HomeMy WebLinkAboutContract 56888-A3CSC No. 56888-A3 AMENDMENT No.3 TO CITY SECRETARY CONTRACT No. 56888 WHEREAS, the City of Fort Worth (CITY) and Graham Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 56888, (the CONTRACT) which was administratively authorized on the 27th day of December, 2021 in the amount of $98,085.00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in the amount of $2,479,025.00 which was authorized by M&C 22-0518 on June 28, 2022, Amendment No. 2 in the amount of $97,360.00 which was administratively approved on April 3, 2023; and WHEREAS, the CONTRACT involves engineering services for the following project: WJ Boaz Road West Half, CPN 103299; and WHEREAS, it has become necessary to execute Amendment No. 3 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $125,124.45. (See Attached Funding Breakdown Sheet, Page -4-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $2,799,594.45. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. Boaz Road (Boat Club Road to Elkins School Road) City Project No: 103299 Contract Amendment No 3 Dear Alex: Graham Associates, Inc. is preparing this letter of proposal to perform the following tasks:. TASK 1: Graham Associates, Inc. sub —consultant for appraisals (Molas Schechter & Assoc. LLC) is asking for an additional $9,300.00 to complete the project. These were due to inspections of the property and some paperwork being done prior to stopping on parcels 12 thru 16 on the roundabout area. She is asking for additional compensation for the parcels changing in size and location per Kimley Horns review of the roundabout changes. We also added more property to Parcel 2 per Oncors recommendations and a new driveway to Parcel 34 (Montoya) which will require an updated appraisal. Parcel 37 & 38 (Dwayne Davis) were actually in the same deed but by separate tracts so we left them as two parcels. She is asking for an additional $9,300.00 for these tasks. TASK 2: Graham Associates, Inc. is proposing to hire ICF to prepare an Environmental Assessment for Boat Club Road LOSA for TxDOT. They are assuming they need to prepare documents for land use, air quality, archeological background study, community impact assessment, hazardous materials initial site assessment, historical PCR, biological resources, prime farmlands, and public involvement. TASK 3: Graham Associates, Inc. sub —consultant for right of way services is Seven Arrows. They are requesting additional funds for optional relocation services asked by them by the City of Fort Worth for four property owners. The properties are not being taken directly by the project but the proposed right of way does not allow the proper building set back requirement by the City of Fort Worth. They therefore have the option -of staying or relocating. This is a very involved process with time and effort by our subconsultant so they are requesting an additional $50,400.00 to perform this task. TASKS 1-3 are an additional $113,749.50 plus an additional 10% for Graham Associates of $11,374.95. This amount does not include condemnation hearing expenses for Molas Schechter & Assoc. LLC who requested to bill the city directly for these appraisal services for the hearings. In conclusion the maximum fee for contract amendment no. 3 would be $ 125,124.45. Boaz Road Change Order Request Dear Ms. Taylor: Thank you for the opportunity to submit a proposal to provide additional appraisal services for the project referenced above. Since the scope of the project and the time line, has changed somewhat since our initial agreement, it is necessary to amend the contract accordingly. Changes and revisions have been made which have reduced the economies of scale on this project and required additional time and increased overhead expense. It is noted that our original agreement was for all the legal descriptions to be provided prior to starting the project, please understand that by changing that time line, it has greatly impacted the economies of scale that were built into the original contract price. With regard to the current changes, my review indicates that affected parcels include the five roundabout parcels (Parcels 12,13, 14, 15 & 16) as well as multiple revisions to Parcels 37 and 3 8. These revisions necessitated multiple inspections and much starting and stopping which detracts greatly from the aforementioned economies of scale. In addition, I incurred additional time researching and correcting ownership and survey errors on Parcels 37 and 38. It is estimated that an 15 additional hours will be required to complete these parcels. As per our previous agreement, my hourly rate is $300 per hour so the total change is $4,500. In addition, it is my understanding that survey revisions have been made to two parcels for which appraisal reports have previously been completed (Parcels 2 and 34). It is estimated that