§ Renewal and Amendment of Interlocal AgreemenT ourt

COUNTY OF TARRANT § Project: Summer Creek/McPherson Extension
BACKGROUND
1. Tarrant County ("COUNTY' and the City of Fort Worth ("CITY' entered
into an Agreement approved by Tarrant County Commissioners Court
Order No. 113018, for the cooperative funding of improvements to
Summer Creek Drive and McPherson Road ("Project' as described in the
2006 Tarrant County Bond Program.
2. The Project is not complete and the COUNTY and the CITY desire to
renew the Agreement for the 2014 Fiscal Year.
Therefore, the COUNTY and CITY agree to the following
1. The COUNTY and the CITY renew the Agreement for the COUNTY's 2014
Fiscal Year with the Agreement to expire September 30, 2014 or the
completion of the Project as determined by the COUNTY, whichever
occurs sooner.
2. The COUNTY and CITY agree to the revised payment schedules.
3. Section II of Agreement is amended as follows:
The services to be provided by the CITY include, but are not limited to,
the following:
A. All as -built total project costs including all construction cost, right-of-
way acquisition, planning, engineering, surveying and governmental
approval cost (collectively referred to as "Costs'.
� B. Construction agreement administration, site review, permitting and

3 D. A monthly progress report documenting the percent complete for each
major component of the project shall be provided to the COUNTY;
E. CITY will notify the COUNTY on completion of the project; and
N F. CITY will include the following language on all on -site public notice
signage:
"This project is funded by the City of Fort Worth and the Tarrant County
Commissioners Court through the 2006 Tarrant County Bond Program"

* COUNTY payments by completed phase are contingent upon the COUNTY'S
reasonable determination that the work regarding the project phase for which payment
is expected is successfully completed, as determined by the COUNTY. COUNTY
plans to issue debt for all phases of this project, therefore payment remains contingent
on debt issuance in accordance with applicable law.
Once Construction commences, COUNTY payment shall be made by fiscal quarter
prorated over the life of the construction but contingent upon reasonable progress in
construction as may be determined by the COUNTY.

CONSENT HEARING:
SUBJECT: Authorize Renewal of Five Interlocal Agreements with Tarrant County for the Construction
Costs to Realign Harley Avenue Between University Drive and Montgomery Street in a
Revised Amount of $3,213,653.50, for the Construction of Summer Creek Drive in the
Amount of $500,000.00, for Reconstruction of East Rosedale Street from US 287, West of
Miller Avenue in the Amount of $7,994,000.00, for the Reconstruction of East Rosedale
Street Near the Texas Wesleyan Campus in the Amount of $375,000.00, and for
Improvements to Ten Traffic Signals Along State Highway 183 in the Amount of
$108,000.00 (COUNCIL DISTRICTS 4, 6, 7, 8, and 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the construction
project to realign Harley Avenue between University Drive and Montgomery Street, City Secretary
Contract No. 41877 in a revised amount of $3,213,653.50;
2. Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the construction
of Summer Creek Drive, City Secretary Contract No. 43321 in the amount of $500,000.00.
3. Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the
reconstruction of East Rosedale Street from US 287 to west of Miller Avenue, City Secretary Contract
No. 44514 in the amount of $7,994,000.00;
4. Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the
reconstruction of East Rosedale Street near the Texas Wesleyan Campus, City Secretary Contract
No. 44513 in the amount of $375,000.00; and
5. Authorize the renewal of the Interlocal Agreement with Tarrant County, Texas for the
improvements to ten traffic signals along State Highway 183, City Secretary Contract 44498 in the
amount of $108,000.00.
DISCUSSION:
The renewal of these Interlocal Agreements are required to maintain Tarrant County's funding
obligation in the new Fiscal Year.
HARLEY AVENUE
On March 22, 2011, the City Council authorized (MSC C-24801), City Secretary Contract No. 41877,
an Interlocal Agreement with Tarrant County for County funding participation in an amount not to
exceed $4,500,000.00 for construction. This value of $4,500,000.00 was based on an as -built cost
estimate before advertisement for construction.
In 2012, Staff revised the project cost based on construction bids; the revised Tarrant County funding
participation for construction of Harley Avenue is $3,213,653.50. The City will own and maintain the
roadway after construction is complete. This renewal adjusts the amount and timing of the payments
to better coincide with actual project delivery.

On April 17, 2012, the City Council authorized (M&C C-25564), City Secretary Contract No. 43321,
an Interlocal Agreement with Tarrant County for cost participation, and accepted Tarrant County's
contribution in the amount of $500,000.00 to partner in funding the project. This renewal adjusts the
timing of the payments to better coincide with actual project delivery.
RECONSTRUCTION OF EAST ROSEDALE STREET
On September 25, 2012, the City Council authorized (M&C C-25881), City Secretary Contract No.
44514, an Interlocal Agreement with Tarrant County for County funding participation in an amount not
to exceed $7,994,000.00 for the reconstruction of East Rosedale from US 287 to west of Miller
Avenue. This renewal makes no adjustments to the original Agreement.
RECONSTRUCTION OF EAST ROSEDALE STREET — TWU CAMPUS
On September 25, 2012, the City Council authorized (M&C C-25866), City Secretary Contract No.
44513, an Interlocal Agreement with Tarrant County for County funding participation in an amount not
to exceed $375,000.00 for the reconstruction of East Rosedale Street from Nashville Avenue to
Collard Street. This renewal adjusts the timing of payments to coincide with actual project delivery.
IMPROVEMENT TO TRAFFIC SIGNALS ON SH 183
On September 14, 2010, the City Council authorized (M&C G-17050), City Secretary Contract No.
44498, an Interlocal Agreement with Tarrant County for the County funding participation in an amount
not to exceed $108,000.00 for traffic signal improvements on SH-183. This renewal makes no
adjustments but keeps the Agreement current.
These projects are located in COUNCIL DISTRICTS 4, 6, 7, 8, and 9, Mapsco 56M, 74W, 75H, 76E,
77L, 78K, 78M, 102E, and 102R.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that this action will not increase the total
appropriations of City Funds.
