposes to perform this study for a lump-sum fee of $279,100.00. City staff considers this fee to be fair and reasonable for the scope of services proposed, based on the size of the study area. The Stormwater Utility Fund will be used to fund this study. This project is located in COUNCIL DISTRICT 7. Kimley-Horn & Associates, Inc., is in compliance with the City's M/WBE Ordinance by committing to 22 percent M/WBE participation. The City's goal for this project is 17 percent. FISCAL INFORMATION/CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached supplemental appropriation ordinance, funds will be available in the current operating budget of the Stormwater Utility Fund.