these revisions and the production of new appraisals incorporating the changes, along with updated dates of value, should require 8 hours per parcel or $4,800, total for those two parcels. Please note, as per our original engagement letter, consultation, updates, pre-hearing/trial preparation, deposition, testimony, etc. regarding the assignment will be billed at $300.00 per hour, including travel time. It is was part of our initial agreement that these services are to be billed directly to the City of Fort Worth and not be contracted through Graham. It is my preference to handle the commissioners' hearings in this manner as it is not possible to estimate the number of hours that will be required. The proposed improvements would add approximately 475 feet of dedicated right turn lane on FM 1220, sidewalk or shared use path at all four corners of the FM 1220/W J Boaz Road intersection, add through and turn lanes at the westbound approach to the intersection, and install raised median in limited areas. A minor amount of addition right-of-way (ROW) and variable width slope easements are needed at the FM 1220/W J Boaz Road intersection to accommodate the proposed improvements. The intent of the project is to improve connectivity, mobility and promote safety. FM 1220 is an on -system facility owned and maintained by the Texas Department of Transportation (TxDOT); therefore, proposed improvements must comply with TxDOT's environmental rules and regulations. This proposal includes the preparation of environmental documentation in support of an anticipated Categorical Exclusion. Under this proposal, ICF shall prepare environmental documentation in accordance with the TxDOT Environmental Compliance Toolkits. ICF shall perform literature and background searches, and conduct field reconnaissance, as appropriate, to gather information and data necessary to complete the Categorical Exclusion documentation. Information and data shall be provided at an appropriate scale and described in sufficient detail for the project. Existing and proposed typical sections, plan and profile sheets, and any proposed ROW or other type of easement shall be provided by the Engineer. If the proposed action meets the criteria for a Categorical Exclusion, ICF shall prepare the following studies: 1. Land Use and Section 4(0/Section 6(f) • ICF shall document the current and projected land use and determine impacts of the proposed project improvements considering land use trends, plans, and policies within the study area. • ICF shall review the applicability of Section 4(0 of the U.S. Department of Transportation Act and Section 6(f) of the Land and Water Conservation Fund Act. 2. Air Quality: Prepare Transportation Conformity Report Form • Approved traffic shall be provided by TxDOT. It is assumed the projected Average Daily Traffic would be under 140,000. 3. Archeology: Prepare Archeological Background Study • An Archeological Background Study and supporting documentation shall be completed and submitted to the TxDOT Fort Worth District. This task includes a background review of records available at the Texas Archeological Research Laboratory (TARL), the Texas Historical Commission's (THC) online Texas Archeological Site Atlas, the TxDOT Potential Archaeological Liability Maps to determine if any previously recorded archeological sites are located in or near the project area or if potential for sites exist. The existing and proposed ROW or other type of easement shall be provided by the Engineer to determine the Area of Potential Effects (APE) for the background study. An archeological survey is not included in this scope of services. If the archeological background study recommends a survey, then it would be conducted under a separate scope and budget. 4. Prepare Community Impacts Assessment in accordance with TxDOT's guidelines. As applicable, this task shall address potential effects of the project on neighborhoods or communities, travel patterns, access, and public safety, particularly as those changes could differentially affectvarious social groups and minorities. The assessment shall also document if populations with Limited English Proficiency are located within the project area. Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal. Prepare Hazardous Materials Initial Site Assessment in accordance with TxDOT's guidelines. • A standard American Society for Testing and Materials (ASTM) data search for potential hazardous material sites within one mile of the project site shall be performed. The report shall include a map and detailed information on sites identified. In addition, a visual inspection for potential hazardous materials shall be performed within the existing and proposed ROW. The Engineer shall be notified if further investigation is necessary based on the results of the report or on -site inspection. All findings shall be summarized using TxDOT's Hazardous Materials Initial Site Assessment form. 6. Historical: Prepare Project Coordination Request Form ICF shall complete a TxDOT Historic Resources Project Coordination Request (PCR) form and submit it to the Fort Worth District for review. This PCR form would analyze the potential for the presence of historic resources in the project's APE. It is anticipated that a PCR form will be the only deliverable required for historic resource compliance for the proposed project. 