HomeMy WebLinkAboutOrdinance 26689-01-2024 Ordinance No.26689-01-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER IMPACT FEE FUND IN THE AMOUNT OF $1,044,827.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF TRANSFERRING FUNDS FROM THE WATER/WASTEWATER WHOLESALE IMPACT FEES AND WATERIWASTEWATER RETAIL IMPACT FEE PROJECTS (CITY PROJECT NOS. B20004 AND B20005) TO THE WESTSIDE WATER TREATMENT PLANT PLATE SETTLER EXPANSION PROJECT(CITY PROJECT 102052); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water Impact Fee Fund in the amount of$1,044,827.00,from available funds,for the purpose of transferring funds from the Water/Wastewater Wholesale Impact Fees and Water/Wastewater Retail Impact Fee projects(City Project Nos. B20004 and B20005)to the Westside Water Treatment Plant Plate Settler Expansion project (City Project 102052). SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. {� That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize execution of Amendment No.4 to City Secretary Contract No.52517 in the amount of$904,827.00,an engineering agreement with CDM Smith,Inc.for construction support services for Westside Water Treatment Plant Plate Settler Expansion project for a revised contract amount of$1,436,115.00; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water impact Fee Fund in the amount of$1,044,827,00 from available funds for the purpose of transferring funds from the Water/Wastewater Wholesale Impact Fees and Water/Wastewater Retail Impact Fee projects(City Project Nos,820004 and 820005)to the Westside Water Treatment Plant Plate Settler Expansion project(City Project 102052);and 3. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Wafer Impact Fee Fund in the amount of $1,044,827.00 transferred from within the Water Impact Fee Fund to the Westside Water Treatment Plant Plate Settler Expansion project (City Project No. 102052)and; 4. Effect a portion of Waters contribution to the Fiscal Years 2024-2028 Capital Improvement Program. DISCUSSION: On June 25,2019,Mayor and Council Communication(M&C C-29181)authorized an engineering agreement with CDM Smith,Inc.,(City Secretary Contract No.52517),in the amount of$192,600.00 for the Westside Water Treatment Plant(WSWTP)Plate Settler Expansion project. The agreement was subsequently revised by Amendment No. 1 in the amount of$97,448.00,administratively authorized May 29,2020,that provided additional design for the replacement of the raw waterflow meter,the addition of filter No.5,the addition of membrane feed pump No.5 and relocating the finished water sample point,Amendment No.2 in the amount of$141,740.00,authorized August 3,2021 (M&C 21-0540)that primarily provided construction support services for construction of Part 1 of the project consisting of shop drawings and submittals reviews, change order review,record drawings and update plant operational manual and Amendment No.3 in the amount of$99,500.00 administratively authorized November 2,2022 that provided for additional construction services on the project. Amendment No.4 provides for the following:Preparation of a formal request to the Texas Commission on Environmental Quality(TCEQ)for an increase in the approved WSWTP rated design capacity from 18 MGD to 20 MGD and design and construction phase services for expanding tt WSWTP capacity from the re-rated capacity of 20 MGD to 24 MGD.The proposed expansion will require modifications to the existing operatior and processes of the treatment plant. In addition to the contract cost,$140,000.00 is required for project management and material testing.This project will have no impact on the WE Department operating budget when complete. It is the practice of the Water Department to appropriate its CIP plan throughout the Fiscal Year,instead of within the annual budget ordinance,< projects commence,additional funding needs are identified,and to comply with bond covenants.The actions in the M&C will amend the City of Fort Worth's Fiscal Year 2024-2028 Capital Improvement Program as follows: 60WSWTPPSETA4-CDM Capita! Funding is available in the WNWV Wholesale Impact Fees and WNVW Retail Impact Fees projects within the Water Impact Fee Fund for the purpose of funding Westside Water Treatment Plant Plate Settler Expansion project within the Water Impact Fee Fund. CDM Smith,Inc.agrees to maintain its initial M1WBE commitment of 10 percent that it made on the original agreement and extend and maintain that same MNWBE commitment of 10 percent to all prior amendments up to and inclusive of this Amendment No.4.Therefore CDM Smith,Inc. remains in compliance with the City's MNWBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous MNWBE Commitment form executed by an authorized representative of its company. The project is located in COUNCIL DISTRICT 3. FISCAL INFORMATION 1 CERTIFICATION: The Director of Finance certifies that funds are currently available in the WNNN Wholesale Impact Fees and WMNV Retail Impact Fees projects within the Water Impact Fee Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances,funds will be available in the Water Impact Fee Fund for the Westside WTP Plate Settlers project to support the above recommendations and execution of the amendment to the agreement.Prior to an expenditure being incurred,the Water Department has the responsibility of verifying the availability of funds.
