HomeMy WebLinkAboutOrdinance 26729-02-2024Ordinance No. 26729-02-2024 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE MUNI AIRPORT GRANTS FEDERAL FUND, SUBJECT- TO RECEIPT OF THE GRANT, IN THE AMOUNT UP TO $11,111,112.00, FOR THE PURPOSE OF FUNDING AN AIRCRAFT RESCUE FIRE FIGHTING VEHICLE, AIRPORT JOINT RESEAL AND PAVEMENT IMPROVEMENTS, AND THE EXTENSION OF TAXIWAY PAPA AT PEROT FIELD FORT WORTH ALLIANCE AIRPORT; PROVIDING FOR A SEVERA.BILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2023-2024 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Muni Airport Grants Federal Fund, subject to the receipt of the grant, in the amount up to $11,111,112.00, for the purpose of funding an aircraft rescue fire fighting vehicle, airport joint reseal and pavement improvements, and the extension of Taxiway Papa at Perot Field Fort Worth Alliance Airport. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 26453-09-2023 and aII other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize application for and acceptance of the Fiscal Year 2024 Airport Discretionary and Cargo Entitlement Airport Improvement Program grant, if awarded, from the Federal Aviation Administration in an amount up to $10,000,000.00 for an aircraft rescue fire fighting vehicle, airport joint reseal and pavement improvements, and the extension of Taxiway Papa at Perot Field Fort Worth Alliance Airport; 2. Authorize the use of land credits in an amount up to $1,111,112.00 for the City's in -kind local match of the project costs; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Muni Airport Grants Federal Fund in the amount up to $11,111,112.00, subject to the receipt of the grant, for the purpose of an aircraft rescue fire fighting vehicle, airport joint reseal and pavement improvements, and the extension of Taxiway Papa at Perot Field Fort Worth Alliance Airport. DISCUSSION: Each year Perot Field Fort Worth Alliance Airport (Airport) is eligible to receive Airport Discretionary and Cargo Entitlement Airport Improvement Program grant funds from the Federal Aviation Administration (FAA) based on the amount of cargo activity from the previous calendar year and discretionary dollars available in the Airport Improvement Program (AIP). The total amount of discretionary and entitlement funds and required match being applied for this year is an amount not to exceed $11,111,112.00. The Fiscal Year 2024 (FY24) Airport Discretionary and Cargo Entitlement Airport Improvement Program grant (Grant) will be used for, but not limited to, the following items: • Purchase of a new aircraft rescue fire fighting (ARFF) vehicle • Joint resealing and pavement improvements on various areas of the Airport • Extension of Taxiway Papa Fort Worth Fire Department Station 35 (FWFD Station 35) at the Airport currently maintains three ARFF vehicles to satisfy FAA emergency response requirements. According to the FAA, the average service life of ARFF vehicles are ten to twelve years, and the FAA has multiple factors to consider if an ARFF vehicle is in need of replacement. The oldest ARFF vehicle at the Airport was manufactured in 2003. Not only is it twenty- one years old and has significantly exceeded the FAA's recommended average service life, but almost all FAA criteria has been met to justify its replacement. By replacing this ARFF vehicle, the Airport will be better equipped to satisfy FAA requirements with reliable equipment that is not outdated or obsolete, as well as ensure requirements are still met if any other ARFF vehicles need to be placed out of service for maintenance. The Joint Reseal and Pavement Repair project (Joint and Pavement Project) will consist of the resealing of concrete pavement joints and miscellaneous pavement repairs on various parts of the Airport (see attached map). This Joint and Pavement Project will be broken into multiple phases dependent on funding. Phase I of the Joint and Pavement Project is 95% designed, and this FY24 Grant will be used for construction. If any funds remain, they will be used for design of Phase 11 of the Joint and Pavement Project. The Taxiway Papa Extension project (Taxiway Papa Project) is located on the west side of the Airport (see attached map), and will provide greater ease of access to tenants on the west side of the Airport and allow for better, overall operational efficiency. It also provides additional public protection along the west perimeter of the Airport by providing a larger protection zone that will enhance the margin of safety on airport property in accordance with FAA Advisory Circulars. Phase 1 and Phase 11 are already complete, and Phase III is currently in construction. Funds, if any, received from this Grant will be used for the design of Phases IV and V. Existing land credits remaining from land donations at the Airport will be used for the City's in -kind match of $1,111,112.00. Since no City salaries will be charged, indirect cost recovery does not apply. Perot Field Fort Worth Alliance Airport is located in COUNCIL DISTRICT 10. CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, in the Muni Airport Grants Federal Fund. The Aviation Department (and Financial Management Services) will be responsible for the collection and deposit of funds due to the City.
