HomeMy WebLinkAboutContract 41469-A1i AMENDMENT No.1 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc., (ENGINEER) made and entered into City Secretary Contract No. 41469, (the CONTRACT) which was authorized by M&C C-24703 on the 25 day of January, 2011 in the amount of$ 800,750 .00; and WHEREAS, the CONTRACT involves engineering services for the following project: Deep Bed Media Filter Improvements at the Village Creek Water Reclamation Facility (VCWRF ); and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated 1 /24 /2012, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $232,000.00. 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1,032,750.00. 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. WORTH, TX ATTACHMENT A-1 TO AMENDMENT #1 FOR ENGINEERING SERVICES BETWEEN THE CITY OF FORT WORTH AND FREESE AND NICHOLS, INC. FOR ENGINEERING SERVICES FOR DESIGN OF THE VILLAGE CREEK DEEP BED MEDIA FILTERS MODIFICATIONS This amendment describes the services to be provided by ENGINEER as the ENGINEER . The following elements are added to the project Design Phase and Bid Phase Services as described in the original agreement dated January 25, 2011 and terms and conditions of that agreement apply: Additional design and bid phase services scope items are provided below . Construction Phase Services are not included and are additional services. The following design elements are added to the project for inclusion in the final design and bid phase documents : 1. Additional Filter Pilot Testing -In order to determine best fit of hydraulic throughput and water quality, and judge the impact of options for filter underdrain designs, the City has decided to augment the pilot testing protocol for Leopold and Severn Trent (Tetra) equipment to allow for additional data collection. The following elements are included: • Additional run time and pilot plant operation for the Leopold pilot plant extending the study time from 6 weeks to 13 weeks to cover more media size options including mono-media sand, anthracite and dual media configurations . • Development of a separate protocol for modification of the Severn Trent Pilot plant and testing of sand mono-media configurations at deeper media depths. This effort includes additional 9 weeks of pilot plant operation and rental of the pilot plant from Severn Trent. • Additional reporting associated with the two pilot plant facilities and data analysis. 2. New MCC Building -The existing MCC building is showing evidence of shorting and potential life/safety hazard issues and replacement is recommended . A new MCC building will be provided as a pad mounted, combination galvanized steel building/electrical enclosure . Location of the building will be in the parking area immediately west of the existing MCC. In addition, the existing 1000 kVA transformers in this area are undersized for load requirements and will need to be replaced with 1500 kVA transformers. The existing MCC will be demolished and removed upon completion of the new MCC. • Electrical: o Relocation of all electrical equipment associated with the existing MCC including Chlorine Contact Influent Gates, Service Water Pumps, Chlorine Booster SWPS and Filters Complex Motor Controls from the existing MCC to the new MCC Building. o Inclusion of VF D's for the four (4) new Service Water Pumps (referenced in Item 4 below). o The addition of the new electrical transformers in order to meet the increased electrical loads for the filter equipment. • Structural: o Concrete Foundation Design and miscellaneous structural items for the new MCC and transformers. o Miscellaneous Geotechnical Analysis and Survey. • Civil : o Modification of the parking area located west of the Service Water Pump Station for location of the new MCC Building . 3. Filter Control Building -The existing filter control building cannot be maintained in service and reconfigured without substantial long-term shutdowns of the entire filter complex. This City has requested that these shutdowns be minimized to maintain maximum filter operation during construction . To facilitate construction of the filter control system, a new filter control building is proposed to sit adjacent to the existing building. The new filter control building will al low phased construction and the existing building will be renovated to an operator work station. The new control building will be a prefabricated galvanized steel building similar in style to the MCC in Item 1 above to house the Distributed Control System. In addition the City has requested renovations to the existing filter control building to include a new HVAC system and ceiling replacement. The following elements are included : • Electrical : o Design and specifications for a new Distributed Control System (DCS) pre-fabr icated control building with new lighting and power panels, etc. o New wiring and conduit runs from the filter equipment and instrumentation to the new filter control building. • Structu ra I/ Arch itectu ra I o Concrete Foundation Design and miscellaneous structural items for the new Control Building. o New drop in tile ceiling in the existing fi lter control building. • Mechanical o New HVAC system for the existing filter control building. 4. Service Water Pump Station -Due to age and deterioration of the service water pumps and the importance of this pump station to overall plant operations and ultimate permit compliance , the City has requested that replacement of this pump station be designed as an alternate bid item to the project. Elements of the design include: • Electrical: o Provide new VFD's for the four (4) service water pumps to be incorporated into the new MCC building for the Filter Improvements (referenced in Item 2 above). • Structu ra I: o Replace existing dry pit access hatch with new water tight hatch. o Replace access platforms and ships ladders at pumps/valves with new aluminum platforms and ships ladders . o Repair cracks and spalls in the dry pit area for these pumps. • Mechanical : o Removal of the surface wash pumps and piping both inside and outside of the filter pipe gallery. o Removal and replacement of the four (4) service water pumps associated piping and valves, located in the dry pit area and connection to the existing piping immediately outside this area . • All elements shall be designed as an additive bid alternate to the project. • . . 