7. Biology: Prepare Species Analysis Form, Species Analysis Spreadsheet, and TPWD BMP form 8. ICF shall assess impacts to prime farmland soil units. Coordination with the Natural Resources Conservation Service is not anticipated. 9. Waters of the U.S. • Services related to evaluation of waters of the U.S., including wetlands, will be provided if needed by Symonds Ecology Ltd. and under a separate agreement with the Engineer. ICF will coordinate with the Engineer to obtain and incorporate water resources information as applicable to TxDOT's environmental process. Symonds Ecology Ltd. will be responsible for addressing TxDOT comments and providing revisions as required. 10. Traffic Noise Analysis • The proposed project is not expected to meet the definition of a Type I noise project and therefore a traffic noise analysis is not anticipated. 11. Public Involvement • Services related to public involvement will be provided by the City of Fort Worth, and under a separate agreement with the Engineer. ICF will coordinate with the Engineer to obtain and incorporate public involvement information as applicable to TxDOT's environmental process. The Engineer will be responsible for addressing TxDOT comments on public involvement and providing responses and/or revisions to public involvement materials, as required. Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal. Publishing public notices, preparing media releases, providing a court reporter, or other public involvement activities are not included in this proposal. All communication with Graham Associates, Inc., TxDOT, and resource agencies will be incorporated into the project file. Assumptions This proposed scope of services is based on the following assumptions: 1. A presence/absence survey for federally endangered vertebrates is not included in this scope and cost estimate. If the results of the habitat assessments indicate that a survey(s) is necessary, or the U.S. Fish & Wildlife Service determines one or more surveys are needed, survey(s) will be accomplished under a separate scope and budget. 2. Section 7 consultations under the Endangered Species Act are not included in this scope of services. Section 7 consultation, if deemed necessary, will be accomplished under a separate scope and budget. Services related to evaluations of waters of the U.S., including wetlands, will be provided if needed by Symonds Ecology Ltd. and under a separate agreement with the Engineer. ICF will coordinate with the Engineer to obtain and incorporate water resources information as applicable to TxDOT's environmental process. Symonds Ecology Ltd. will be responsible for addressing TxDOT comments and providing revisions as required. 4. If a reconnaissance level historic resources survey report for non -archeological historic resources, intensive level survey, or other additional historic resource investigations are required, they would be done under a separate scope and budget. S. All necessary land access will be secured by Graham Associates, Inc. 6. Any mitigation plan that maybe required as a result of regulatory coordination or consultation would be done under a separate scope and budget. 7. CE documentation is expected to be adequate to meet the National Environmental Policy Act requirements for this project. If the project does not qualify as a CE, or an Environmental Assessment is deemed necessary, the additional work would be conducted under a separate scope and budget. S. This scope and budget does not include formal coordination with any regulatory agency. 9. This scope and budget does not include the preparation of a 4(0 Evaluation or the resolution of adverse effect activities or mitigation efforts for non -archeological historic resources. This scope and budget does not include rental of meeting facilities. 