Ordinance No.~~,~~-0~~5 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $803,785, SUBJECT TO RECEIPT OF THE EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT FROM THE U.S. DEPARTMENT OF JUSTICE, FOR THE PURPOSE OF FUNDING VARIOUS PROGRAMS OF THE FORT WORTH POLICE bEPARTMENT; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE bA7E. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 9. That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $803,785, subject to receipt of the Edward Byrne Memorial Justice Assistance grant from the U.S. Department of Justice, for the purpose of funding the various programs of the Fort Worth Police Department. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining par#ians, sec#ions, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 1606 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Apply for and accept, if awarded, the FY 2005 Byrne Justice Assistance Grant in the amount of $778,785, for the period ©ctober 1, 2004 through September 30, 2008; 2. Approve an Inter-Local Agreement to have the City of Fart Worth to serve as the cognizant fiscal agency on this grant for Tarrant County, Arlington, Haltom City, Hurst and North Richland Hills; 3. Authorize the use of anticipated interest in the amount of $25,000; and 4. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by $803,785. DISGUSSIOhd: The United States Department of Justice has discontinued the Local Law Enforcement Block Grant (LLEBG) program and replaced it by combining the Edward Byrne Memorial Fund, a discretionary grant program and a new program to create the FY .2005 Byrne Memorial Justice Assistance Grant (JAG). This was announced in mid-January 2005 and the deadline to apply for the grant is March 31, 2005. Under the LLEBG, the Gity of Fart Worth, along with several other jurisdictions, were deemed "disparate" agencies and had to negotiate with Tarrant County to develop a program budget and strategy. Previously each city applied for. their own grant and contracted with Tarrant County to provide funds. This strategy is not allowed in the FY 2005 JAG. All funds destined for agencies cer#ified as disparate must be pooled, a spending plan must be developed and one agency must serve as the cognizant jurisdiction to apply for and disperse funds. A committee of all impacted law enforcement agencies was formed and met to develop an application strategy. At this meeting Fort Worth was selected to serve as the cognizant agency. The initial funding period is October 1, 2004 through September 30, 2005 and may be extended for a period not to exceed 3 years, until September 30, 2008.