5. Filter Pipe Gallery and Miscellaneous Filter Complex Repairs -Evaluation of the filter complex and gallery has identified additional repairs and replacements necessary for a functional and long lasting system beyond those identified in the previous study. These items include: • Electrical: o Replacement of all some ancillary equipment located in the filter gallery. These items include sumps pumps and removal of the unit heaters. o Design a remote electrical switch station for operation of the 36-inch backwash header butterfly valve at the filter gallery floor. o Provide pressure transmitters on the filter underdrains for filter pressure monitoring during backwash conditions. • Structural : o Repair leak at electrical duct bank penetration and filter backwash line penetration through pipe gallery walls. o Repair cracks and spalls in the filter gallery. Repair cracks using epoxy crack injection or expanding chemical grout repair mortar at pipe gallery interior where leakage presents concerns. o Repair loose railings and repair loose rail post bases along the filter complex. 650 LF of rail repair and 125 bases are assumed for replacement. o Demolition existing concrete protrusion at Filter Influent Channel and repair concrete surface after demolition. o Repair expansion joints between filters 7-8 and filters 14-15 by removing and replacing the existing joint filler material and installing new expansion joint and sealant. The expansion joint repair design at the Filter Influent channel and Pipe Gallery will involve removing and replacing existing joint filler and installing saturated oakum joint seal with strip and seal system. Design repair method so that influent channel and at the pipe gallery can be repaired while the influent channel and effluent flumes remain in service . 6. Plant Sewer Meter Vault No. 3 -The existing waste washwater flow meter is inoperable. The City has requested replacement of this old turbine meter with a new transit time type meter. • Electrical: o Electrical and instrumentation associated with a new flow meter and sump pumps . • Structural: o Removal of meter vault top slab and design removable grating on top of the meter vault for access. • Mechanical: o Provide a new sump pump for the vault . TIME OF COMPLETION: ENGINEER is authorized to commence work on the Project upon execution of this AGREEMENT and agrees to complete the services in accordance with the following schedule: Final Design by February 28, 2012 Bid Phase 3 months from Advertisement If ENGINEER's services are delayed through no fault of ENGINEER, ENGINEER shall be entitled to adjust contract schedule consistent with the number of days of delay. These delays may include but are not limited to delays in CITY or regulatory reviews, delays on the flow of information to be provided to ENGINEER, governmental approvals, etc. These delays may result in an adjustment to compensation as outlined on the face of this AGREEMENT and in Attachment CO . ATTACHMENT CO TO AMENDMENT #1 FOR ENGINEERING SERVICES BETWEEN THE CITY OF FORT WORTH AND FREESE AND NICHOLS, INC. FOR ENGINEERING SERVICES FOR DESIGN OF THE VILLAGE CREED DEEP BED MEDIA FILTERS MODIFICATIONS COMPENSATION COST TIMES MULTIPLIER WITH MAXIMUM FEE A. Not to Exceed: The total fee for Basic Services in Attachment SC shall be computed on the basis of the Schedule of Charges but shall not exceed Two Hundred Thirty Two Thousand Dollars ($232,000). If ENGINEER sees the Scope of Services changing so that Additional Services are needed, including but not limited to those services described as Additional Services in Attachment Al, ENGINEER will notify CITY for CITY 's approval before proceeding. Additional services shall be computed based on the Schedule of Charges. B. Schedule of Charges: Staff Member Resident Representative Salary Cost Times Multiplier of 2.12 Salary Cost Times Multiplier of 2.0 Salary Cost is defined as the cost of payroll of engineers, draftsmen, stenographers, surveymen, clerks, laborers, etc., for the time directly chargeable to the project, plus social security contributions, unemployment compensation insurance, retirement benefits, medical and insurance benefits, longevity payments, sick leave, vacation and holiday pay applicable thereto . (Salary Cost is equal to 1.632 times payroll. Th is factor is adjusted annually). Other Direct Expenses Subconsultant Expenses Large Subconsultant Expenses (COM) Actual Cost Times Multiplier of 1.10 Actual Cost Times Multiplier of 1.10 Actual Cost Times Multiplier of 1.05 Other direct expenses shall include outside printing and reproduction expense, communication expense, travel, transportation and subsistence away from the ENGINEER office and other miscellaneous expenses directly related to the work, including costs of laboratory analysis, test, and other work required to be done by independent persons other than staff members. For Resident Representative services performed by non-ENGINEER employees and CAD services performed In- house by non-ENGINEER employees where ENGINEER provides workspace and equipment to perform such services, these services will be billed at cost times a multiplier of 2.0. This markup approximates the cost to ENGINEER if an ENGINEER employee was performing the same or similar services . D ISCUSSION : On January 25 , 2011 , (M&C C-24703 ), the City Council authorized the execution of an engineering Agreement with Freese & Nichol s, Inc ., to design the Deep Bed Media Filter Improvements at the Village Creek Water Reclamation Facility (VCWRF) for a fee in the amount of $800,750.00 . Amendment No. 1 will cover additional de sign engineering items required for the completion of the project documents and increase facility efficiency including: increased pilot testing of additional under-drain manufacturer's blocks to determine the be st performance for increa sed hydraulic capacity and water quality , de sign of a new motor control center and a new filter control building based on unavail a bility of current parts and to avoid potential life/safety hazards and to maintain continuous operation and minimize long term shut downs of the existing facilitie s during construction, re habilitation of existing service water pump station and wash-water meter vault due to increased maintenance and equipment performance, additional survey and geotechnical investigation and as sociated minor design improvements. Free se and Nichols , Inc., agree s to maintain its initial M/WBE commitment of 30 percent that it made on the original Agreement and extend and maintain that same M/WBE commitment of 30 percent to thi s Amendment No . 1. Therefore , Freese and Nic hols , Inc., remains in compliance with the C ity 's M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an authorized repre sentative of it s company .
