AMENDMENT No . 3
TO CITY SECRETARY CONTRACT No. 47707
WHEREAS, the City of Fort Worth (CITY) and Multatech Engineering,
Inc., (ENGINEER) made and entered into City Secretary Contract No. 47707,
(the CONTRACT) which was authorized by M&C C-27724 on the 17th day of May,
2016 in the amount of $ 950,000.00; and
WHERAS, the CONTRACT was subsequently revised by amendment Number 1
in the amount of $47,780 and administratively approved on June 02, 2021,
and
WHERAS, the CONTRACT was subsequently revised by amendment Number 2
in the amount of $51,595.00 and administratively approved on May 28, 2022,
and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Keller Hicks Road from Lauren Way to East ROW of Katy Road, CPN
100146; and
WHEREAS, it has become necessary to execute Amendment No. 3 to
the CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and incorporated
herein. The cost to City for the additional design services to be performed
by Engineer totals $17,940.00. (See Attached Funding Breakdown Sheet, Page
-4-)

Improvements Additional Services Amendment 3
The scope set forth herein defines the work to be performed by the ENGINEER in completing
the project. Both the CITY and ENGINEER have attempted to clearly define the work to be
performed and address the needs of the Project.
OBJECTIVE
The purpose of this task order is to provide for moving the storm drain north to allow for one-
way traffic and eliminate the need for temporary pavement on Keller Hicks Road.Segment 1-
East Right of Way Line of Katy Road to US 377 (under separate agreement with City of Keller)
The existing roadway is currently a two-lane asphalt roadway with narrow shoulders and open
ditch drainage. There are numerous drives and businesses along this portion of Keller Hicks
including one major intersections; Katy Road.
This section of roadway is identified in the City of Fort Worth Master Thoroughfare Plan as a
Commercial Collector with the following future designation, one lane (each direction), no transit
facility, 2-way continuous left turn lane, no parking, off street side path within an 80 foot right of
way- CCO-L 1-TO-TWLT-PO-BOP (80').

Revisions to Storm Sewer Alignment
• This contract modification provides for engineering services related to moving the proposed
storm sewer north. The use of one-way traffic has been approved. The movement of the
storm sewer will allow for the maintenance of one-way traffic without the use of temporary
pavement.
• This modification also provides for the structural modifications to plug and fill the 10 x 6 box
culvert.
This contract modification will provide for:
o Modify Sheet 27 to identify the two end pugs (upstream entrance and
downstream exit)
o Create Structural design sheet (Sheet 34A) for the two end plugs
o Redesign SD B! SD C1 and associated laterals to move north and allow for the
maintenance of one way traffic on Keller Hicks Road.

TASK 7. ROW/EASEMENT SERVICES. Segment 2
ENGINEER will support and perform activities related to ROW and land as outlined below, per
scoping direction and guidance from the CITY's Project Manager.

7.2. Right-of-Way/Easement Preparation and Submittal.

which did not include a 10 foot shared path for the entire south side of Keller Hicks
Road. It was later decided to include the 10 foot shared path along both the north and
south side of Keller Hicks. This required addition of permanent ROW acquisition
documents. The downstream improvements of the RCB installation were modified
several times to accommodate the changes in discharges and water surface elevations
(see below for discussion on H&H revisions).

Additional Services not included in the existina Scope of Services — CITY and
ENGINEER agree that the following services are beyond the Scope of Services described
in the tasks above. However, ENGINEER can provide these services, if needed, upon the
CITY's written request. Any additional amounts paid to the ENGINEER as a result of any
material change to the Scope of the Project shall be agreed upon in writing by both parties
before the services are performed. These additional services include the following:

Cateaory Rate for the ENGINEER's team member performing the work.

Expenses at invoice or internal office cost.
Direct Expenses (non -labor) include, but are not limited to, mileage, travel and
lodging expenses, mail, supplies, printing and reproduction services, other direct
expenses associated with delivery of the work; plus applicable sales, use, value
added, business transfer, gross receipts, or other similar taxes.
iii. Subcontract Expenses. Subcontract expenses and outside services shall
be reimbursed at cost to ENGINEER plus a markup of ten percent (10%).

iv. Budgets. ENGINEER will make reasonable efforts to complete the work
within the budget and will keep the City informed of progress toward that end so
that the budget or work effort can be adjusted if found necessary.
ENGINEER is not obligated to incur costs beyond the indicated budgets, as may
be adjusted, nor is the City obligated to pay ENGINEER beyond these limits.
If ENGINEER projects, in the course of providing the necessary services, that the
PROJECT cost presented in Article 2 of this Agreement will be exceeded, whether
by change in scope of the project, increased costs or other conditions, the
ENGINEER shall immediately report such fact to the City and, if so instructed by
the City, shall suspend all work hereunder.
When any budget has been increased, ENGINEER's excess costs expended prior
to such increase will be allowable to the same extent as if such costs had been
incurred after the approved increase.
B. The ENGINEER shall be paid monthly payments as described in Section II -
Method of Payment.
II. Method of Payment
A. The ENGINEER shall be paid by the City based upon an invoice created on the
basis of statements prepared from the books and records of account of the
ENGINEER, based on the actual hours and costs expended by the ENGINEER
in performing the work.
B. Each invoice shall be verified as to its accuracy and compliance with the terms of
this Agreement by an officer of the ENGINEER.
C. ENGINEER shall prepare and submit invoices in the format and including content
as presented in Exhibit B-1.
D. Payment of invoices will be subject to certification by the City that such work has
been performed.
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the
Transportation and Public Works Department monthly progress reports and
schedules in the format required by the City.

RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment Number 3, in an amount not to
exceed $17,940.00 to City Secretary Contract Number 47707 with Multatech Engineering, Inc., thereby
increasing the contract amount to $1,067,315.00 (City Project No. 100146).
DISCUSSION:
The 2018 Bond Program allocated funds for the roadway widening of Keller Hicks Road from Lauren Way
to US 377. An Engineering Services Agreement, City Secretary No. 47707 with Multatech Engineering,
Inc. (Consultant) was authorized for the design of the project that included widening a two-lane asphalt
road to a three -lane arterial that includes a traffic signal and 10 foot shared used paths.
Amendment Number 3 provides compensation to the Consultant for constructability changes to the
drainage plans. The changes to the plans are recommended by the contractor to make the construction
phasing simpler and will result in construction cost savings by requiring less temporary asphalt.

Justification
Initial contract to develop design and construction
documents for construction of Keller Hicks from Lauren
Way to US 377.
Amendment to add design and ROW services. Scope
changes were made that related to sidewalk, drainage
and adjacent developer changes that required changes
to the design and ROW documents previously
completed.
Amendment to add design services related to phasing
and drainage revision. The revisions will allow the
contractor to phase the construction and keep traffic
open to specific property owners. The revisions were
also made to accommodate drainage design recently
completed by adjacent developer.
Amendment to add design servies related to the
drainage and construction phasing. The selected
contractor proposed some revisions to the location of
the storm drain that will improve the construction
phasing and not require as much temporary asphalt as
previously needed. The revisions will result in an
