C-26912 WHEREAS , the City of Fort Worth ("City") and Hillwood Residential Services . ("Deve loper") entered into a Community Facilities Agreement, City Secretary Contract No. 42295 ("Agreement"); and WHEREAS , Amendment No . 1 to the Agreement has been executed as City Secretary Contract No. 4-z,1.f S-,.4, ; and WHEREAS , it has become necessary to execute Amendment No. 2 to the Agreement to add City participation in an amount up to $68,653 for the City 's portion of additional water costs associated with the North Beach Street from Ke ll er-Hicks Road to Go lden Triangle Boulevard contemplated by the Agreement; and WHEREAS, the C ity Council authorized execution of this Amendment No. 2 on the 12th day of August, 2014 via M&C C -26912 . NOW THEREFORE, City and Developer, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Agreement 's Cost Summary Table shown be low and provides a Revised Cost Summary Table. 1. The City's participation estimate shall be based upon unit price s contained in the City of Fort Worth Ordinance No . 21210. DISCUSSION: This Amendment No. 2 to the Agreement is necessary to increase the City participation for water and sanitary sewer facilities by the amount of $68 ,653 .00 . The increase for this Amendment breaks down as follows: water construction cost ($60 ,503 .00), water inspection and material testing fee ($6 ,131 .00) and sewer inspection and material testing fee ($2 ,019 .00), for the total amount of $68 ,653 .00 as shown on the following rev ised water and sewer cost estimate table : A. Sewer Inspection and Material Testing Fees $ $ 2 ,019 .00 $ $ 2 ,019.00 Water and Sewer Fees Subtotal $ $ 8 ,150 .00 $ $ 8 ,150.00 Total Water and Sewer Project Cost $ $ 68,653.00 $ $68,653.00 History: On June 14, 2011 , Mayor and Council Communication (M&C C-2497 1) t he City Council authorized the execution of an Infrastructure Construction Agreement with Hillwood Residential Services , L.P ., wi t h City participation in an amount not to exceed $6 ,400 ,000 .00 utilizing 2008 Capital Improvement Program (CIP) funds and 2007 Cert ificates of Obligation for the design and construction of Keller-Hicks Road as a four lane undivided minor arterial street and for the des ign and construction of North Beach M&t ~-e v iew -~ Street from Keller-Hicks Road to Golden Triangle Boulevard as a four lane divided arterial street. (The actual executed Agreement was a Community Facilities Agreement.) This original amount contained a contingency in the amount of $146 ,295 .66 . On August 14, 2012 , Mayor and Council Communication (M&C C-25782) the City Council authorized the execution of Amendment No. 1 to the Agreement for the addition of water and sewer improvements along North Beach Street from Keller-Hicks Road to Golden Triangle Boulevard and along Keller-Hicks Road from Alta Vista Boulevard 1,000 feet to the east with funds from the Water Department in the amount of $283 ,972 .00 and TPW Department contributing $84 ,553 .00 from its original project contingency for a total amount of City participation for the water and sewer component of $368 ,525 .00 for a revised City participation amount of $6,752 ,625 .00 . This project is located in COUNCIL DISTRICT 7 .
