A RESOLUTION DETERMINING THE NECESSITY FOR ACQUIRING REAL
PROPERTY AND AUTHORIZING ITS APPROPRIATION OR
CONDEMNATION FOR PUBLIC USE
WHEREAS, the Fort Worth City Council on October 31, 2023, in M&C 23-0934, ordered and
decreed that a public necessity existed to acquire 0.618 acres in permanent drainage easement and
0.045 acres in temporary construction easement from real property owned Vass'e Enterprises located at
4201 S. Cravens in the Daniels James W Survey, Abstract No. 395, Tract 3, 3D, 3E, 3F, 3F1, &
3G, Tarrant County, Texas, as described in the exhibits attached to the above -referenced M&C; those
exhibits are incorporated herein for all purposes (the "Property");
WHEREAS, the Fort Worth City Council has determined that:
- the Property is needed for Hazardous Roadway Overtopping Mitigation South Cravens Road
Culvert Improvements project (the "Project");
- the land rights in the Property are needed for the drainage improvements;
- public necessity required the acquisition by condemnation of the Property, located within the
alignment of the Project;
- the use of the Property will be a public use; and
- the Real Estate Division of the Property Management Department is authorized to acquire by
negotiation the Property needed for the Project.
WHEREAS, negotiations between the City of Fort Worth and the property owner, Vass'e
Enterprises were unsuccessful due the inability to negotiate agreeable terms for the property interests
being acquired by the City of Fort Worth; and
WHEREAS, on this 31st day of October 2023, at a regular meeting of the Fort Worth City
Council, upon M otion of Councilmember Bevins, to wit:
"I move that the Fort Worth City Council adopt the resolution authorizing use of the power of
eminent domain to acquire 0.618 acres in permanent drainage easement and 0.045 acres in temporary
construction easement from real property owned by the Vass'e Enterprises, located at 4201 S Cravens
Drive in the James M. Daniel Survey, Abstract No. 395, Tracts 3, 3D, 3E, 3F, 3F1, and 3G, Tarrant
County, Texas. The property is needed for the Hazardous Roadway Overtopping Mitigation South
Cravens Road Culvert Improvements Project (City Project No 103398), a public use project that will
replace the bridge (S. Cravens Rd) and increase drainage capability to eliminate flooding. The land
rights in the subject property are needed for the drainage improvements. The property interest to be
acquired is described by metes and bounds and depicted by survey exhibits attached to this Mayor and
Council Communication."
Seconded by Councilmember Crain, duly put and carried: RESOLUTION.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS THAT:
The City of Fort Worth, Texas, is authorized to use the power of eminent domain to acquire the
Property for the public use and inclusion in the Project; and
The City Attorney be and is hereby authorized and directed to file or cause to be filed, to spend all
reasonable and necessary legal expenses, and to carry through to final judgment proceedings in eminent
domain for the acquisition of the property interest listed above and attached to the M&C.

recorded in County Clerk's File No. D207095424 of the Official Public Records of Tarrant
County, Texas, said permanent drainage easement also being a portion of a 1.701 acre tract of land
(by deed) described as Tract II in deed to Vass'e Enterprises, Inc. as recorded in County Clerk's
File No. D207095424, of said Official Public Records of Tarrant County, Texas, said permanent
drainage easement being more particularly described by metes and bounds as follows:
BEGINNING at a 1/2 inch iron rod with cap (illegible) found for the southwest corner of said
1.699 acre tract of land, said 1/2 inch iron rod with cap (illegible) being the northwest corner of
Lot 1, Block 1 of Summer Lake Estates Addition, an addition to the City of Fort Worth, Tarrant
County, Texas as recorded in Volume 388-176, Page 28 of the Plat Records of Tarrant County,
Texas, said 1/2 inch iron rod with cap (illegible) also being in the east right-of-way line of South
Cravens Road (a variable width right-of-way), from which a 1/2 inch iron rod with cap (illegible)
found for the southwest corner of said Lot 1 bears South 00 degrees 29 minutes 27 seconds East,
a distance of 966.31 feet, said 1/2 inch iron rod with cap (illegible) being an interior ell corner in
the east right-of-way line of said South Cravens Road;

Cravens Road Culvert Improvements Project
RECOMMENDATION:
It is recommended that the City Council:
1. Declare that negotiations between the City and the property owner to acquire 0.618 acres in permanent drainage easement and 0.045 acres
in temporary construction easement from real property owned by Vass'e Enterprises, located at 4201 S. Cravens in the James M. Daniels
Survey, Abstract No. 395, Tracts 3, 3D, 3E, 3F, 3F1 & 3G, Tarrant County, Texas, were unsuccessful due to the inability to negotiate
agreeable terms for the property interest being acquired by the City;
2. Declare the necessity to acquire the described property interest for the Hazardous Road Overtopping Mitigation South Cravens Road
Culvert Improvements Project (City Project No. 103398);
3. Adopt the attached resolution authorizing the City to use its power of eminent domain to acquire the property for public use;
4. Authorize the City Attorney to institute condemnation by eminent domain proceedings to acquire the described property interest from the
property owner;
5. Authorize a payment pursuant to an award of commissioners or a negotiated settlement; and
6. Authorize the City Manager or his designee to accept and record the appropriate instruments.
DISCUSSION:
The land rights in the subject property are needed for the Hazardous Roadway Overtopping Mitigation (HROM) South Cravens Road
Culvert Improvements Project, a public use project that will replace the bridge (S. Cravens Rd) and increase drainage capability to
eliminate flooding.
An independent appraisal established fair market value for the property interest (shown below) in the total amount of $116,548.00. Negotiations
were unsuccessful due to the inability to negotiate agreeable terms for the property interest being acquired by the City.
Upon approval, a condemnation action will be brought and a Special Commissioners' hearing held to acquire the property interest (shown
below) on the property.
