INTERLOCAI, AGREEMENT
TARRANT COUNTY AND THE CITY OF FORT WORTH
STATE OF TEXAS
COUNTY OF TARRANT
This INTERLOCAL AGREEMENT, hereinafter called the "Agreement" is made and entered into
by and between Tarrant County, hereinafter called "County" and the City of Fort Worth, Texas,
hereinafter called the "City."
WITNESSETH:
WHEREAS, the Interlocal Cooperation Act, Chapter 791, Texas Government Code, provides
authorization for any local government to contract with one or more local governments and with
agencies of the State of Texas to perform governmental functions and services under the terms of
this act; and
WHEREAS, the Enhanced Collaborative Model Task Force to Combat Human Trafficking is a
grant program funded under an award by the United States Department of Justice, hereinafter
called "DOT" through their Office of Victims of Crime, hereinafter called "OVC"; and
WHEREAS, County and the City desire to enter into an agreement regarding the Tarrant County
Human Trafficking Task Force; and
WHEREAS, the County, for its Sheriff's Office, has applied for and received from the DOJ a grant
to target human trafficking in Tarrant County, in the State of Texas, the grant period runs from
October 1, 2023 through September 30, 2026; and
WHEREAS, the grant is titled Enhanced Collaborative Model Task Force to Combat Human
Trafficking Grant (Grant Number 15POVC-23-GK-02747-HT), hereinafter called "Project", and
WHEREAS, the Tarrant County Sheriff s Office has asked the City to participate in fulfilling the
purpose of the grant.
NOW THEREFORE, this Agreement is hereby made and entered into by County and the City for
the mutual consideration stated herein:

I.
For the consideration hereinafter agreed to the City undertakes, covenants and agrees to:
1. Provide staff and resources to investigate human trafficking within its jurisdiction so as
to assist the Enhanced Collaborative Model Task Force to Combat Human Trafficking
Project in achieving its goals.
2. On a quarterly basis provide the Tarrant County Sheriffs Office with an activity report
describing cases investigated.
3. Maintain documentation of all overtime expenditures which are to be reimbursed by the
Enhanced Collaborative Model Task Force to Combat Human Trafficking Grant. This
documentation will include the name and title of the person earning the salary or overtime,
the date(s) worked, the number of hours worked, the exact payment amount to be charged
to the Grant, the employee's hourly and overtime pay rate as appropriate, and a brief
explanation of the activity undertaken to earn the salary or overtime. This expenditure
report must carry an original signature of a Fort Worth Police Department official and be
supported by departmental payroll records which correspond to the overtime payments.
This overtime expenditure report and support documentation will be submitted to the
Tarrant County Sheriff's Office at the time reimbursement is requested.
4. Maintain documentation of all training and travel expenditures which are to be reimbursed
by the Enhanced Collaborative Model Task Force to Combat Human Trafficking Grant. This
documentation will include the name and title of the person travelling or receiving
training, the dates and location of travel or training, the exact payment amount to be
charged to the Grant, and a brief explanation of the purpose of the travel or training. This
expenditure report must carry the signature of a Fort Worth Police Department official and
be supported by receipts, invoices, or other appropriate documentation. This travel and
training expenditure report and support documentation will be submitted to the Tarrant
County Sheriff's Office at the time reimbursement is requested. All training and travel
must be approved by the Tarrant County Sheriffs Office Grant Manager prior to
expenditure by the Fort Worth Police Department.
Maintain an up -to -.date and itemized inventory list of all equipment or services purchased
by the Fort Worth Police Department with funds from the Enhanced Collaborative Model
Task Force to Combat Human Trafficking Grant_ Inventory list entries of major hardware items
such as computers, monitors, printers, FAX machines, and the like must also include the
brand name and model, serial number, the Fort Worth Police Department's property
inventory tag number assigned to the specific item, and the current physical location of the
property. This inventory list must be supported by receipts, invoices, or other appropriate
documentation. The inventory list will be submitted to the Tarrant County Sheriff's Office
when requested. All equipment or services must be approved by the Tarrant County
Slteriff s Office Grant Manager prior to expenditure by the Fort Worth Police
Department.

