AMENDMENT No . 5
TO CITY SECRETARY CONTRACT No. 50018
WHEREAS, the City of Fort Worth (CITY) and CH2M Hill Engineers,
Inc, (ENGINEER) made and entered into City Secretary Contract No. 50018,
(the CONTRACT) which was authorized by M&C C-28475 on the 14th day of
November, 2017 in the amount of $282,822.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No.
1 in the amount of $77,296.00, administratively authorized on
September 4, 2018, Amendment No. 2 in the amount of $245,461.00
which was authorized by M&C C-29039 on February 12, 2019, Amendment
No. 3 in the amount of $539,620.00 which was authorized by M&C
20-0463 on June 23, 2020, Amendment No 4 in the amount of
$50,000.00 administratively authorized on October 16, 2023; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Village Creek Biosolids Management and Beneficial Reuse Facility
Project Owner On -Site Representation; and
WHEREAS, it has become necessary to execute Amendment No. 5 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated October 6, 2023, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional engineering services to be performed by Engineer
totals $54,144.00.
2.
Article II of the CONTRACT is amended to provide for an increase
in the fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City
for all work and services shall be an amount of $1,249,343.00.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

SCOPE OF SERVICES FOR
VILLAGE CREEK BIOSOLIDS MANAGEMENT AND BENEFICIAL REUSE FACILITY

AMENDMENT 5
The scope set forth herein defines the work to be performed by the ENGINEER in completing Amendment 5
related to the Village Creek Biosolids Management and Beneficial Reuse Facility Project (Project). Both the
CITY and ENGINEER have worked to clearly define the work to be performed and address the needs of the
Project.
WORK TO BE PERFORMED
The purpose of this Amendment 5 is for the ENGINEER to perform additional services to support the City's
Project: Village Creek Biosolids Management and Beneficial Reuse Facility Project Owner On -Site
Representation, specifically to assist with sludge quality testing and evaluation at the City's sludge storage
lagoons.
Specific work tasks are as follows:

7. Pond Sampling
ENGINEER shall develop a plan to sample and test solids from sludge ponds at the Village Creek Biosolids and
Beneficial Reuse facilities, currently operated by Synagro for the City. The samples will be pulled from the ponds
based on the developed sample plan after incorporating input from the City and Synagro.
Samples will be taken from the North and South Lagoons, and 5 MG tank overflow pond, over a maximum of 3
days.. Anticipated sample locations and quantities are estimated as follows:
• South Pond: 10 locations within the pond, from 2 elevations per location for a total of 20 samples.
• North Pond: 16 locations within the pond, from 2 elevations per location for a total of 32 samples
• Overflow Pond: 3 sample locations, one grab sample per location.
ENGINEER will be onsite during the sampling and will work with the City's contractor that will be providing and
operating an excavator from the shoreline that will be used to perform the sampling of the north and south

ponds. ENGINEER will not provide or operate equipment. ENGINEER will perform the collection of samples from
the excavator bucket and assist the City in transport of the samples to the lab facility that will be selected by and
contracted to the City. The lab will test for solids content and molybdenum content of the samples. The City will
provide all sampling bottles. ENGINEER will receive test results from the City and summarize the results in a
Technical Memorandum (TM)that will be presented to the City.
Jacobs will be responsible for the safety practices of Jacobs staff but is not responsible for the safety practices of
the excavator operator, City, or any non -Jacobs personnel.
The anticipated schedule is as follows:
• NTP (based on confirmation from City of excavator/sampling date) to field sampling: 5 calendar days
• Field sampling to receipt of lab data (by City): 7 calendar days
• Lab data to Draft TM: 7 calendar days
• Receipt of City comments (including any Synagro input) to Final TM: 7 calendar days.
Followup meetings will be provided as requested. A budget of 10 hours for each of three staff has been allocated.
ENGINEER shall also manage the team to promote efficient and effective use of ENGINEER's time and resources.
ENGINEER shall manage change, communicate effectively, coordinate internally and externally, and proactively
address issues with the CITY's Project Manager and others as necessary to make progress on the work.

Contribution to Fiscal Years 2024-2028 Capital Improvement Program
RECOMMENDATION:
It is recommended that the City
1. Authorize the execution of Amendment No. 5 to City Secretary Contract No. 50018, an Engineering Agreement with CH2M Hill Engineers,
Inc. in the amount of $54,144.00, for a revised contract amount of $1,249,343.00, for the Village Creek Biosolids Management and
Beneficial Reuse Facility project (City Project No. 101961); and
2. Adopt the attached appropriation ordinance adjusting estimated receipts and appropriations in Water & Sewer Capital Project 2019 Fund
by increasing estimated receipts and appropriations in the Village Creek Water Reclamation Facility Biosolids Management and
Reuse project (City Project No. 101961) in the amount of $54,144.00 and decreasing estimated receipts and appropriations in the
Unspecified -All Funds project (City Project No. UNSPEC) by the same amount for the purpose of funding Village Creek Water Reclamation
Facility Biosolids Management and Reuse project (City Project No. 101961) and effect a portion of Water's contribution to the Fiscal Years
2024-2028 Capital Improvement Program.
DISCUSSION:
On November 14, 2017 (Mayor and Council Communication (M&C) C-28475), the City Council authorized an Engineering Agreement in the
amount of $282,822.00 with CH2M Hill Engineers, Inc., for the Village Creek Biosolids Management and Beneficial Reuse Facility project. The
agreement was subsequently revised by Amendment No. 1, in the amount of $77,296.00, administratively authorized September 4, 2018, that
provided for additional wastewater solids process modeling work, long-term growth projections and additional alternatives analysis, as well as the
preparation of an engineering feasibility report submitted to the Texas Water Development Board (TWDB) as part of a Clean Water State
Revolving Fund (CWSRF) Loan application. Amendment No. 2, in the amount of $245,461.00, authorized February 12, 2019 (M&C C-29039) that
provided for the development of a the Request for Qualifications (RFQ) and Request for Proposals (RFP) as part of the procurement process for a
design -build -operate contract for biosolids management project and responding to requests for information (RFIs) during the procurement
process, for providing technical analysis and recommendations during the evaluation of vendor submittals and during the negotiation of the
agreement. Amendment No. 3 authorized June 23, 2020 (M&C 20-0463) in the amount of $539,620.00 that provided for inspection, testing, and
construction administration for the biosolids dryer facility and Amendment No. 4, in the amount of $50,000.00, administratively authorized October
12, 2023, provided for claims review and technical assistance.
Amendment No. 5 provides for of the necessary services to develop sludge lagoon residuals field sampling, testing, and quality assurance plan for
the facility site. This work is necessary to determine appropriate disposal methods for accumulated residuals located in the two sludge lagoons at
the Village Creek Biosolids Management and Beneficial Reuse Facility.

Funding is available for appropriations in the Unspecified -All Funds project within the WS Capital Project 2019 Fund for the purpose of funding
the Village Creek Water Reclamation Facility Biosolids Management & Reuse project.
This project serves the entire City and is located in COUNCIL DISTRICT 5.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Unspecified -All Funds project within the WS Capital Project 2019 Fund
and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the WS Capital
Project 2019 Fund for the VCWRF Biosolids Mgmt & Reuse project to support the above recommendations and execution of the contract. Prior to
any expenditure being incurred, the Water Department has the responsibility to validate the availability of funds.
