FOR THE ROBIN-DENVER STORM DRAIN RECONSTRUCTION PROJECT; MAKING THIS ORDINANCE CUMULATIVI~ OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Tha# in addition to thaw amounts allocated to the various City departments for Fiscal Year 2004-2005 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $13,394 and the Sewer Capital Project Fund in the amount of $15,7'97 from available funds for the purpose of funding an engineering agreement with Halff Associates, Inc. for the Robin-Denver Storm Drain Reconstruction Project. SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative ar void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shad be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 1fi061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Water Capital Project Fund in the amount of $93,394.00 and the Sewer Capital Project Fund in the amount of $15,797.00, from available funds; 2. Authorize the City Manager to execute an engineering agreement with Halff Associates, Inc. in the amount of $139,190.00 for the Robin-Denver Storm Drain Reconstruction Project.; and 3. Authorize the transfer of $29,191.00 from the Water and Sewer Operating f=und to the Water Capital Project Fund in the amount of $13,394.DO and Sewer Capital Project Fund in the amoun# of $15,797.00; and ©ISCUSSION: The 2004 Capita! Improvement Program {CIP) includes funding for the Robin-Denver Storm Drain Reconstruction Project. The scope of the project consists of the prepara#ion of plans and specifications for the replacement of an existing storm drain system beginning from the .Robin Avenue and Deaver Avenue intersec#ion, southerly 280 feet along Rabin Avenue, southeasterly 450 feet, easterly 200 feet along Park Street, southerly 200 feet along Denver Avenue, northeasterly 400 feet to Gould Street and southerly 250 feet aiang Gould Street. This storm drain relocation is required in artier #o replace approximately 1,200 linear feet of water line and 1,600 linear feet of sewer line. Halff Associates, Inc. proposes to perform the necessary design work for a lump sum fee of $139,190.00. City staff considers this fee to be fair and reasonable for the scope of services proposed. In addition to the Contract amount, a total $19,391.00 ($1,584.00 {water}; $1,967:00 {sewer); and $15,840.00 {streets}) is required far project management by the Engineering Department. Halff Associates, Inc., is in compliance with the City's M/VIIi3E Ordinance by committing to 20% MIWBE participation. The City's goal on the project is 18%.