6. Allow the Enhanced Collaborative Model Task Force to Combat Human Trafficking
Grant Manager or his/her designate to make one or more on -site visits for the purpose of
assessing the compliance of the City with the provisions of this Agreement.
7. When requested, provide the Tarrant County Sheriff's Office with a copy of the City's
most recent Single Audit Report and, if appropriate, a written statement describing any
necessary corrective action identified in that Audit Report.
8. Funding cannot be used to support operations which:
a. target the purchasers of commercial sex, colloquially known as "John stings" if they do not
involve the identification of one or more actual victims of human trafficking, prior to the
operation or if they otherwise fail to involve a connection to one or more actual victims.
b. target individuals engaged in prostitution for arrest as a means for identifying victims of
tracking. Such efforts can compromise victim safety and recovery by failing to properly
screen for sex tracking victimization and resulting in the arrest of victims of sex
trafficking.
II.
As consideration for the services contracted for herein, the County agrees to reimburse the City
a sum not to exceed Thirty Thousand and 00/100 Dollars ($30,000.00) per fiscal year, (fiscal
year is the period from October I" through September 301h) for a total not to exceed Ninety
Thousand and 00/100 Dollars ($90,000.00) for the grant period hereinafter called the "Contract
Amount". Unobligated funds may be carried over to the following fiscal year, but not past the
ending of the grant period. This sum is to reimburse the City for expenses incurred for training,
travel, equipment and overtime as deemed necessary and appropriate by the City for its
operations to combat human trafficking. The City may invoice the County for reimbursement
of expenses, but no reimbursement request will be accepted after September 301h per fiscal
year. Reimbursement for allowable expenses incurred shall be made by the Tarrant County
Sheriff's Office to the City after receipt of invoices detailing the expenses to be reimbursed.

The Contract Amount may increase if, in the future, additional funds become available to grant
to City. If additional funds are available in the future to grant to the City, County will give
written notice and City may accept or reject the additional funds by giving written notice of
the intent to the County.
During the performance of this Agreement, the City agrees to the following:
It will, to the extent permitted by law, accept liability, under the Worker's
Compensation Act, in the event personal injuries occur to its employee(s) while
engaged in Project activities.
2. It shall, to the extent permitted by law and during the entire time of participation,
maintain sufficient insurance to cover its obligation and liability for its employee(s).
This will include, but is not limited to, coverage of the employee and vehicle, while
operating a vehicle, where applicable.
3. It may, in lieu of purchasing liability insurance, elect to be self -insured but will be
responsible for all risks of loss and actual loss as specified herein.
IV.
The term of this Agreement shall be from October 1, 2023 through September 30, 2026. This
Agreement may be extended by mutual agreement of the parties hereto, or terminated by either
party upon thirty (30) days prior written notice thereof to the other of its intention to terminate
upon the date specified in such notice. If at which time during the grant period, the County of
Tarrant receives an extension to the original grant, the Contract may be extended further by
County giving City written notice of new term.
V.
Any notice, payment, statement, or demand required or permitted to be given hereunder by
either party to the other may be affected by personal delivery in writing or by mail, postage
prepaid. Mailed notices shall be addressed to the parties at the addresses appearing below, but
each party may change its address by written notice in accordance with this section. Mailed
notices shall be deemed communicated as of three days after mailing.

VI.
This Agreement may be amended by the mutual agreement of the parties hereto in writing to be
attached to and incorporated into this Agreement.
VII.
In case any one or more of the provisions contained in this Agreement shall be held to be invalid,
illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability shall not
affect any other provision thereof and this Agreement shall be construed as if such invalid, illegal,
or unenforceable provision had never been contained herein.
VIII.
This Agreement supersedes any and all other agreements, either oral or in writing, between the
parties hereto with respect to the subject matter hereof, and no other agreement, statement, or
promise relating to the subject matter of this agreement, which is not contained herein, shall be
valid or binding.
IX.
In providing the services required by this Agreement, City must observe and comply with all
applicable federal, state, and local statutes, ordinances, rules, and regulations, including, without
limitation, workers' compensation laws, minimum and maximum salary and wage statutes and
regulations, and non-discrimination laws and regulations. City shall be responsible for ensuring
its compliance with any laws and regulations applicable to its business, including maintaining
any necessary licenses and permits.

