FIRST AMENDMENT TO
CITY SECRETARY CONTRACT NO . 41972
CONTRACT FOR EMERGENCY RESPONSE SERVICES
FOR ENVIRONMENTAL HAZARDS
THIS FIRST AMENDMENT to City Secretary Contract No. 41972 (hereinafter
"Amendment") is entered into by and between the City of Fort Worth ("City"), a home-
rule municipality in the State of Texas, acting by and through Fernando Costa, its duly
authorized Assistant City Manager, and Aqua Cleaning and Environmental Services,
LLC ("Contractor"), acting through Erick D. McCallum, its duly authorized Managing
Member. City and Contractor may be referred to herein individually as a Party, or
collectively as the Parties.
WHEREAS , the City and Contractor have entered into that certain agreement identified
as City Secretary Contract No. 41972 (also the "Contract") executed on July 1, 2011 for
emergency response services for environmental hazards ; and
WHEREAS , that contract was for an initial term of one year beginning on July 1, 2011
through June 30 , 2012;
WHEREAS, that contract had a provision under Article 4 (Term) for up to three (3)
extensions in the term of the contract for one (1) year each upon mutual agreement of the
parties ;
WHEREAS , the parties in fact desire to extend the term for an additional year;
NOW WHEREFORE:
The City of Fort Worth and Aqua Cleaning and Env ironmental Services, LLC do hereby
agree to extend the term of City Secretary Contract No. 41972 for one year beginning on
July 1, 2012 through June 30, 2013.
Other than as specified in this amendment, no other changes are made to the terms and
conditions of the contract documents including the annual not-to-exceed amount of
$24 ,999 and other price terms .
