(Engineer) made and entered into City Secretary Contract No. 39252, (the Contract) which was authorized by the City Council by M&C C-23944 on the 8th day of December 2009 and amended by City Secretary Contract No. 39252-A1 on the 181" day of May, 2010; and WHEREAS, the Contract involves engineering services for the following project: Affiance Runway Extension Phase 8 WHEREAS, it has become necessary to execute Amendment No. 4 to said Contract to include an increased scope of work and revised maximum fee for program management services associated with the construction and construction management of Earthwork Package 3; NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the Contract- Article I of the Contract is amended to include the additional engineering services specified in the proposal letter dated Aprif 1, 2011, a copy of which is attached hereto and incorporated herein. The cost to City for the additional services to be performed by ENGINEER total $369,544.82. 2. Article II of the Contract is amended to provide for an increase in the fee to be paid to ENGINEER for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed the sum of $2,760,084.33. IX ,t,l,f2 U.S.A. Jacobs wilt provide additional program management services associated with the Construction and construction management of Earthwork Package 3. The estimated duration for these services is 32 weeks. During this time Jacobs will: • Attend the pre -construction meeting • Attend construction coordination meetings on a monthly basis • Visit the construction site on a monthly basis • Monitor and adjust the project schedule • Monitor and adjust the project budget • Administer the prime and subcontract agreements • Coordinate with SNSF, FAA, Alliance Airport and City of Fort Worth SCOPE OF WORK Resident Project Representative Services for City of Fort Worth ! Alliance Airport Runway Extension Project Phase VIII - Earthwork Package 3 General A. Paragon Project Resources, Inc. (PARAGON) will provide the following Construction Management services in support of the City of Fort Worth / Alliance Airport Runway Extensions Project Phase Vill - Earthwork Package 3 at Alliance Airport, Fort Worth, Texas: Resident Project Representative Services B. For purposes relating to the services provided under this agreement, the Resident Project Representative (RPR) will report to Jacobs Engineering Group Inc. (Jacobs) and/or City of Fort Worth's designated representative. C. PARAGON will ensure that their on -site personnel are equipped with personal safety equipment, transportation, communications and normal construction inspection supplies necessary to perform the required services. D. Jacobs will provide a pant time Contract Administrator to provide Contract Administration and/or clerical services assistance to PARAGON's RPR as necessary for PARAGON to perform the scope of services identified in Item II below. E. JACOBS will assist with providing and managing all necessary project specific supplies and services such as report forms and survey support, maintaining project construction managementladministration files, and logging and tracking RFI's and submittals. F. A fully furnished field office, complete with all utility services including intemet access, phones, copier, fax, etc. will be included in the project bid documents to be provided by the General Contractor for the RPR's use for the duration of the project. The General Contractor will pay all set-up, monthly service charges and / or expenses associated with the field office. II. Resident Project Representative (RPR) Services A. Resident Project Representative Services will include the following: 1. Conduct onsite observations of the general progress of the work to assist Jacobs and the Owner in determining if the work is proceeding in accordance with the construction contract documents. PARAGON shall neither have control over or change of, or be responsible for, the construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the Work, since these are solely the Contractor's rights and responsibilities under the Contract Documents. 2. Serve as the Owner's liaison with the Contractor when Contractor's operations affect Owners onsite operations. Report to Jacobs, giving opinions and suggestions based on the RPR's observations regarding defects or deficiencies in the Contractor's work and relating to compliance with drawings, specifications and design concepts. 4. Visually inspect materials, equipment, and supplies delivered to the work site_ Issue non-conformance notifications for materials, equipment, and supplies, which do not conform to the construction contract documents. 5. Schedule and conduct weekly construction progress meetings with the Contractor to review and discuss construction inspection and quality control procedures, and other matters concerning the project. 6. Assist Jacobs with managing all necessary project specific supplies and services such as report forms, materials testing, geotechnicai and survey support, maintaining project construction managementladministration files, preparation of change order documentation, and logging and tracking RFI's and submittals. 7. Coordinate geotechnical engineering/materials testing services with JacobslTerracon per project design materials testing requirements. S. Coordinate surveying services with Jacobs as necessary for coordination of project layout/controls with the Contractor and verification of the Contractor's pay application quantities. 9. Submit to Jacobs, monthly, weekly and daily construction progress reports generally containing a summary of the Contractor's progress, progress photos, general condition/quality of the work, problems, and resolutions or proposed resolutions to the prof lem and quality assurance testing results 10, Verify and track completed contract unit price quantities on a regular basis. Review and verify monthly pay applications, sign off on completed quantities and quality of the work. 11. Review the Contractor's monthly progress schedule. Identify progress schedule concerns or problem areas and forward recommendation(s) to JACOBS. III. Schedule A. PARAGON is prepared to start these services within 30 days after receipt of NTPlexecution of this agreement from JACOBS for a period of 32 weeks or until the above referenced project is completed and accepted by the City of Fort Worth, whichever occurs first. B. Should the project exceed 32 weeks in duration, JACOBS shall initiate a contract modification for additional services with PARAGON 30 days minimum prior to expiration of the base 32 week agreement period. In this letter, we present our understanding of the scope of the project, our proposed services, and a budgetary estimate. 1.0 PROJECT INFORMATION — Exhibit "A" The project consists of an engineered fill to provide elevations for airport lighting and support structures at the north end of the Alliance Airport Runway Extension Project. Quality Control services are to be provided by the General Contractor. This proposal is to provide Quality Assurance services in support of the Owner's Authorized Agent. 