It is recommended that the City Council:
Authorize the execution of an Interlocal Agreement with Tarrant County to participate in the
Tarrant County Human Trafficking Task Force for three years;
Authorize the acceptance of federal grant pass -through funding for the Tarrant County
Human Trafficking Task Force in an amount up to $90,000.00 ($30,000.00 per year); and
Adopt the attached appropriation ordinance increasing estimated receipts and appropriations
in the Grants Operating Federal Fund in an amount up to $90,000.00, subject to the receipt
of grant, for the purpose of funding participation in the Tarrant County Human
Trafficking Task Force.
DISCUSSION:
The City of Fort Worth has been an active participant in the Tarrant County Human Trafficking Task
Force (Task Force) since 2016. The Task Force uses coordinated and cooperative enforcement, and
crime prevention techniques and technology to investigate and combat human trafficking. The Task
Force is grant -funded through the United States Department of Justice, Office of Victims of Crimes,
Enhanced Collaborative Model Task Force to Combat Human Trafficking Grant. The City of Fort
Worth is a sub -recipient of the grant.
Currently, seven municipal police agencies participate in the Task Force and are partially reimbursed
for their participation. The Fort Worth Police Department will use the funds for overtime in an amount
up to $90,000.00 ($30,000.00 per year). The grant funds will reimburse the detectives' and officers'
overtime salary, including fringe benefits.
With the approval of this Mayor and Council Communication (M&C), the City will execute an interlocal
agreement with Tarrant County to continue its participation in the Task Force. This M&C also
authorizes the City to accept grant funds for the Task Force, which will be appropriated in accordance
with the attached ordinance.
Indirect costs are not allowable expenses under this Interlocal Agreement. This is a reimbursement
grant.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of
the attached appropriation ordinance funds will be available in the current operating budget, as
appropriated, in the Grants Operating Federal Fund. The Police Department (and Financial
Management Services) will be responsible for the collection and deposit of funds due to the City.

Prior to any expenditure being incurred, the Police Department has the responsibility to validate the
availability of funds. This is a reimbursement grant.

It is requested that the Commissioners Court approve an Interlocal Agreement (ILA) between Tarrant
County, d/b/a Tarrant County Sheriff's Office and the City of Fort Worth for the Enhanced
Collaborative Model (ECM) Task Force to Combat Human Trafficking Grant Program.
BACKGROUND
The ECM Task Force to Combat Human Trafficking Grant Program is a grant award program funded
by the U.S. Department of Justice (DOJ) Office for Victims of Crime. The purpose of the program is
to provide grant funding for the development or continuation of collaborative model task forces to
combat human trafficking. This furthers the mission of the DOJ to enhance law enforcement and the
response of social services to victims of human trafficking. This collaborative approach includes
victim and social service providers, law enforcement, prosecution personnel, individuals with lived
experience, and a range of other governmental and nongovernmental partners that work together to
provide access to a diverse set of services for trafficking victims and to seek justice on their behalf.
On April 18, 2023, the Commissioners Court, through Court Order 4140751, approved the
submission of an application to the DOJ for the ECM Task Force to Combat Human Trafficking Grant
Program for grant funding in the amount of $1,000,000.00. Tarrant County, for its Sheriff's Office,
has applied for and received from the DOJ a grant to target human trafficking in Tarrant County, in
the State of Texas, the grant period is from October 1, 2023 through September 30, 2026.
On October 17, 2023, the Commissioners Court, through Court Order If141996, accepted the FY 2023
ECM Task Force to Combat Human Trafficking Grant Program grant award in the amount of
$750,000.00 from the U.S. Department of Justice to support the Tarrant County Sheriffs Office
(TCSO) in combating human trafficking.
With approval of the ILA, the City of Fort Worth will provide staff and resources to investigate human
trafficking within its jurisdiction. Tarrant County will reimburse the City a sum not to exceed
$30,000.00 per fiscal year for a total not to exceed the amount of $90,000.00 for the grant period. This
sum is to reimburse the City for expenses incurred for overtime, training, travel and equipment as
deemed necessary and appropriate by the City for its operations to combat human trafficking.
