AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE PARD DEDICATION FEES FUND, BY INCREASING
ESTIMATED RECEIPTS AND APPROPRIATIONS IN MULTIPLE PROJECTS, 1)
IN THE AMOUNT OF $50,000.00, FROM AVAILABLE FUNDS, FOR THE
PURPOSE OF FUNDING THE TIM WATSON RESERVE PARK PROJECT (CITY
PROJECT NO.102336); 2) IN THE AMOUNT OF $4,000.00, FROM AVAILABLE
FUNDS, FOR THE PURPOSE OF FUNDING CENTRAL CITY PROGRAMMABLE
PROJECT (CITY PROJECT NO.P00057) IN ORDER TO FUND THE CHILD
PROJECT, VICTORY FOREST REC CENTER; 3) IN THE AMOUNT OF
$32,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE
WESLEYAN HILLS PARK PROJECT (CITY PROJECT NO.102326); PROVIDING
FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the PARD
Dedication Fees Fund, by increasing estimated receipts and appropriations in multiple projects, 1) in the
amount of $50,000.00, from available funds, for the purpose of funding the Tim Watson Reserve Park Project
(City Project No.102336); 2) in the amount of $4,000.00, from available funds, for the purpose of funding
Central City Programmable project (City Project No.P00057) in order to fund the child project, Victory Forest
Rec Center; 3) in the amount of $32,000.00, from available funds, for the purpose of funding the Wesleyan
Hills Park Project (City Project No.102326).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 26453-09-2023 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of a construction contract with Cole Construction, Inc., in the amount of $768,693.47 for the park improvements at Tim
Watson Park (City Project No. 102336), Wesleyan Hills Park (City Project No. 102326), and Victory Forest Park (City Project No. C00130);
2. Adopt the attached appropriation ordinance in the PARD Dedication Fees Fund by:
1. Increasing estimated receipts and appropriations in the amount of $50,000.00, from available funds, for the purpose of funding the Tim
Watson Park project (City Project No.102336);
2. Increasing estimated receipts and appropriations in the amount of $4,000.00, from available funds, for the purpose of funding the
Central City programmable project (City Project No. P00057) in order to fund project, Victory Forest Rec Center (City Project No.
C00130); and
3. Increasing estimated receipts and appropriations in the amount of $32,000.00, from available funds, for the purpose of funding the
Wesleyan Hills Park project (City Project No.102326); and
3. Amend Fiscal Years 2024 - 2028 Capital Improvement Program.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of a construction contract with Cole Construction,
Inc., in the amount of $768,693.47 for the park improvements at Tim Watson, Wesleyan Hills and Victory Forest Parks.
The project was posted on the City purchasing website and the Fort Worth Star -Telegram on September 7 & 14, 2023. The following bids were
received on October 5, 2023:

Base bid improvements at Tim Watson Park and Wesleyan Hills Park include installation of a concrete trail, a new playground, and benches. Base
bid improvements at Victory Forest includes the installation of a small shelter with amenities. Alternate bid items at Tim Watson Park include the
installation of multiple park benches and construction allowances. Alternate bid items for Wesleyan Hills Park include installation of a basketball
court, one bench, and construction allowances. The alternate bid item at Victory Forest Park include the installation of a concrete seating wall.
Funding for the Victory Forest Rec Center project and the Wesleyan Hills Park Project was not included in the Fiscal Years (FY) 2024-2028 Capital
Improvement Program due to increased costs from the original estimate. The action in this M&C will amend the FY2024-2028 Capital
Improvement Program as approved in connection with Ordinance 26453-09-2023.
Construction of this project is anticipated to begin in January 2024 and be completed in August 2024.
Tim Watson Park, Wesleyan Hills Park, and Victory Forest Park improvement projects are estimated to increase the department's annual
maintenance by $19,079.00 beginning in FY2025. As of October 2023, the cumulative total of all previously approved M&C's increased the
department's estimated annual maintenance by $73,124.00 beginning in FY2025.
Cole Construction, Inc., is in compliance with the City's Business Equity Ordinance by committing to 7% MWBE participation on this project. The
City's MWBE goal on this project is 7%.
Funding is budgeted in the 2018 Bond Program, General Capital Projects, PARD Gas Lease Capital Projects and PARD Dedication Fee Funds
for the purpose of funding the Tim Watson Park, Wesleyan Hills Park, and Victory Forest Rec Center projects, as appropriated.
Tim Watson Park is located in COUNCIL DISTRICT 3, Wesleyan Hills Park is located in COUNCIL DISTRICT 8, & Victory Forest Park is located in
COUNCIL DISTRICT 11.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Tim Watson Park project within the 2018 Bond Program Fund, the Victory
Forest Rec Center project within the General Capital Projects and PARD Gas Lease Capital Projects Funds and in the Wesleyan Hills Park, PPD
4.10-2, PPD 4.6-4 and PPD 4.2-3 projects within the PARD Dedication Fees Fund and upon approval of the above recommendations and
adoption of the attached appropriation ordinance, funds will be available in the PARD Dedication Fees for the Tim Watson Park project, Wesleyan
Hills Park project, and Central City programmable project to support the above recommendation and execution of the contract. Prior to an
expenditure being incurred, the Park & Recreation Department has the responsibility of verifying the availability of funds.
