ORDINANCE NO. r V)~a~+o3`" a1d~Jr' AN ORDINANCE VACATING AND EXTTNGUTST°TING A PORTION OF WEST DASHWOOD STREET BETWEEN LOTS 59 AND b0 IN THE SHELMIRE'S SUBDIVISION FROM THE EAST RIGHT-OF- WAY LINE OF COLLEGE STREET TO THE WEST RIGIIT-OF WAY LINE OF A t3 FOOT PUBLIC ALLEY FOLLOWING THE PROJECTED SOUTIIERLY EX'T'ENSION OF THE WEST PROPERTY LINE OF LOT 60 AND BEING APPROXIMATELY 102 FT LONG AND 17 FT WIDE AND CONTAINING 1,734 SQUARE FEET, MORE OR LESS; PROVIDING FOR TIFTE REVERSION OF FEE IN SAID LAND; THE RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That a portion of W. Dashwood Street between Lots 59 and b0, Black 5 in the Shehr~ire's Subdivision from the east right-of--way line of College Street to the west right-of way line of a 13 foot public Alley following the projected southerly extension of the west property line of lot b0 being approximately 102 ft long and 17 d wide, and containing 1,73 square feet, more or less as shown an the plats thereof recorded in Volume 106, Page 94 and Volume 1365, Page 17 of the Tarrant County Deed Records, and as more specifically described in Exhibit "A" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street and alley rights-af way is released and shall revert to the adjacent owner as provided bylaw. SECTION 3. That all existing utility easements shall be retained by the City until such time all utilities located in that ease:ent are relocated at the owner's expense. 0~--1 ~-O~AOf3 ~ 1 SECTION 4. Dashwood Street between Lnts 59 and 60, Block 5 in the Shelmire's Subdivision from the east right-af-way line of College Street to the west right-of-way line of a 13 foot public alley following the projected southerly extension of the west property line of lot fi0 being approximately 102 ft long and 17 ft wide, and containing 1,734 square feet, more or less as shown on the plats (hereof recorded in Volume 106, Page 94 and Volume 1365, Page 17 of the Tarrant County Deed Records. DISCUSSION: Curtis of Gerry Curtis Associates, Inc., Fort Worth Texas, acting on behalf of Gordon Ke!!y has requested vacation of the above referenced street in order to include the area in a rep[at to create an enhanced building site, as shnwn on the attached replat. The Engineering Department, Real Property Services Division, states that the purchase fee of $1.00 has been satisfied. The City Plan Commission recommended approval of this request at its meeting on December 17, 2004. An acceptable replat has been received (see attached). This request is located in COUNCIL DISTRICT 9. FISCAL 1NFORMATIONICERTIFICATION: The Finance Director certifies that this action will have no material effec# on City funds.
