WHEREAS, the City of Fort Worth (City) and TranSystems
Corporation Consultants, (Engineer) made and entered into City
Secretary Contract No. 35497, (the Contract) which was authorized
by the City Council by M&C C-22159 on the 5th day of June 2007;
and
WHEREAS, the Contract involves engineering services for the
following project:
Drainage Improvements to Kermit-Bonnie Channel and Culvert, 4600 Block
Merida Avenue, Sarita Channel and Waverly Park, Project No. 00484
WHEREAS, it has become necessary to execute Amendment No. 4
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the
additional engineering services specified in M&C C-24767,adopted
by the City Council on the 8th day of March 2011 and further
amplified in a proposal letter dated November 30, 2010, copies of
which are attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by
Engineer total $57,006.00 .
2.
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that_the

total fee paid by the City for all work and services shall not
exceed the sum of $319,047 .00.

All other provisions of the Contract which are not expressly
amended herein shall remain in full force and effect.

Dear Mr. Shaffer,
Per your request,this amendment revises the previously approved Storm Water Utility Projects, City
Secretary Contract No.35497 design plans and contract documents. Specifically,this amendment includes
the preparation of plans and details associated with the Sarita Channel access ramp,channel wall
reconstruction and stilling basin modifications. The specific work to be included is as follows:
• Site Analysis—Site visit to gather information including city installed
stilling basin grate,location of alternate access ramp location and
existing channel wall conditions. _$ 1,020
• Stilling Basin—Prepare construction plans and details for modifying
the stilling basin for a sump pit,access ladders and channel bottom
for an open trench to replace a portion of the existing stilling basin
drain pipe. _$ 7,790
• Access Ramp—Prepare construction plans and details for the Pierce
property access ramp and drive approach to the channel and
stilling basin. Include fencing altemative and landscape plan. Design
and detail of paver access drive. _$ 17,740
• Channel Design—Prepare construction plans and details for
reconstructing the channel sidewall. _$ 5,210
• Storm Drain Design—Prepare construction plans and details
for storm drain to relieve street runoff on Pierce property. =$ 11,670

thereby Revising the Total Contract Cost to$319,047.00(COUNCIL DISTRICT 3)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No.4 in the
amount of$57,006.00 to City Secretary Contract No. 35497 with TranSystems Corporation Consultants,for
the storm water utlitiy project Kermit—Bonnie drainage improvements,4600 block of Merida Avenue, Sarita
Channel and Waverly Park,thereby revising the total contract cost to$319,047.00.
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in Fort Worth,preserve streams,
minimize water pollution and to operate the storm water system in a more effective manner to fully comply
with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction
and system maintenance,master planning, enhanced development review and increased public education and
outreach.
The scope of this project includes preparation of plans and specifications for drainage improvements at four
locations: the Kermit—Bonnie channel and culvert;4600 Block of Merida Avenue;Sarita Channel; and
Waverly Park.At the Kermit—Bonnie channel, an undersized culvert has caused residential and roadway
flooding. Culvert improvements are needed to convey the 100—year storm flow.At the 4600 Block of Merida
Avenue,residential flooding has occurred and a storm drain extension is needed.At the Sarita Channel,
residential flooding has occurred and access ramps to the channel bottom for maintenance and improvements
to the stilling basin are needed.At Waverly Park,the storm drain system is undersized causing residential
and roadway flooding,and culvert improvements are needed to convey the 100—year storm flow.
A Request for Qualifications (RFQ)to provide drainage design was issued by the City in January of 2006 and
24 design consultants submitted statements of qualifications, including TranSystems Corporation Consultants
(TranSystems).TranSystems was selected to study the drainage in the project areas and to provide design
services for any identified drainage improvements for the Kermit—Bonnie/4600 Merida Avenue/Sarita
Channel/Waverly Park Drainage Improvements project(City Project No.00484).
On June 5, 2007,the City Council authorized the City Manager,via M&C C-22519,to execute an
engineering agreement with TranSystems Corporation Consultant(City Secretary Contract No. 35497)in the
amount of$132,305.00 for the design of drainage improvements at the four sites.
On October 16, 2007, (Ordinance No. 17840-10-2007)the City Council authorized t4 RWA4P* t)

On July 8, 2008,the City Council authorized the City Manager, via M&C C-22886, to execute Amendment
No. 1 with TranSystems(City Secretary Contract No. 37334) in the amount of$87,006.00 for additional
survey,design and FEMA—level studies of the Kermit—Bonnie drainage channel; additional survey and
design at the 4600 Block Merida Avenue; and additional survey,design and FEMA—level studies at Sarita
Channel.
On January 27, 2009,the City Manager executed administratively Amendment No. 2 with TranSystems(City
Secretary Contract No. 35497—A2)in the amount of$24,915.00 for sub—surface utility engineering services
to determine the exact location of existing utilities.
On September 22,2009, (Ordinance No. 18838-09-2009)the City Council approved the issuance and sale
of$45,000,000.00 in revenue bonds for the Storm Water Capital Project Bond 2009 Fund to fund a two—year
storm water capital project program.
On June 17, 2010,the City Manager executed administratively Amendment No. 3 with TranSystems(City
Secretary Contract No. 35497—A3)in the amount of$17,815.00 for the preparation of a drainage easement
and for the provision of construction phase services for the Kermit—Bonnie, 4600 Block Merida Avenue, and
Waverly Park drainage improvements.
The need for additional design scope has been identified. Amendment No.4 will provide the following:
additional survey and design at the Sarita Channel, and the provision of construction phase services for the
Sarita Channel drainage improvements.
TranSystems proposes to perform the additional services for a lump sum fee of$57,006.00. City staff
considers the fee to be fair and reasonable for the scope of services proposed.
TranSystems is in compliance with the City's MWWBE Ordinance by committing to eight percent MWWBE
participation.The City's goal on the project is eight percent.
This project is located in COUNCIL DISTRICT 3,Mapsco 73V, 89F, 89G and 90K.
FISCAL INFORMATION:
The Financial Management Services Director certifies that funds are available in the current capital budget,
as appropriated,of the Storm Water Capital Projects Bond 2009 Fund.
