AMENDMENT No.7
TO CITY SECRETARY CONTRACT No. 49049
WHEREAS, the City of Fort Worth (CITY) and CDM Smith, Inc., (ENGINEER) made
and entered into City Secretary Contract No. 49049, (the CONTRACT) which was
authorized by M&C C-28213 on the 2nd day of May, 2017 in the amount of
$1,570,965.00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment No. 1 in
the amount of $885,755.00 which was authorized by M&C C-28857 on September 18,
2018, Amendment No. 2 in the amount of $71,993.00 administratively authorized
February 7, 2019, Amendment No. 3 in the amount of $114,939.00 which was authorized
by M&C 20-0159 on April 7, 2020, Amendment No. 4 in the amount of $705,000.00
which was authorized by M&C 20-0346 on May 19, 2020, Amendment No. 5 in the amount
of $699,217.00 which was authorized by M&C 20-0700 on September 22, 2020 and
Amendment No. 6 in the amount of $785,500.00 which was authorized by M&C 21-0356
on March 18, 2021; and
WHEREAS, the CONTRACT involves engineering services for the following
project:
Village Creek Water Reclamation Facility Grit Facility and South Influent
Pump Station, CPN 100075-1; and
WHEREAS, it has become necessary to execute Amendment No. 7 to the CONTRACT
to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional engineering
services specified in proposal attached hereto and incorporated herein. The cost
to City for the additional design services to be performed by Engineer totals
$60,802.00.
2.
Article II of the CONTRACT is amended to provide for an increase in the fee
to be paid to Engineer for all work and services performed under the Contract, as
amended, so that the total fee paid by the City for all work and services shall
be an amount of $4,894,171.00.
3.
All other provisions of the Contract, which are not expressly amended herein,
shall remain in full force and effect.

Subject: Village Creek Water Reclamation Facility Grit Removal Facility Project
Amendment 7 Proposal Additional Hydraulic Modeling during Startup and Additional
Construction Phase Services
Dear Farida:
During startup of the grit removal facility in June 2023, the City requested CDM Smith and Freese &
Nichols to complete additional hydraulic modeling efforts to evaluate various modified grit facility
effluent weir elevations and flow scenarios. This amendment proposal is for compensating Freese &
Nichols for the additional infoworks hydraulic modeling efforts, prepare exhibits for meetings, and
attend meetings to discuss the modeling efforts they have completed to date. Any additional modeling
requests beyond these services will be considered an Additional Service. Please see attached fee
breakdown for Freese & Nichols. CDM Smith considers our time attending meetings as part of our
construction phase services and is not requesting additional compensation for the additional hydraulic
modeling.
CDM Smith is 94% spent on our construction phase services budget with approximately $38,160
remaining based on our invoice dated January 25, 2024. We have been able to cover the additional 20
plus monthly construction progress meetings, additional 124 submittal/resubmittal reviews, additional
34 RFIs, 12 monthly Headworks shutdown meetings, and additional 34 weekly startup meetings (May
thru December 2023), as part of our construction phase services budget to date. The remaining efforts
for finish out the project include the following.
1. Attend monthly construction progress meetings February May 2024
2. Complete final construction project closeout (anticipated to be complete in May 2024)
3. Finalize SOPs after we receive comments from City (assuming comments are not significant)
4. Complete record drawings
Our original budget allocated $40,838 for record drawings, which is slightly more than our remaining
budget and we have the other items above to complete as well. All things considered, CDM Smith is
requesting additional compensation to complete the remaining tasks above to close out our
construction phase services for the VCWRF Grit Removal Facility project.
