CITY SECRETARY CONTRACT 15705
WHEREAS, on the 2nd day of June, 1987, the City of Fort Worth, hereinafter
referred to as "Fort Worth"; the City of Blue Mound, hereinafter referred to as
"Customer"; and the Saginaw Park Utility Company, Inc., hereinafter referred to as
"Corporation", entered into an agreement, same being City of Fort Worth City Secretary
Contract No. 15705, whereby Fort Worth agreed to provide wastewater service to
Customer and Corporation; and
WHEREAS, on the 2nd day of July, 1991, the parties hereto entered into an
amendment to Fort Worth City Secretary Contract No. 15705, such amendment being
known as Fort Worth City Secretary Contract No. 18585; and
WHEREAS, the parties hereto desire to amend Fort Worth City Secretary
Contract No. 15705, as amended by Fort Worth City Secretary Contract No. 18585.
NOW, THEREFORE, Fort Worth, Customer and Corporation hereby agree as
follows:

Subsection 7.8 of Section 7 of Fort Worth City Secretary Contract No. 15705, as
amended, is hereby amended to be and read as follows:
7.8 Fort Worth shall obtain samples three (3) times per year to determine the
quality of the wastewater for the purpose of billing for the strength of the
wastewater. These samples shall be obtained at the metering and sampling
facilities or such other agreed upon sampling points. To determine the quality of
the wastewater, Fort Worth shall collect twenty-four (24) hour flow -weighted
composite samples for a period of five (5) consecutive days. In the event of a
malfunction of the sampling equipment for whatever reason for one or more,
additional days shall be added to obtain a total of five (5) samples. Fort Worth
will provide Customer and Corporation with a minimum of seven (7) days
advance notice of intent to sample, or such notification as is sufficient to allow
Customer and Corporation to arrange the services of a qualified laboratory. If, at
the request of Customer, Corporation or the Director, more extensive monitoring
is desired, such additional monitoring shall be paid for by the party making the
request and shall be done in compliance with Section 7. If Customer or
Corporation requests such additional monitoring, Fort Worth shall invoice the
requesting party and payment shall be made within ten (10) days after receipt of
invoice.
The notification required in this section shall include the planned dates,
times, and location(s) of sampling. Fort Worth shall analyze the samples
collected in accordance with standard methods. Customer and/or Corporation
may be present during the initial setup of sampling equipment and at the time of
pick up for each twenty-four (24) hour composite sample. Fort Worth agrees, if
requested, to split said wastewater samples with Customer or Corporation.

All other terms and conditions of Fort Worth City Secretary Contract No. 15705,
as amended, not amended hereby are unaffected and continue in full force and effect.

SUBJECT I AMENDMENT TO WHOLESALE WASTEWATER CONTRACTS
RECOMMENDATION:

It is recommended that the City Council authorize the City Manager to execute an amendment
to contracts with Wholesale Wastewater Customers to change the frequency of wastewater
strength sampling.
DISCUSSION:
The uniform wastewater contracts signed in 1987 provided that the number of BOD/TSS
strength sampling events per customer was dependent upon the volume of flows contributed to
the system by each individual customer. Some customers were sampled once a year, some
customers were sampled twice a year, while the very largest customers were sampled three
times a year. The recommended amendment provides for three sampling events per customer.
Wholesale wastewater bills are calculated using the strengths obtained by each sampling event.
Sampling each customer three times a year will provide billing information that is representative
of seasonal and weather related changes for each wholesale wastewater customer and allow
for billing changes to occur more frequently.
The Wholesale Wastewater Advisory Committee voted to recommend this contract amendment;
however, such vote is not binding on the individual customer. Staff recommends that the
Wholesale Wastewater contracts be amended with those customers choosing to execute the
amendment.
FISCAL INFORMATION/CERTIFICATION:
The Director of Fiscal Services certifies that this amendment will have no material effect on City
funds.