2.0 SCOPE OF SERVICES — Exhibit "B" Terracon proposes to provide the following scope of services: A. Earthwork a) Sample materials proposed for use as subgrade, embankment, and trench backfill materials. Prepare and test the samples for Atterberg Limits (ASTM D4318), Material Finer than Number 200 Sieve (ASTM 1140) and Moisture Density Relationship (ASTM D698-CSB and D-1557 for embankment). b) Perform field moisture and density tests using the nuclear method (ASTM D3665) to determine the moisture content and percent compaction of the soil materials, and observation of the earthwork installation. Test frequency specified is 10,000 SF for embankment and 250 LF for trench backflll on pipe over 6" dia. Quality Assurance testing assumed to be 10% of Contractor QC tests. Concrete a) At the job site, monitor each load of concrete when not performing sample tests. Sample the fresh concrete for each mix and perform required tests including slump, air content, ambient and concrete temperature, unit weight, and cast test specimens (4 cylinders per 100 cy or fraction thereof per mix per day) during placements (ASTM C172, C31, C143, C173, C1064). b) Perform compressive tests of concrete test cylinders cast in the field (ASTM C617, C39) assumed to be 10% of Contractor QC tests. Limitations of Authority of Terracon 1. Terracon is not authorized to release, revoke, alter, or enlarge requirements of the Contract Documents. 2. Terracon will not approve or accept any portion of the Work. These services are provided to verify compliance on a random basis at the frequency indicated. These services do not relieve the Contractor of responsibility for compliance with the Contract Document requirements. 3. Terracon will not assume or perform any duties of the contractor. 4. Terracon has no authority to stop the work. 5. Terracon will perform observations, sampling and testing of materials and construction as listed in the scope of work. Additional services will be provided when required by the Architect /Engineer and authorized representative of the client_ 6. Terracon is not responsible for site safety. We reammi a minimum of 24 hours notice to Droneriv schedule our services. 3.0 PROJECT FEE Our budgetary estimate for providing the above scope of services is $24,651.00. A breakdown of the cost is attached. Please note that this estimate is based on the quantity of hours and tests indicated in the attached cost breakdown. If these quantities are exceeded at the request of the contractor and authorized by the Client, additional fees will apply. Services not included in this proposal, which may be requested by the client or its representative, will be billed at the MSA unit rates schedule. Overtime is defined as all hours in excess of eight per day, outside of the normal hours of 7:00 a.m. to 5:00 p.m. Monday through Friday, and all hours worked on weekends and holidays. Overtime rates will be 1.50 times the hourly rate quoted for work on Monday through Friday, and 2.0 times for Sundays and holidays. Hourly rates are invoiced portal to portal from our facility. You will be invoiced on a monthly basis for services actually performed and/or as authorized or requested by you or your representative. Principal JACOBS April 1, 2011 Alliance Airport Runway Extension Project Phase Vill - Contract Amendment No. 4 Earthwork Package 3 — Construction Management Services QUALITY ASSURANCE SURVEYING Scope of Work Perform an as -built verification survey of existing earthwork and constructed storm drain facilities at direction of the Project Manager_ All verification of constructed facilities will be based on the current published "FOR CONSTRUCTION" plan set for name and date. Plans will be provided complete and current with any and all addenda. Horizontal and vertical control used for this effort will be that control as published within said plan set. Verification of earthwork will consist of collecting data across existing grade to provide comparison to the published cross-section lines as shown in the plan set. A location at the top of slope, toe of slope, grade breaks, ditch flow line, limit of disturbance including a shot on undisturbed ground on each end of the cross section will be provided. Verification of the constructed facilities for the storm drain installation will consist of performing an as -built survey of those features. Data collected will be used to verify horizontal and vertical placement of those ditches, structures, require grading and pipe flow lines constructed according to the plan set. Upon completion of this effort a triangulated irregular network (TIN), the point and breakline data will be delivered to the Project Manager in Microstation .DGN and ascii format and develop cross --sections for comparison to the design. The total fee paid by the City for all work and services shall not exceed the sum of $2,760,084.33. DISCUSSION: On March 28, 2001, (M&C C-18528) the City Council approved hiring Carter and Burgess, Inc. (now Jacobs Engineering Group, Inc.) for Phase I program management services for the Runway Extension Project at Fort Worth Alliance Airport. Subsequently, similar services have been performed in multiple phases under individual agreements as funds became available. On August 18, 2009, (M&C C-23735) the City Council approved a contract in the amount of $1,323,029.89 with Jacobs Engineering Group, Inc., for phase VIII of the program management services for the runway extension project which included program management Design Earthwork Package No. 3, Design John Day Road, Design Keller Haslet Road and ALP Update at Fort Worth Alliance Airport. On April 20, 2010, (M&C C-24187), the City Council approved a contract with Jacobs Engineering Group, Inc., for Amendment No. 1 in the amount of $471,179.70 in order to add additional program management and land acquisition services associated with the Burlington Northern Santa Fe Railroad (BNSF) main line and connector track for additional work not included in the original contract . On June 23, 2010, (no M&C required), Amendment No. 2 in the amount of $49,708.63, was approved to increase funding to this project for Phase I Environmental Site Assessment associated with the relocation of the BNSF main line due to the need to change the alignment to separate the rail line from an existing natural gas well pad site. On April 12, 2011, (M&C C-24855), Amendment No. 3 in the amount of $546,621.29 was approved for additional program management and land acquisition services for the BNSF connector track and relocation of their main line. The amendment was necessary to meet the BNSF requirement for ALTA surveys and to account for the additional parcels and changes in the ROW requirements. This Amendment No. 4 in the amount of $369,544.82 has been proposed to accomplish Construction Management Services for the Fort Worth Alliance Airport Runway Extension in the Amount of $369,544.82 for Construction Support Services, Material Testing and Quality Assurance Surveying Associated with the Construction of the Earthworks Package No. 3 of the Alliance Runway Extension.