13. Graham Associates, Inc. shall provide the required engineering drawings and schematics for environmental studies including public involvement. A copy of the cost estimate is included as Attachment B. The fee to conduct these tasks would include a total, not -to -exceed cost of $54.049.50 and includes labor costs to be billed on a time and materials basis. At the time of initial contact, the Acquisition Provider shall provide Displacees, that are approved by the State, with a Relocation Assistance Packet consisting of the following approved TxDOT forms: • Parcel advisory services record • Certificate of eligibility • Relocation Assistance Brochure • Copy of the Relocation Assistance Program Survey along with a stamped return envelope addressed as shown below. All distributed surveys must have the ROW CSJ and parcel number pre -completed by the Relocation Agent before delivery to the Displacee. • Acquisition Provider shall provide on -going relocation assistance and advisory services to Displacees affected by the acquisition of right of way and deliver the required TxDOT forms to local ROW PD office that are signed by the Displacee. On -going advisory services include monitoring the move and any necessary relocation activities taken by the Displacee. Frequency and manner for monitoring the move must match the complexity of the relocation, however, the expectation is multiple in -person site visits, which is standard practice, and must be documented in the contact log portion of the required TxDOT forms to be submitted at close out. • Acquisition Provider shall locate, evaluate, and maintain files on comparable available housing as well as listings for non-residential properties, for the duration of the project. These files are subject to review by local ROW PD office as deemed necessary. • Acquisition Provider shall compute and submit the request for relocation housing/rental supplement to local ROW PD office on the appropriate TxDOT form with supporting photos attached for each property. • Acquisition Provider shall provide 90-day notice: www.7arrowsland.com �A SEVEN ARROWS • Deliver the 90-day notice and benefits package at the same time as the written offer to purchase is delivered. • Not deliver the 90-day notice prior to a personal interview with the Displacee during which time the Relocation Agent determines the type, needs, and eligibilities of the Displacee, or before the issuance of the initial offer. • Acquisition Provider shall provide 30-day notice to vacate once the State has possession of the property. The Displacee must be given a minimum of 90 days' notice prior to being required to vacate. • Acquisition Provider shall immediately notify local ROW PD office if the Displacee does not vacate the premises after 30-day notice expires. • Acquisition Provider shall perform a decent, safe, and sanitary (DSS) inspection of replacement housing in accordance with TxDOT policy. Acquisition Provider shall complete the appropriate TxDOT forms and submit to local ROW PD office. • Acquisition Provider shall prepare all relocation claims on appropriate forms and in accordance with TxDOT policies and procedures. • Acquisition Provider shall coordinate and monitor moves with displaced homeowners, business owners, tenants, and with moving companies in accordance with TxDOT procedures. • Relocation Agent must maintain relocation contact logs on appropriate TxDOT forms journaling all attempted and completed contacts with all parties, including descriptions of the reasons and outcome for each contact. Copies of all Displacees' emails with date and time sent must be captured in the Acquisition Provider's relocation contact logs. • Relocation Agent must: • Attend closings on replacement property and ensure supplemental payment is properly distributed. • Process and compute increased interest payments as required. • Be available for any relocation appeals and meetings. • Prepare all relocation payment claim submissions for all Displacees in accordance with TxDOT guidelines. • Deliver warrants in accordance with TxDOT guidelines. • Issue Relocation Assistance Program Surveys to all Displacees • Acquisition Provider shall provide an executed certification of eligibility with all Displacee claims. • The local ROW PD office must approve the timing and content of any notice to a Displacee concerning relocations prior to the Acquisition Provider sending the notice. On June 28, 2022, Mayor and Council Communication (M&C) 22-0518 authorized Amendment No. 1 in the amount of $2,479,025.00 for the preparation of plans, specifications and estimates for the roadway widening from a 2-lane road to a 4-lane thoroughfare from Boat Club Road to Elkins School Road. The contract was subsequently revised by Amendment No. 2, which was administratively approved for $97,360.00, to add franchise utility relocations services. Amendment No. 3 will provide additional compensation to the consultant for the revision of four (4) appraisals due to the revision of the plans which required additional right-of-way to accommodate a roundabout. Also, three (3) appraisals were revised to include additional driveways which were part of the right-of-way negotiations with the property owners. The amendment also includes additional compensation for an Environmental Assessment needed to obtain a Local On -System Agreement (LOSA) permit from the Texas Department of Transportation.
