HomeMy WebLinkAboutContract 39252-A2AMENDMENT NO. 2 STATE OF TEXAS 6 CITY SECRETARY CONTRACT NO._301asa^q,�, COUNTY OF TARRANT 6 WHEREAS, the City of Fort Worth (City) and Jacobs Engineering Group Inc., (Engineer) made and entered into City Secretary Contract No. 39252, (the Contract) which was authorized by the City Council by M&C C- 23735 on the 18th day of August 2009 and amended by City Secretary Contract No. 39252-Al on the 18th day of May 2010; and WHEREAS, the Contract involves engineering services for the following project: Engineering Services for the Design of Alliance Airport Runway Extension Project, Phase VIII, Project No. 00960 WHEREAS, it has become necessary to execute Amendment No. 2 0 said Contract to change scope of work in order to allow Engineer to provide professional services for a Phase I Environmental Site Assessment for each parcel of land acquired for BNSF main line Right-o- Way; i NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I, of the Contract is amended to include the additional engineering services specified in a proposal letter dated April 27, 2010, copies of which are both attached hereto and incorporated herein. The cost to the City for the additional services to be performed by Engineer total $49,708.63. 2. Article II of the Contract is amended to provide for an increase in the fee to be paid to ENGINEER for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $1,843,918.22. 06-21-10 PO4:54 IN OFFICIAL RECORD CITY SECRETARY FT. This section of BNSF railway realignment track is located to the west of an existing track alignment in northern Tarrant County and southern Denton County. This new alignment is approximately 11.55 miles in length and requires acquisition of additional land. The Phase I is to be developed for both the City of Fort Worth (CFW) and the BNSF Railway. The primary purpose of this Phase I is to conduct an environmental site assessment of parcels of commercial real estate with respect to satisfying one of the requirements to qualify for the innocent landowner, contiguous property owner, or bona fide prospective purchaser limitation of CERCLA liability and "All Appropriate Inquiry" (AAI). It is TranSystems' understanding that the land will be acquired initially by the CFW and at a later date be transferred to BNSF. As a result of this time delay, an addendum to the report is to be developed to discover and update any potential visual or Standard Environmental Record Source changes. 2.0 Scope of Services Phase I A Phase I Environmental Site Assessment will be developed in accordance with ASTM Standard E 1527- 05, Standard for Environmental site Assessments: Phase I Environmental Site Assessment Process. The PHASE I Environmental Site Assessment is to identify recognized environmental conditions in connection with the property and shall have four major components. • Records Review • Site Reconnaissance • Interviews (property owners and occupiers, and government officials), and • Report and Evaluation The draft report will be reviewed by both the CFW and the BNSF Railway. A statement will be included in the report that the report is for both the CFW and BNSF_ BNSF Addendum An Addendum to original report is to be developed within 60 days of property transfer to BNSF to update visual and ASTM/AAI Database of original report. This Phase 1 Environmental Site Assessment BNSF Addendum will be developed in accordance with ASTM Standard E 1527-05, Standard for Environmental site Assessments: Phase I Environmental Site Assessment Process for updating . A statement will be included in the addendum to reflect it is developed for both the CFW and BNSF. The draft report will be reviewed by both the CFW and the BNSF Railway (BNSF). 3.0 Fees Scope of services Based on the scope of services outlined above, discussions with Jacobs Engineering, Brad Penn and Dr. Ernest Crosby, TranSystems offers the following fee proposal. The chain of title and environmental liens are to be obtained for only those properties located west of the original railway track alignment on which additional ROW is to be acquired. It is presently estimated that there are 27 such properties. If the chain of title search revels more properties are impacted or that some of the properties in history area split and require additional property searches, then additional chain of title searches required will be billed a $275 per search. Mileage will be billed at Current IRS rates. 4.0 Schedules TranSystems will deliver the Phase I within 60 working days of the authorization to proceed and will coordinate with the CFW for site visits. CFW will coordinate and arrange for site access for site visits with property owners. TranSystems will deliver the Phase I Addendum after the initial Phase I is finished and within 15 working days after receiving authorization from both CFW and BNSF to proceed with the Addendum, in order to facilitate the 60 day BNSF requirement for closing. Tran 5.0 Deliverables TranSystems will provide five copies of the initial Phase I report, including necessary drawings and photographs.
