These failures were not repaired/noticed prior to the resurfacing being conducted. Additional message boards are being added as they were required for the lane closures and notification to the traveling public of the work and were not included in CO #4. Time is being added to cover the time from the end of the contract time to when the failures and warranty work were completed. Here is a breakdown of the additional 322 days needed to be added to the contract time: (1) TDLR Inspection (44 days): Original contract work that was completed on 1118/2023. TDLR Inspection was conducted, and a correction report was received on 3/17/2023. (2) Final Inspection (82 days) CFW conducted the Final Inspection on 6107/2023. During the final inspection, pavement base failures were noted, and discussions were started with the contractor to determine the causes of the failure. (3) Pavement Core and more testing (72 days): The City hired a geotechnical consultant to take cores and provide results. On 8/1812023, pavement cores were performed by the testing lab to determine the type of failures and determine the repair to be included in CO #4. (4) Approval of CO#4 (67 days): Several meetings took place to determine how to pay for the needed repair on the recently paved streets. CO#4 was completed on 10/2412023. (5) Complete Punchlist (57 days): The contractor had a delayed start due to the Parade of Lights and Thanksgiving Holiday and not impacting traffic during that period. The contractor began repairs after Thanksgiving and completed all repairs, including pavement markings, on 12/20/2023. It is understood and agreed that the acceptance of this Change Order by the contractor constitutes an accord and satisfaction and represents payment in full (both time and money) for all costs arising out of, or incidental to, the above Change Order.
